RECOMMENDED ACTION:
Introduce Ordinance No. NS-784 to establish a prima facie 40 mile per hour speed limit upon
Alicante Road from Alga Road to its intersection with Poinsettia Lane.
ITEM EXPLANATION:
Alicante Road follows a curvilinear alignment between Alga Road and Poinsettia Lane. The subject
road segment is unclassified on the Circulation Element of the General Plan, however, it functions
as a collector road and serves new residential development. Alicante Road has been constructed
as a two-lane roadway and has curb and gutter, sidewalks, and street lights on both sides
according to Engineering Department roadway standards. Recent traffic counts found the 24-hour
average daily traffic (ADT) volumes to be less than 1,900 vehicles per day on Alicante Road.
The segment of Alicante Road south of Alga Road has a posted speed limit of 40 miles per hour.
Sections 22357 and 22358 of the California Vehicle Code authorize local authorities to establish a
prima facie speed limit on the basis of the results of an Engineering and Traffic Survey.
The Engineering and Traffic Survey considers such factors as the number of collisions that have
occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic
volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight
distance, and conditions that may not be readily apparent to the driver.
At their meeting on December 5, 2005, the Traffic Safety Commission considered the results of the
Engineering and Traffic Survey to establish a prima facie speed limit upon the subject portion of
Alicante Road. The Commission recommended by a 5-0 vote that a 40 mile per hour prima
facie speed limit be established upon Alicante Road from Alga Road to its intersection with
Poinsettia Lane.
The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic
Engineer.
ENVIRONMENTAL REVIEW:
The installation of an official traffic control device is a project that is a Class 1 categorical
exemption (minor alteration of existing structure or facility) and is, therefore, exempt from the
environmental review process under the provisions of the California Environmental Quality Act
(CEQA), Section 15301(c).
FISCAL IMPACT:
Installing six speed limit signs upon Alicante Road will cost about $750.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER
10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE REVISION
OF SECTION 10.44.210 TO ESTABLISH A PRIMA FACIE 40 MILE
PER HOUR SPEED LIMIT UPON ALICANTE ROAD FROM
ALGA ROAD TO ITS INTERSECTION WITH POINSETTIA LANE.
The City Council of the City of Carlsbad, California, hereby ordains as follows:
SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended
by the revision of Section 10.44.210 to read as follows:
a. Upon Alicante Road from Alga Road to its intersection with
Corte de la Vista, the prima facie speed limit shall be forty miles per

EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and14

published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen

(15) days after its adoption.
