RECOMMENDED ACTION:
Adopt Resolution No. 2005298
and setting a public hearing for November 8,2005.
declaring the intention to vacate a portion of Sapphire Drive
ITEM EXPLANATION:
Saddleview, LLC, owners of the real property shown on the tentative map for CT 02-07, have filed
an application to vacate a portion of Sapphire Drive.
On June 16, 2004, the Planning Commission adopted Resolution No. 5647 approving a tentative
map for Emerald Point Estates, CT 02-07. The tentative map identified the proposed vacation of a
portion of Sapphire Drive. The vacation is necessary in order to develop the property as contemplated on the tentative map.
In conformance with the approved tentative map, the developer is currently processing a final map
for the subject property and concurrently processing the subject street vacation. The final map,
grading, and improvement plans for the proposed development will be complete and secured prior
to recording a resolution vacating the portion of Sapphire Drive.
Utility Companies have been notified of the proposed vacations; no objections have been received.
ENVIRONMENTAL REVIEW:
The activity is exempt per CEQA Section 15061 (b) 3.
FISCAL IMPACT:
Approval of this vacation will result in 0.076 acres of land to be returned to the tax rolls.

RESOLUTION NO. 2005298
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, DECLARING THE INTENTION TO
VACATE A PORTION OF SAPPHIRE DRIVE AND SETTING A PUBLIC HEARING.
WHEREAS, Saddleview, LLC has submitted an application to vacate a portion of Sapphire
Drive; and
WHEREAS, the Planning Commission did on June 16, 2004, adopt Resolution No. 5647
approving a tentative map, CT 02-07, for the Emerald Point Estates project; and
WHEREAS, the tentative map of Carlsbad Tract CT 02-07 contemplated the vacation of a
Dortion of Sapphire Drive; and
WHEREAS, a final map for CT 02-07 is currently being processed and all necessary
mprovements will be completed or secured prior to recordation of a resolution of vacation; and
WHEREAS, the City Engineer has determined that this portion of Sapphire Drive is not
ieeded for present or future street purposes; and
WHEREAS, the proposed vacation is in accordance with the Growth Management Policies
and is consistent with the General Plan of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
Salifornia, as follows:

That the above recitations are true and correct.
It is Council's said intention to vacate, for public street purposes, a portion of
Sapphire Drive as described in Exhibit "A" and shown for the sake of clarity on Exhibit "B".
3. It also shall be Council's said intention to conduct the proceedings for this street
lacation under the California Streets and Highways Code, Division 9, Part 3, Chapter 3.
4. A public hearing shall be held at the City Council Chambers at 1200 Carlsbad
Jillage Drive, Carlsbad, California, at 6:OO p.m., on Nowmber 8, 2005.

5. That the City Clerk is instructed to publish this resolution of intention in the local
newspaper and the City Engineer is instructed to post such notices along the site in accordance
with the California Streets and Highways Code.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 4th day of October , 2005 by the following vote, to wit:
