RECOMMENDED ACTION:
Adopt Ordinance No. NS-784 amending Title 10, Chapter 10.44 of the Carlsbad Municipal
Code by the revision of Section 10.44.210 to establish a prima facie 40-mile per hour speed
limit on Alicante Road from Alga Road to its intersection with Poinsettia Lane.
ITEM EXPLANATION:
Ordinance No. NS-784 was introduced and first read at the City Council meeting held on
January 24, 2006. The second reading allows the City Council to adopt the ordinance,
which would then become effective in thirty days. The City Clerk will have the ordinance
published within fifteen days, if adopted.
FISCAL IMPACT:
See Agenda Bill No. 18,419 on file with the City Clerk.

CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER
10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE REVISION
OF SECTION 10.44.210 TO ESTABLISH A PRIMA FACIE 40 MILE
PER HOUR SPEED LIMIT UPON ALICANTE ROAD FROM
ALGA ROAD TO ITS INTERSECTION WITH POINSETTIA LANE.
The City Council of the City of Carlsbad, California, hereby ordains as follows:
SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended
by the revision of Section 10.44.210 to read as follows:
a. Upon Alicante Road from Alga Road to its intersection with
Corte de la Vista, the prima facie speed limit shall be forty miles per
b. Upon Alicante Road from Alga Road to its intersection with
Poinsettia Lane, the prima facie speed limit shall be forty miles per
hour."

EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and
the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be

published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen

(15) days after its adoption.

PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 7th day of February , 2006 by the following vote, to wit:
