RECOMMENDED ACTION:
Adopt Resolution No.2006-007authorizing a refund of business license tax to Timberland of $683.17,
The Good Guys of $1,802.59, and Mobile Systems Wireless of $821.80.
ITEM EXPLANATION:
Timberland, The Good Guys, and Mobile Systems Wireless, ceased conducting business in the City of
Carlsbad after paying their business license taxes for the year. They have requested a refund for the
period of time after they stopped conducting business in Carlsbad.
The Finance Department has confirmed the date the above businesses ceased conducting business in
the City, verified the business tax computations and confirmed the refund amounts.
Section 5.04.130 of the Carlsbad Municipal Code requires Council approval of any refund in excess of
$500. Therefore, staff is recommending approval of refunds to Timberland of $683.17, The Good Guys
of $1,802.59, and Mobile Systems Wireless of $821.80.
FISCAL IMPACT:
The payments will result in $3,307.56 in refunds, which will be a reduction in business license revenue
for fiscal year 2005-2006.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, REFUNDING
BUSINESS TAX PAYMENT TO TIMBERLAND;
THE GOOD GUYS; MOBILE SYSTEMS
WIRELESS.
WHEREAS, Timberland; The Good Guys; Mobile Systems Wireless overpaid their
business license taxes to the City of Carlsbad; and
WHEREAS, the Finance Department confirmed the overpayment by Timberland; The
Good Guys; Mobile Systems Wireless and verified the refund amount.
NOW, THEREFORE, BE IT RESOLVED,
SECTION 1. That the above recitals are all true and correct.
SECTION 2. That a refund of business license tax of $683.17 to Timberland, $1,802.59
to The Good Guys, and $821.80 to Mobile Systems Wireless is authorized.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 17th day of January , 2006 by the following vote, to wit:
