HD. £ 4^0 CITYATTY. &>* CITY MGR."5^V RECOMMENDED ACTION: Adopt Resolution No. 2006-092 accepting the bid of $297,511.60 and awarding the contract to Court Concepts, Inc., to perform Tot Lot Improvements 2005-2006, Contract No. 39441, Project No. PKS 06-01 and approving appropriation of additional funds. ITEM EXPLANATION: Improvements are needed on tot lots at various park sites throughout the City. Specifically, certain playground equipment that does not meet Americans with Disabilities Act (ADA) standards must be removed and replaced with compliant equipment at four park sites. In addition, new equipment and/or resilient surfacing will be installed at 3 additional park sites. Resilient surfacing is required by law to meet Americans with Disabilities Act (ADA) standards, and to provide required protection from injuries. Existing surfacing that has hardened due to age must be replaced with new resilient surfacing to meet safety standards at all locations. Over 4,800 total square feet of cushioned rubberized surfacing will be installed to provide access to the playground equipment. Staff recommends that Council approve additional funding to complete the project at this time rather than in the 2006-2007 fiscal year CIP budget. Performing the work at this time will minimize exposure to risk of legal action for non-compliance with the ADA and will minimize risk of injury. Listed below are the park sites where these improvements are to be installed. Project Locations • Holiday Park • Hosp Grove Park • La Costa Canyon Park • Laguna Riviera Park • Poinsettia Park • Scout House • Stagecoach Park On February 7, 2006, City Council adopted Resolution 2006-025 approving contract documents and special provisions, and authorized the City Clerk to advertise for bids for this project. Three bids were received, opened, witnessed and recorded on March 29, 2006. The bid amounts ranged from $297,511.60 to $447,888.00. The bids were reviewed by the Public Works Department and were as follows: Court Concepts, Inc. Tri-Group Construction and Development, Inc. Romero General Construction, Inc. $297,511.60 $424,907.00 $447,888.00 Staff has reviewed the bid received from Court Concepts, Inc. and has determined that the bid is very competitive. This bid is valid for 90 days. Delaying award until after the 2006-2007 CIP is approved may invalidate this bid and could result in higher cost for the needed work. Page 2 Court Concepts, Inc. submitted the lowest responsive bid. Therefore, staff recommends the contract be awarded to Court Concepts, Inc., the lowest responsive bidder, in the amount of $297,511.60. The contractor's registration and bonds are in order and references are satisfactory. Contract documents are on file in the General Services offices of Public Works. The Engineer's Estimate for the project is $259,500.00. This project will address the Council Goals as described below. Parks/Open Space/Trails Acquire, develop, and maintain a broad range of open space and recreational facilities that actively address citizen needs, which are fiscally responsible and consistent with the General Plan/GMS. Top Quality Service Ensure the effective and efficient delivery of exceptional services to our community on a daily basis. ENVIRONMENTAL REVIEW: This project has been determined to be exempt from environmental review per CEQA (14 Cal Code Reg §15301) - minor alteration of an existing facility. FISCAL IMPACT: Construction Contract Construction Contingency (10%) TOTAL ESTIMATED PROJECT COST TOTAL APPROPRIATIONS ADDITIONAL APPROPRIATIONS $297,511.60 $29,748.40 $327,260.00 $259,500.00 $67,760.00 The total estimated construction cost for this project, shown in the table above, including construction and contingency is $327,260.00; appropriations to date are $259,500.00. Staff notified the City Council of the possible need for additional funding to sufficiently account for increased construction costs and contingency monies in the agenda bill approving plans and specifications. Staff is requesting an additional appropriation of $67,760.00 from the Infrastructure Replacement Fund. There are sufficient funds available in the Infrastructure Replacement Fund to complete the project. EXHIBITS: 1. PKS-06-01. 5 WHEREAS, the City Council adopted Resolution No. 2006-025 approving contract e documents, special provisions and specifications, and authorized the City Clerk to advertise for bids to perform Tot Lot Improvements 2005-2006, hereinafter referred to as the "Project"; and WHEREAS, the bids were received, opened, witnessed and recorded on March 29, 2006; and 7 8 9 10 11 12 13 14 15 16 17 18 19 OF CARLSBAD, CALIFORNIA, AWARDING THE CONTRACT FOR TOT LOT IMPROVEMENTS 2005-2006 AND APPROPRIATION OF ADDITIONAL FUNDS, WHEREAS, bids have been received by the City of Carlsbad, California, to perform Tot Lot Improvements 2005-2006; and WHEREAS, the lowest responsive bid received was submitted by Court Concepts, Inc., in the amount of $297,511.60; and WHEREAS, insufficient funds are available for this project in the Capital Improvement Project budget; and WHEREAS, additional funds in the amount of $67,760.00 needs to be appropriated to complete this project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 2Q i That the above recitations are true and correct. 21 2. That the Finance Director is authorized to appropriate $67,760.00 from the Infrastructure Replacement Fund to perform Tot Lot Improvements 2005-2006. 3. That the Mayor of the City of Carlsbad is hereby authorized and directed to execute a contract for Contract No. 39441, Project No. PKS 06-01, Tot Lot Improvements 2005-2006 with Court Concepts, Inc. 5. That the award of this contract is contingent upon Court Concepts, Inc. executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) days of adoption of this resolution. The City Manager may grant reasonable extensions of time.
