Project Nos. 36071, 36211, and 63041, and appropriation of funds.
ITEM EXPLANATION:
The subject project consists of the construction of new traffic signals at the Faraday Avenue/
Orion Street and Faraday Avenue/Priestly Drive intersections, as well as intersection widening
and signal improvements at El Camino Real and Faraday Avenue. These improvements will
accommodate the traffic volumes and patterns that will occur as a result of the extension of
Faraday Avenue from Orion Street to the easterly city limit, which is currently being constructed by
the developer of the Carlsbad Oaks North project.
On December 20, 2005, through the adoption of Resolution No. 2005-375, City Council approved
plans and specifications and authorized the advertisement for bids for construction of El Camino
Real/Faraday Avenue intersection improvements, Faraday Avenue/Orion Street traffic signal, and
Faraday Avenue/Priestly Drive Traffic Signal Project Nos. 36071, 36211, and 63041. Eight (8) bids
were received on February 9, 2006, which are summarized as follows:

The Engineer's Estimate for this project is $1,115,019. The apparent lowest responsive bidder is
Hillcrest Contracting in the amount of $1,239,141, which is 10.7% higher than the Engineer's
Estimate. Material suppliers indicate that costs for materials continue to increase significantly.
Therefore, requesting new bids will not result in a lower construction cost. Staff has completed its
review of all documents and finds that they are in order. Therefore, staff recommends that
Hillcrest Contracting be awarded the contract.
To accommodate the construction of the improvements of the right-turn lane along southbound
El Camino Real, the City acquired public road and public utility easements from the property owners.
Staff has obtained a right of entry from the property owners on the east side of El Camino Real to
facilitate some relatively minor reconstruction of driveway and utility features associated with their
properties. The right-of-way acquisitions were previously approved by Resolution Nos. 2006-064
and 2006-067.
Staff is in the process of acquiring an additional 34 square feet of public road and public utility
easement, valued at less than $2,000, at the southeast corner of El Camino Real and
Faraday Avenue for the installation of a signal light. Staff is in discussion with the property owner.
However, if agreement cannot be reached before contract approval, the signal location will be
adjusted in the field to be within the City's current right-of-way.

ENVIRONMENTAL REVIEW:
Carlsbad Municipal Code Section 19.040.060 directs the Planning Director to determine whether a
public project is exempted from the environmental review process of the California Environmental
Quality Act (CEQA). The Planning Director has determined that this project will not have a significant
environmental effect. Accordingly, this project is exempt under Section 15061(b)(3) of the California
Code of Regulations. This section states that CEQA only applies to projects that have the potential
for causing a significant effect on the environment. This project will have no significant effect
because it involves only negligible expansion of existing facilities and impacts no sensitive plants or
animal life.

Notes:
1) Construction contingency is 10% for signal construction (36211 and 63041) and 20% for widening (36071) based on
construction bid.
2) Project administration and inspection is 5% of construction bid.
Staff is recommending that an additional $237,541 be appropriated from the Traffic Impact Fee (TIF)
and Gas Tax fund, as shown in the above table, to fully fund the improvements included in the
project. The increase in total project costs is attributed to a $124,122 increase in the construction bid
over Engineer's Estimate, a recommended $58,419 increase for contingency, administration, and
inspection costs, and $55,000 for miscellaneous engineering costs.

WHEREAS, the project is exempt from the California Environmental Quality Act pursuant
to CEQA Section 15061 (b)(3); and
WHEREAS, a Notice of Exemption has been filed by the Planning Director in compliance
with Section 21152b of the Public Resources Code (California Environmental Quality Act); and
WHEREAS, on December 20, 2005, through the adoption of Resolution No. 2005-375, the
City Council approved plans and specifications for furnishing of all labor, materials, tools,

equipment, transportation, and other expenses necessary or incidental to the El Camino

19 WHEREAS, eight (8) sealed bids were received on February 9, 2006 for the project; and
WHEREAS, the lowest responsive, responsible bid for the project was submitted by
Hillcrest Contracting in the amount of $1,239,141; and
WHEREAS, on March 21, 2006, through the adoption of Resolution Nos. 2006-064 and
2006-067, the City Council authorized the acquisition of public street and public utility easements
from BTINV, LLC and KW Fund l-Carlsbad 1, LP/Sunrise property associates, LLC, for the
intersection improvements at El Camino Real and Faraday Avenue, Project No. 36071; and

WHEREAS, additional Traffic Impact Fee funds need to be appropriated in order to

construct the ECR/Faraday Avenue Intersection Improvements and the Faraday Avenue/

Orion Street Traffic Signal; and

2. That the bid submitted by Hillcrest Contracting in the amount of $1,239,141 for the9
project, is hereby accepted and the Mayor is here authorized to execute the contract for10
the construction of the El Camino Real/Faraday Avenue Intersection Improvements,

Faraday Avenue/Orion Street Traffic Signal, and Faraday Avenue/Priestly Drive Traffic Signal

Project, Project Nos. 36071, 36211, and 63041, in accordance with the plans, specifications, and
13 contract documents referred to herein.

WHEREAS, there are sufficient Traffic Impact Fee funds available for the additional
appropriation; and
WHEREAS, additional Gas Tax funds need to be appropriated in order to construct the
Faraday Avenue/Priestly Traffic Signal; and
WHEREAS, there are sufficient Gas Tax funds available for the additional appropriation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
3. That the Finance Director is hereby authorized to appropriate $144,491 from the
15 Traffic Impact Fee fund for the project.
4. That the Finance Director is hereby authorized to appropriate $93,050 from the
17 Gas Tax fund for the project.
18 5. That the City Manager is hereby authorized to approve construction change orders
19 up to $197,300 for Hillcrest Contracting for the El Camino Real/Faraday Avenue Intersection
20 Improvements, Faraday Avenue/Orion Street Traffic Signal, and Faraday Avenue/Priestly Drive
21 Traffic Signal Project, Project Nos. 36071, 36211, and 63041.

6. That the award of this contract is contingent upon Hillcrest Contracting executing
the required contract and submitting the required bonds and insurance policies, as described in
the contract, within twenty (20) calendar days of adoption of this resolution. The City Manager
may grant reasonable extensions of time.
