RECOMMENDED ACTION: Introduce Ordinance No. NS-773 hour speed limit from Black Rail Road to Cassia Road. to establish upon Poinsettia Lane a prima facie 45 mile per ITEM EXPLANATION: The portion of Poinsettia Lane between Black Rail Road and Ambrosia Lane was constructed and opened to traffic in 2004. That road segment, designated Poinsettia Lane Reach “C”, completed an important missing portion of Poinsettia Lane and now drivers can travel from Carlsbad Boulevard to Cassia Road entirely upon Poinsettia Lane. The terminus of Poinsettia Lane at Cassia Road ends in a 90” turn. Motorists are able to access El Camino Real by using Cassia Road when they turn from Poinsettia Lane. The subject segment of Poinsettia Lane is a four-lane, divided roadway constructed to City standards with curb and gutter, sidewalks, and street lights. The intersection of Poinsettia Lane at Black Rail Road is controlled with a four-way stop and the intersection of Poinsettia Lane at Ambrosia Lane is controlled with a traffic signal. Poinsettia Lane, from Paseo del Norte to Black Rail Road, has a posted speed limit of 45 miles per hour. The recommendation of the Traffic Safety Commission would extend the 45 mile per hour speed zone on Poinsettia Lane from Black Rail Road to Cassia Road. Sections 22357 and 22358 of the California Vehicle Code authorize local authorities to establish a prima facie speed limit on the basis of the results of an Engineering and Traffic Survey. The Engineering and Traffic Survey considers such factors as the number of collisions that have occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight distance, and conditions that may not be readily apparent to the driver. At their meeting on August 1, 2005, the Traffic Safety Commission considered the results of the Engineering and Traffic Survey to establish a prima facie speed limit upon Poinsettia Lane. The Commission recommended by a 5-0 vote that a 45 mile per hour prima facie speed limit be established upon Poinsettia Lane from Black Rail Road to its intersection with Cassia Road. The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic Engineer. ENVIRONMENTAL REVIEW: The installation of an official traffic control device is a project that is a Class 1 categorical exemption (minor alteration of existing structure or facility) and is, therefore, exempt from the environmental review process under the provisions of the California Environmental Quality Act (CEQA), Section 15301 (c). NS-773 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE REVISION OF SECTION 10.44.360 TO ESTABLISH A PRIMA FACIE 45 MILE PER HOUR SPEED LIMIT UPON POINSETTIA LANE FROM BLACK RAIL ROAD TO ITS INTERSECTION WITH CASSIA ROAD. The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION I: That Title IO, Chapter 10.44 of the Carlsbad Municipal Code is amended “y the revision of Section 10.44.360 to read as follows: “10.44.360 Poinsettia Lane: a. Upon Poinsettia Lane from Carlsbad Boulevard to its intersection with Paseo del Norte the prima facie speed limit shall be thirty-five miles per hour. b. Upon Poinsettia Lane from Paseo del Norte to its intersection with Cassia Road the prima facie speed limit shall be forty-five miles per hour.” EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its adoption.
