RECOMMENDED ACTION:
Adopt Resolution No. 2006-060 to quitclaim one slope and three construction easements located
in CT 99-04-03, Villages of La Costa-La Costa Oaks North.
ITEM EXPLANATION:
Real Estate Collateral Management Company (RECMC), owner of the real property of CT 99-04
Phase 3, Villages of La Costa-La Costa Oaks North, has requested that one slope and three
construction easements located within the development be quitclaimed. The easements were
granted to facilitate the construction of Rancho Santa Fe Road.
All work necessary for the road construction that required the use of the slope easement and two of
the three construction easements has been completed. The third construction easement (PR 05-
125) has been replaced by a new construction easement (PR 05-120). The new easement provides
the City's contractor, FCI, with sufficient access, working areas and staging area to complete the
construction of Rancho Santa Fe Road. The contractor has agreed that he no longer needs the use
of the work areas contained within the original easement. The City and FCI agreed to RECMC's
request and executed a no cost change order in which FCI agreed to relinquish its use of the original
easement. Staff recommends the City Council quitclaim the slope easement and the three
construction easements identified in the attached quitclaim deeds.
ENVIRONMENTAL REVIEW:
The proposed quitclaims are exempt from environmental review under the California Environmental
Quality Act Section 15061 (b)(3), because it has been determined that the there is no foreseeable
possibility that the quitclaims may have a significant effect on the environment.
FISCAL IMPACT:
This item has no fiscal impact to the City. The easements were granted to the City at no cost.
RECMC has paid the standard fee for processing these quitclaims.

CARLSBAD, CALIFORNIA, APPROVING THE QUITCLAIM OF ONE
SLOPE AND THREE CONSTRUCTION EASEMENTS LOCATED IN
CT 99-04-03 VILLAGES OF LA COSTA-LA COSTA OAKS NORTH
WHEREAS, Real Estate Collateral Management Company has submitted a request to
quitclaim one slope and three construction easements located in CT 99-04-03; and
WHEREAS, the easements were granted to facilitate the construction of Rancho Santa Fe
Road; and
WHEREAS, the construction of Rancho Santa Fe Road has been completed within certain
areas encumbered by the easements; and
WHEREAS, the slope easement (2002-0701686) and two of the construction easements
(2002-0701825 and 2002-0220022) are no longer necessary; and
WHEREAS, a third construction easement (2002-0995694) has been replaced with a new
construction easement; and
WHEREAS, the City Engineer has determined that the slope easement and the three
construction easements are no longer needed for their intended purpose.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the quitclaim deeds conveying a slope easement and three construction
easements located in CT 99-04-03 Villages of La Costa-La Costa Oaks North to Real
Estate Collateral Management Company, are on file with the City Clerk and are
incorporated by this reference are approved.

3. That the Mayor is authorized to execute the original quitclaim deeds and the City
Clerk is hereby authorized to cause the original quitclaim deeds to be recorded in the
office of the County Recorder of San Diego County, State of California.

held on the 2lst day of March 2006 by the following vote, to wit:
