TITLE: ADOPTION OF ORDINANCE APPROVING
THE NORTH COUNTY HABITAT BANK
ZONE CHANGE - ZC 04-11 CITY ATTY

RECOMMENDED ACTION:
Adopt Ordinance No. NS-776, approving the North County Habitat Bank Zone Change (ZC
04-11) on approximately 18.73 acres of property generally located on the south side of
Palomar Airport Road between Armada Drive and Hidden Valley Road, in Local Facilities
Management Zone 5.
ITEM EXPLANATION
Ordinance No. NS-776 was introduced and first read at the City Council meeting held on
October 18, 2005. The second reading allows the City Council to adopt the ordinance, which
would then become effective in thirty days. The City Clerk will have the ordinance published
within fifteen days, if adopted. (Notwithstanding the preceding, this ordinance shall not be
effective in the Coastal Zone until it is approved by the California Coastal Commission.)

ORDINANCE NO. NS-776
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE NORTH COUNTY
APPROXIMATELY 18.73 ACRES GENERALLY LOCATED ON
THE SOUTH SIDE OF PALOMAR AIRPORT BETWEEN
ARMADA DRIVE AND HIDDEN VALLEY ROAD IN LOCAL
FACILITIES MANAGEMENT ZONE 5.

WHEREAS, the North County Habitat Bank Zone Change is in conformance with
the City of Carlsbad Habitat Management Plan for the subject property as well as current city
ordinances; and
WHEREAS, the City Council did on the 18th day of October I
2005 hold a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, said application constitutes a request for a Zone Change as shown
on Exhibit “ZC 04-1 1” dated September 7, 2005, incorporated by reference.
NOW, THEREFORE, the City Council of the City of Carlsbad does ordain as
follows:
SECTION I: That the Zone Change (ZC 04-1 I) dated September 7,2005, on file
in the Planning Department, and incorporated by reference herein, is approved. The Zone
Change shall constitute the zoning for the property and all development shall conform to the
zoning.
SECTION II: That the findings and conditions of the Planning Commission in
Planning Commission Resolution No. 5964 shall also constitute the findings and conditions of
the City Council.
EFFECTIVE DATE: This ordinance shall be effective thirty days after its
adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be
published at least once in a publication of general circulation in the City of Carlsbad within
fifteen days after its adoption. (Not withstanding the preceding, this ordinance shall not be
effective within the City’s Coastal Zone until approved by the California Coastal Commission.)

INTRODUCED AND FIRST READ at the regular meeting of the Carlsbad City
Council on the 18th dayof October 2005, and thereafter.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council
of the City of Carlsbad, California, held on the 25th day of October 2005, by
the following vote, to wit:
AYES: Council Members Lewis, Hall, Kulchin, Packard, Sigafoose
NOES: None
ABSENT: None
ABSTAIN: None
