ESTABLISH A PRIMA FACIE SPEED LIMIT UPON A ‘ITY ATTym@
PORTION OF POINSETTIA LANE
RECOMMENDED ACTION:
Adopt Ordinance No. NS-773 amending Title 10, Chapter 10.44 of the Carlsbad Municipal
Code by the revision of Section 10.44.360 to establish a prima facie 45 mile per hour speed
limit upon Poinsettia Lane from Black Rail Road to its intersection with Cassia Road.
ITEM EXPLANATION:
Ordinance No. NS-773 was introduced and first read at the City Council meeting held on
September 13, 2005. The second reading allows the City Council to adopt the ordinance,
which would then become effective in thirty days. The City Clerk will have the ordinance
published within fifteen days, if adopted.
FISCAL IMPACT:
See Agenda Bill No. 18,278 on file with the City Clerk.

ORDINANCE NO. NS-773
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44,
OF THE CARLSBAD MUNICIPAL CODE BY THE REVISION OF
SECTION 10.44.360 TO ESTABLISH A PRIMA FACIE 45 MILE PER
HOUR SPEED LIMIT UPON POINSETTIA LANE FROM
BLACK RAIL ROAD TO ITS INTERSECTION WITH CASSIA ROAD.
The City Council of the City of Carlsbad, California, hereby ordains as follows:
SECTION 1 : That Title IO, Chapter 10.44 of the Carlsbad Municipal Code is amended by
:he revision of Section 10.44.360 to read as follows:
‘‘I 0.44.360 Poinsettia Lane:
a. Upon Poinsettia Lane from Carlsbad Boulevard to its
intersection with Paseo del Norte the prima facie speed limit shall be
thirty-five miles per hour.
b. Upon Poinsettia Lane from Paseo del Norte to its intersection
with Cassia Road the prima facie speed limit shall be forty-five miles
per hour.”
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and
:he City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be
wblished at least once in a newspaper of general circulation in the City of Carlsbad within fifteen
