RECOMMENDED ACTION:
Adopt Resolution No. 2006-021 approving the City of Carlsbad's application to the
California Integrated Waste Management Board (CIWMB) Rubberized Asphalt Concrete Grant
Program and authorizing the Public Works Director, or his designee, to sign all related grant
documents.
ITEM EXPLANATION:
The California Integrated Waste Management Board (CIWMB) receives an annual appropriation
from the California Tire Recycling Management Fund to administer the Tire Recycling Act. As part of
the Act, CIWMB is offering the Rubberized Asphalt Concrete Grant Program to encourage the
reduction of landfill disposal and stockpiling of California waste tires. The CIWMB will award the
grants on a competitive basis. The proposed funding allocation for Fiscal Year 2005-06 is
one million six hundred sixty-three thousand dollars ($1,663,000).
As part of the ongoing Pavement Management Program, the City utilizes rubberized asphalt
concrete overlays to maintain roadways throughout the City. The proposed grant application is for
the rubberized asphalt concrete overlay project scheduled for construction in the summer of 2006.
The current scope of this project includes the installation of approximately 37,000 tons of rubberized
asphalt concrete.
Staff recommends that the City Council delegate signature authority for all CIWMB grant-related
documents to the Public Works Director or his designee. This delegation of signature authority will
make the grant application and administration process more efficient.
ENVIRONMENTAL REVIEW:
The proposed grant application is exempt from environmental review under the California
Environmental Quality Act Section 15061 (b)(3), because it can be seen with certainty that there is no
possibility that the grant application may have a significant effect on the environment.
FISCAL IMPACT:
If the City's grant application is approved by CIWMB, the funds will be used to supplement the
2005-06 Pavement Management Program funding which comes from TransNet Local,
Non-Jurisdictional fee and Gas Tax revenues. Similar to last year, this year's grant program has a
funding limit of fifty thousand dollars ($50,000) per project. Based on this limitation and the size of
the candidate project, the City could receive as much as fifty thousand dollars ($50,000) in grant
funding. In 2004-05, the CIWMB awarded the City a $50,000 grant which will be deposited in the
Pavement Management Fund upon receipt.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE APPLICATION
OF THE 2005-06 RUBBERIZED ASPHALT CONCRETE
GRANT PROGRAM AND DELEGATING SIGNATURE
AUTHORITY FOR GRANT DOCUMENTS.
WHEREAS, grant funding has been established as part of the Tire Recycling Act and is
available to cities and counties through the California Integrated Waste Management Board to
encourage the reduction of landfill disposal and stockpiling of California waste tires; and
WHEREAS, the City of Carlsbad is desirous of applying for these funds; and
WHEREAS, the program requires that grant applications be approved by the City Council
and signature authority be appointed by City Council resolution.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. The submittal of the 2005-06 Rubberized Asphalt Concrete Grant Application is
approved.
3. The Public Works Director, or his designee, are appointed as the signature
authority for all grant documents.

held on the 7th day of February , 2006 by the following vote, to wit:

Environmental Justice
Public entities that receive grant funding from CIWMBfor this grant program must comply with the following
principles of Environmental Justice. Environmental Justice is defined in Government Code Section 65040.12(e)
as: " ...the fair treatment of people of all races, cultures, and incomes with respect to the development, adoption,
implementation and enforcement of environmental laws, regulations, and policies. " Senate Bill 115 (Solis,
Statutes 1999, Chapter 690) broadly requires all California Environmental Protection Agency boards,
departments, and offices to conduct their "programs, policies, and activities that substantially affect human
health or the environment in a manner that ensures the fair treatment of people of all races, cultures, and income
levels, including minority populations and low-income populations of the state."
