RECOMMENDED ACTION
Adopt Resolution No. 2005-313 authorizing additional overtime to fund
enhanced City enforcement efforts in the downtown village area.
ITEM EXPLANATION
The Fire and Police Departments have identified an increase in the incidence of
establishment overcrowding and an increase in the number of fights and intoxicated
persons in and around the downtown village area. In March 2005 the Fire
Department joined with the Police Department in conducting enhanced downtown
enforcement operations focusing on downtown bars and restaurants, to provide a
visible presence and to enforce applicable laws. Since the inception of this
enforcement, a deputy fire marshal has conducted fire code enforcement activities
every Friday and Saturday night from approximately 9:30 p.m. to 2:30 a.m., as well as
during high-profile events and holidays in the downtown area. The Police Department
has mirrored this effort by staffing two additional officers on an overtime basis on
Friday and Saturday nights for five hours each night, as frequently as staff is
available. Additionally, four extra enforcement nights were staffed since March.
Those efforts varied from a 6-person local effort to a 40-person multi agency, citywide
combination DUI sweep and bar enforcement detail.
The Police and Fire Departments are recommending the continuation of the Friday
and Saturday night enforcement with two police officers and one fire department
member for five (5) hours each night through the balance of the 2005/2006 fiscal
year. In addition, a Special Enforcement Detail is proposed for operation through the
end of the fiscal year. This detail would employ flexible scheduling that may include
shifting a weekend night effort to another day depending on holidays or other special
concerns. This detail would be a sweep strategy where officers focus a high level of
enforcement on a specific area on selected days. It is estimated that this additional
Special Enforcement Detail would be utilized approximately eight (8) times through
the end of the fiscal year. The special detail’s operation would include the regular
Friday and Saturday night detail personnel plus additional staff for a total of one
sergeant, seven officers, two fire department personnel and one dispatcher. The
impact of these additional enforcement efforts would not require any additional
overtime for either Code Enforcement or Public Works.
FISCAL IMPACT
The cost of this additional enforcement through the end of the fiscal year is $65,000.
This includes overtime for two officers and one fire department member every Friday
and Saturday night for approximately 35 remaining weekends in the fiscal year (five
hours each). It also includes overtime for an additional five officers, one fire
department member, one police sergeant, and one dispatcher for eight additional
special details (five hours each). It is recommended that an account be established to
fund this effort and that any funds not expended by the end of FY 05/06 would be
returned to the general fund.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
ADDITIONAL OVERTIME TO FUND ENHANCED
CITY ENFORCEMENT EFFORTS IN THE
DOWNTOWN VILLAGE AREA.
WHEREAS, the City of Carlsbad desires to provide a downtown village area
that is safe and enjoyable for residents and visitors alike; and
WHEREAS, the City wishes to provide additional enforcement to address
WHEREAS, the City desires to fund overtime for police and fire personnel
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
establishment overcrowding and other public safety issues; and
though the end of the fiscal year to meet these additional enforcement duties.
Carlsbad, as follows:
1. That the above recitations are true and correct.
2. That the finance director is authorized to appropriate $65,000 from the Council
contingency fund for additional enforcement overtime.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the City Council of the City of
Carlsbad, California, held on the 18th day of October , 2005, by the following
vote, to wit:
