PWSOG-02STS Adopt Resolution No. 2005-361 rejecting the bid of $84,921 from CH&D Construction and accepting the bid of $1 15,747 and awarding the contract to D.G. Yeager Construction to repair and replace curb, gutter, and sidewalks, Contract No. PWSOG-02STS. 2. D.G. Yeager Construction 3. Tri-Group Construction and Development, Inc. 4. Koch Armstrong General Engineering, Inc. ITEM EXPLANATION: $1 15;747.00 $1 16,127.00 $1 94,087.25 The Streets Department bids out several contracts for sidewalk, concrete curb and gutter repair per year in order to keep up with the maintenance of the City's sidewalks, curbs and gutters. It was estimated based on earlier contract unit costs that the cost of this work would be below $100,000 and, therefore, a City Council request for approving plans and specs was not initiated. The lowest responsive bid is now over $100,000 and requires City Council approval to award the contract. Four bids were received, opened, witnessed and recorded on August 24, 2005. The bid amounts ranged from $84,921 to $194,087.25. The bids were reviewed by the Public Works Department and were as follows: I 1. CH&D Construction I $84,921.00 I CH&D Construction submitted the lowest bid in the amount of $84,921. However, the bid submitted by CH&D Construction does not meet the contractual requirement that the Bidder have an active contractor's license. Therefore, staff recommends the bid from CH&D Construction be declared non-responsive in accordance with the contract documents. D.G. Yeager Construction submitted the lowest responsive bid. Therefore, staff recommends the contract be awarded to D.G. Yeager Construction, the lowest responsive bidder, in the amount of $1 15,747. The contractor's registration and bonds are in order and references are satisfactory. Contract documents are on file in the General Services offices of Public Works. ENVIRONMENTAL REVIEW: This agreement is not a project as defined by Section 15378 of the CEQA Guidelines. FISCAL IMPACT: The total estimated construction cost of $1 15,747 for this project will be funded from the Streets Department concrete maintenance account. EXHIBITS: 1. PWSOG-02STS. WHEREAS, bids have been solicited by the City of Carlsbad, California to replace and repair City curb, gutter, and sidewalk facilities in various locations; and WHEREAS, the bids were received, opened, witnessed and recorded on August 24,2005; and WHEREAS, the lowest bid received was submitted by CH&D Construction in the amount Df $84,921 ; and WHEREAS, the City of Carlsbad requires that the all bids evidence that the bidder have a Jalid contractor’s license and that any bid that does not do so will be rejected as non-responsive; and WHEREAS, CH&D Construction did not possess a valid contractor’s license at the time of Did submittal; and WHEREAS, the lowest responsive bid received was submitted by D.G. Yeager Construction in the amount of $1 15,747; and WHEREAS, City curb, gutter, and sidewalk repairs are necessary to maintain City standards; and WHEREAS, the contract cannot be awarded without City Council approval; and WHEREAS, sufficient funds are available in the Streets Maintenance Budget. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. 2. ?ejected. 3. That the above recitations are true and correct.
