Introduce Ordinance No. NS-771 hour speed limit from Calle Barcelona to Segovia Way. to establish upon Paseo Avellano a prima facie 30 mile per ITEM EXPLANATION: Paseo Avellano is a short, two-lane roadway located in the La Costa Valley development. The road is unclassified on the Circulation Element of the General Plan and it serves as a local collector road. Paseo Avellano is built to city standards with curb and gutter, sidewalk, and street lights and there are no homes that front directly on Paseo Avellano. From a recent traffic count, the 24-hour traffic volumes were found to range from about 4,500 vehicles per day near Calle Barcelona to about 2,900 vehicles per day near Segovia Way. A speed survey conducted on Paseo Avellano found a critical (85th percentile) speed of 31 miles per hour. The critical speed is the speed at which 85 percent of the vehicles are traveling at or below. Sections 22357 and 22358 of the California Vehicle Code authorize local authorities to establish a prima facie speed limit on the basis of the results of an Engineering and Traffic Survey. The Engineering and Traffic Survey considers such factors as the number of collisions that have occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight distance, and conditions that may not be readily apparent to the driver. At their meeting on August 1, 2005, the Traffic Safety Commission considered the results of the Engineering and Traffic Survey to establish a prima facie speed limit upon Paseo Avellano. The Commission recommended by a 5-0 vote that a 30 mile per hour prima facie speed limit be established upon Paseo Avellano from Calle Barcelona to its intersection with Segovia Way. The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic Engineer. ENVIRONMENTAL REVIEW: The installation of an official traffic control device is a project that is a Class 1 categorical exemption (minor alteration of existing structure or facility) and is, therefore, exempt from the environmental review process under the provisions of the California Environmental Quality Act (CEQA), Section 15301 (c). FISCAL IMPACT: Installing two speed limit signs upon Paseo Avellano will cost about $250. EXHIBITS: 1. Location Map. 2. NS-771 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF SECTION 10.44.740 TO ESTABLISH UPON PASEO AVELLANO APRIMA FACIE 30 MILE PER HOUR SPEED LIMIT FROM CALLE BARCELONA TO ITS INTERSECTION WITH SEGOVIA WAY. The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1: That Title IO, Chapter 10.44, of the Carlsbad Municipal Code is amended by the addition of Section 10.44.740 to read as follows: “1 0.44.740 Paseo Avellano. Upon Paseo Avellano from Calle Barcelona to its intersection with Segovia Way, the prima facie speed limit shall be thirty miles per hour.” EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen (1 5) days after its adoption.
