RECOMMENDED ACTION:
Adopt Resolution No. 2006-105 accepting the bid of $97,495 and awarding the contract to
Commercial & Industrial Roofing, Inc., to furnish and install four new roofs at multiple City structures,
Contract No. PWS06-25FAC.
ITEM EXPLANATION:
General Services is tasked with maintenance of multiple structures in the City of Carlsbad facility
inventory. Previous inspections revealed issues with the integrity of the roofing system at four of the
facilities the City currently maintains. Advanced age, exposure to weather, insects, and
wear-and-tear have resulted in roofing systems that are susceptible to leaks, resulting increased
maintenance costs and potential damage to the building structure.
The City Council approved funding in the 2005-2006 General Fund, Facilities Maintenance, Capital
Outlay budget to install new roof systems on four facilities. These facilities are listed below:
• Arts Office
• Fire Station #3
• Heritage Hall
• Swim Complex
Staff made a determination that it would be advantageous to combine the four separate projects into
a single bid to attract potential bidders and to realize economy of scale. Staff compiled plans and
specifications for the needed work and placed the item out for public bidding.
On March 10, 2006, the City Clerk published a Notice Inviting Bids for this project. Three bids were
received, opened, witnessed, and recorded on April 12, 2006. The bid amounts ranged from
$97,495 to $193,645. The bids were reviewed by the Public Works Department and were as follows:

Carlsbad Municipal Code, Section 3.28.040 C-4 names the City Manager as the awarding authority
for Public Works contracts subject to a dollar limit established in the Public Contract Code, Section
22032. The current limit is $125,000. However, Carlsbad Municipal Code Section 3.28.040 C-5
limits the City Manager's authority to approve Change Orders on Public Works projects to an
aggregate limit of $100,000. This limit was established at the time the code was adopted and was
consistent with the dollar limits set at that time.
Although the City Manager has the authority to award this agreement, the Municipal Code limits his
authority to approve Change Orders on this project to a total amount of $2,505. This creates an
issue with this particular project. Roofing projects, by their nature, present a certain amount of
unpredictability. Substructures, including roof sheathing and structural members, are not accessible
for evaluation prior to removal of the existing roof. There is the potential for needed repairs to these
items that cannot be fully realized until the roofing material is removed and the underlying structures
can be fully inspected.

Staff is requesting that City Council award this agreement and authorize the City Manager to
approve a contingency amount of $9,750, which is equal to 10% of the contract amount in order to
address any unknown construction needs.
Commercial & Industrial Roofing, Inc., submitted the lowest responsive bid. Therefore, staff
recommends the contract be awarded to Commercial & Industrial Roofing, Inc., the lowest
responsive bidder, in the amount of $97,495. The contractor's registration and bonds are in order
and references are satisfactory. Contract documents are on file in the General Services offices of
Public Works.
The Engineer's Estimate for the project is $115,000.
ENVIRONMENTAL REVIEW:
This project has been determined to be exempt from environmental review per CEQA (14 Cal Code
Reg §15301) - minor alteration of an existing facility.
FISCAL IMPACT:
The total estimated construction cost for this project is $97,495. Sufficient funds are available in the
General Fund, Facilities Maintenance, Capital Outlay budget to complete the project.

WHEREAS, on March 10, 2006, the City Clerk published a Notice Inviting Bids to Furnish
and Install Four New Roofs at Multiple City Structures, hereinafter referred to as the "Project"; and
WHEREAS, the bids were received, opened, witnessed and recorded on April 12, 2006;
and
WHEREAS, bids have been received by the City of Carlsbad, California, to Furnish and
Install Four New Roofs at Multiple City Structures; and
WHEREAS, the lowest responsive bid received was submitted by Commercial & Industrial
Roofing, Inc., in the amount of $97,495.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1 That the above recitations are true and correct.
2. The bid of $97,495 by Commercial & Industrial Roofing, Inc., to Furnish and Install
Four New Roofs at Multiple City Structures, and a contingency account of $9,750 is hereby
accepted.
3. That the Mayor of the City of Carlsbad is hereby authorized and directed to execute
a contract for Contract No. PWS06-25FAC, to Furnish and Install Four New Roofs at Multiple City
Structures with Commercial & Industrial Roofing, Inc.

4. That the award of this contract is contingent upon Commercial & Industrial Roofing,
Inc., executing the required contract and submitting the required bonds and insurance policies, as
described in the contract, within twenty (20) days of adoption of this resolution. The City Manager
may grant reasonable extensions of time.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 25th day of April , 2006 by the following vote, to wit:
