HD. //) RT • _ J*jST»'^ CITY ATTY. \<JZ£^ CITYMGR.'^3r> # RECOMMENDED ACTION: Adopt Resolution No.2006-104 accepting bids and awarding a contract for the construction of the Concrete Replacement Project No. 6006 and appropriation of funds. ITEM EXPLANATION: The project is designed to replace curb, gutter, sidewalk, and driveway approaches on those streets which will receive a pavement overlay in the same fiscal year. The concrete work occurs at locations where there is deterioration, cracking, and uplifting. There are over 700 locations in the Northwest Quadrant of the City which will be reconstructed as part of this project. On January 24, 2006 City Council appropriated funds and authorized the advertisement for bids for construction of the Concrete Replacement Project No. 6006. Two bids were received on March 28, 2006, which are summarized as follows: CONTRACTOR 1 . Romero General 2. Koch Armstrong General Eng BID TOTAL $1,143,349.93 $1,472,379.00 The lowest responsive bidder, Romero General, submitted a bid in the amount of $1,143,349.93, which is 14% higher than the engineer's estimate. The engineer's estimate was created using last year's concrete bid prices for similar work, which were increased by 5% in order to account for increases in the costs of materials over the past year. Despite accounting for the increase in the cost of materials, the concrete bid prices were higher than expected due to the combined effects of a large number of concrete replacement locations and the short contract duration. The short contract duration was required to ensure that the concrete replacement was completed prior to the pavement overlay project which is currently out to bid. Requesting new bids is not anticipated to result in lower construction costs. Staff has completed its review of the contract documents and finds that they are in order. Therefore, staff recommends that Romero General be awarded the contract. ENVIRONMENTAL REVIEW: This project is categorically exempt from the environmental review process under Section 15301 Class 1(c) of the Public Resources Code (California Environmental Quality Act). AND APPROPRIATION OF FUNDS. WHEREAS, the City Council of the City of Carlsbad, California, has determined it necessary, desirable, and in the public interest to replace damaged concrete in the Northwest Quadrant of the City; and WHEREAS, the project is exempt from the California Environmental Quality Act pursuant to CEQA Section 15301 Class 1 (c); and WHEREAS, on January 24, 2006, through the adoption of Resolution No. 2006-012, the City Council approved plans and specifications for furnishing of all labor, materials, tools, equipment, transportation, and other expenses necessary or incidental to the Concrete Replacement Project No. 6006; and WHEREAS, two (2) sealed bids were received on March 28, 2006 for the project; and WHEREAS, the lowest responsive, responsible bid for the project was submitted by Romero General in the amount of $1,143,349.93; and WHEREAS, additional Infrastructure Replacement funds need to be appropriated in order to construct the Concrete Replacement Project No. 6006; and WHEREAS, there are sufficient Infrastructure Replacement funds available for the additional appropriation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the bid submitted by Romero General in the amount of $1,143,349.93 is 23 hereby accepted and the Mayor is here authorized to execute the contract for the construction of 24 the Concrete Replacement Project No. 6006, in accordance with the plans, specifications, and 25 contract documents referred to herein. PR 3. That the City Manager is hereby authorized to approve construction change orders up to the contingency amount of $50,000 to Romero General for the Concrete Replacement Project No. 6006. 5. That the award of this contract is contingent upon Romero General executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) calendar days of adoption of this resolution. The City Manager may grant reasonable extensions of time.
