ENG TITLE: SUMMARILY VACATE A PORTION OF RANG HO SANTA FE ROAD (CITYATTY. (STV 04-05) CITY MGR. DEPT. HD. RECOMMENDED ACTION: Adopt Resolution No. 2006-063 summarily vacating a portion of Rancho Santa Fe Road. ITEM EXPLANATION: The applicant, Real Estate Collateral Management Company (RECMC), owner of the real property of CT 99-04 Phase 3 Villages of La Costa - La Costa Oaks North, has filed an application with the City to vacate a portion of Rancho Santa Fe Road. The City is in the process of constructing a new, realigned Rancho Santa Fe Road (RSF). The traffic has been shifted from the old RSF alignment to the new one. The right-of-way for the old RSF alignment that traverses the La Costa Oaks North development is no longer needed. There are also portions of old street right-of-way dedicated in the 1920's north of San Marcos Creek that were never used for street purposes. The permanent right-of-way for RSF and a portion of San Elijo Road were dedicated overlaying portions of the old RSF alignment. The vacation of the old RSF alignment does not negate or override the dedication of the new RSF and San Elijo Road. Utility companies have been notified of this street vacation request and have no objections. ENVIRONMENTAL REVIEW: The activity is exempt per CEQA Section 15061(b) 3. FISCAL IMPACT: RECMC has paid the standard fee for processing this vacation. Approval of this vacation will result in approximately 4 acres of land to be returned to the tax rolls. EXHIBITS: 1. DEPARTMENT CONTACT: Frank Jimeno, (760) 602-2758, fjime@ci.carlsbad.ca.us LOCATION MAP STREET VACATION STV 04-05 VICINITYMAP NTS PROJECT NAME:STREET VACATION RANCHO SANTA FE ROAD CT 99-04-03 STV 04-05 1 RESOLUTION NO. 2006-063 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, SUMMARILY VACATING A PORTION OF RANCHO SANTA FE ROAD (STY 04-05). 4 WHEREAS, a request has been made to vacate a portion of Rancho Santa Fe Road 5 within the real property of CT 99-04 Phase 3 Villages of La Costa - La Costa Oaks North 6 development; and 7 WHEREAS, Rancho Santa Fe Road has been realigned; and 8 WHEREAS, construction of the realigned Rancho Santa Fe Road North has resulted in 9 traffic being shifted off the old Rancho Santa Fe Road alignment; and 10 WHEREAS, the City Engineer has determined that this portion of the old Rancho Santa Fe 11 Road alignment is no longer needed for present or future street purposes; and 12 WHEREAS, vacating the portion of the old Rancho Santa Fe Road alignment is not 13 intended to vacate the easements for public street and public utility purposes granted to the City 14 of Carlsbad per document 2003-0995693 recorded August 15, 2003, and document 2004- 15 0174128 recorded March 3, 2004, both at the County Recorder's Office of the County of San 16 Diego; and 17 WHEREAS, the proposed vacation is consistent with the General Plan of the City; and18 WHEREAS, utility companies have no objections to the proposed vacation.19 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 20 California, as follows: 21 1. That the above recitations are true and correct.22 2. That pursuant to Division 9, Part 3, Chapter 4 of the California Street and Highways23 Code, said portion of the old Rancho Santa Fe Road alignment more particularly described in Exhibit A, and shown for the sake of clarity in Exhibit B, be summarily vacated. 3.
