RECOMMENDED ACTION:
Adopt Resolution No. 2005-366 accepting the construction of the Traffic Signal at
Carlsbad Village Drive and Chatham Road, Project No. 3918-1 , as complete, and directing the
City Clerk to record a Notice of Completion and release bonds in accordance with State Law
and City Ordinances.
ITEM EXPLANATION:
On May 18, 2004, HMS Construction, Inc. was awarded a contract in the amount of $145,184 for
the construction of the Traffic Signal at Carlsbad Village Drive and Chatham Road, Project No.
391 8-1.
HMS Construction, Inc. completed the traffic signal improvement work on February 1, 2005. City
staff has inspected the work and found it to be satisfactory. Staff recommends formal acceptance
of the improvements by the City Council.

The approval of a Notice of Completion is a ministerial process and is exempt from the
requirements of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

RESOLUTION NO. 2005-366
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING CONSTRUCTION OF THE
TRAFFIC SIGNAL AT CARLSBAD VILLAGE DRIVE AND CHATHAM
ROAD, PROJECT NO. 3918-1.
WHEREAS, the construction of the Traffic Signal at Carlsbad Village Drive and Chatham
Road was completed to the City's satisfaction by HMS Construction, Inc. on February 1, 2005;
and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the Traffic Signal at Carlsbad Village Drive and Chatham Road, specifically
dentified as Project No. 3918-1, is deemed complete and is hereby accepted by the City Council
sf the City of Carlsbad.
3. The City Clerk of the City of Carlsbad is hereby authorized and directed to execute
md record the Notice of Completion for the Traffic Signal at Carlsbad Village Drive and Chatham
