Introduce Ordinance No. NS-782 hour speed limit from El Camino Real to Melrose Drive. to establish upon Poinsettia Lane a prima facie 50 mile per ITEM EXPLANATION: The entire segment of Poinsettia Lane from El Camino Real to Melrose Drive was opened to traffic in June 2005. However, portions of this segment on the easterly end had been serving public traffic for a number of years. Poinsettia Lane is designated as a major arterial on the Circulation Element of the General Plan. It is constructed to city standards with four traffic lanes divided by a raised, landscaped median, bicycle lanes, curb and gutter, sidewalk or D. G. trail on each side and street lights. Traffic signals have been installed at three locations within the subject segment. School zone signing is provided on Poinsettia Lane for Carrillo Elementary School that takes access to/from Poinsettia Lane at the signalized intersection of Paseo Escuela. Sections 22357 and 22358 of the California Vehicle Code authorize local authorities to establish a prima facie speed limit on the basis of the results of an Engineering and Traffic Survey. The Engineering and Traffic Survey considers such factors as the number of collisions that have occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight distance, and conditions that may not be readily apparent to the driver. At their meeting on December 5, 2005, the Traffic Safety Commission considered the results of the Engineering and Traffic Survey to establish a prima facie speed limit upon the subject portion of Poinsettia Lane. The Commission recommended by a 5-0 vote that a 50 mile per hour prima facie speed limit be established upon Poinsettia Lane from El Camino Real to its intersection with Melrose Drive. The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic Engineer. ENVIRONMENTAL REVIEW: The installation of an official traffic control device is a project that is a Class 1 categorical exemption (minor alteration of existing structure or facility) and is, therefore, exempt from the environmental review process under the provisions of the California Environmental Quality Act (CEQA), Section 15301 (c). FISCAL IMPACT: Installing eight speed limit signs upon Poinsettia Lane will cost about $1,000. EXHIBITS: 1. Location Map. 2. NS-782 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE REVISION OF SECTION 10.44.360 TO ESTABLISH A PRIMA FACIE 50 MILE PER HOUR SPEED LIMIT UPON POINSETTIA LANE FROM EL CAMINO REAL TO ITS INTERSECTION WITH MELROSE DRIVE. The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1 : That Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended by he revision of Section 10.44.360 to read as follows: “1 0.44.360 Poinsettia Lane: a. Upon Poinsettia Lane from Carlsbad Boulevard to its intersection with Paseo del Norte the prima facie speed limit shall be thirty-five miles per hour. b. Upon Poinsettia Lane from Paseo del Norte to its intersection with Cassia Road the prima facie speed limit shall be forty-five miles per hour. C. Upon Poinsettia Lane from El Camino Real to its intersection with Melrose Drive the prima facie speed limit shall be fifty miles per hour.” EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and he City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be iublished at least once in a newspaper of general circulation in the City of Carlsbad within fifteen 15) days after its adoption.
