CITY OF CARLSBAD - AGENDA BILL 18,566AB# MTG. S/16/06 DEPT. COM DEV. APPOINTMENT OF A MEMBER OF CITIZENS' COMMITTEE TO STUDY THE FLOWER FIELDS AND THE STRAWBERRY FIELDS AREA DEPT. HEAD CITY ATTY. RECOMMENDED ACTION: That the City Council ADOPT City Council Resolution No. 2006-129 appointing a citizen to serve as a member of the Citizens' Committee to Study the Flower Fields and the Strawberry Fields Area. ITEM EXPLANATION: On April 18, the City Council adopted Resolution No. 2006-103, establishing a 25-member Ad Hoc Citizens' Committee to Study the Flower Fields and Strawberry Fields Area between Cannon Road and Palomar Airport Road. Resolution No. 2006-112 was adopted by the City Council on May 2, 2006 expanding the committee membership to 31 members, including six non-voting representatives from SDG&E, Carltas Company, the farming/flower industry, Concerned Citizens' of Carlsbad, Citizens' for Usable Places, and one Planning Commissioner. On May 2, 2006, the City Council appointed 31 members to the Committee. Subsequent to that date, one of the Committee members, Debbie Hollabaugh, expressed a desire to be removed from the Committee. The recommended replacement for Ms. Hollabaugh is Leslea Meyerhoff. Ms. Meyerhoff has indicated an interest in serving on the committee and is available for the projected time period. WOOD, City Clerk (Seal) -3- 1 RESOLUTION NO. 2006-103 2 A Resolution of the City Council of the City of Carlsbad, California, Creating A Committee to Study the Flower Fields and the Strawberry Fields Area Between Cannon Road and 4 Palomar Airport Road. 5 WHEREAS, an initiative entitled "Save the Strawberry and Flower Growing Fields Act of 6 2006" has been titled and summarized and is currently being circulated to obtain the requisite aigiia WHEREAS, the proponents of a second initiative entitled "Parkland and Public Access signatures for placement on the ballot according to the California Elections Code; and 8 9 Planning Initiative of 2006" has been submitted to the City Clerk and has been given a title and 10 summary by the City Attorney for circulation; and WHEREAS, both initiatives propose amending the Carlsbad General Plan; and 13 WHEREAS, the two initiatives are in conflict in its proposed amendments; and 14 WHEREAS, the City Council has requested a voluntary time out from both proponents which has not been agreed to at this time; and WHEREAS, the City Council has expressed interest in the creation of a 25-member Citizens 17 Committee to Study the Flower Fields and the Strawberry Fields Area of the City, including 18 citizens-at-large and representatives of various City Boards and Commissions to analyze and 19 consider all view points on current land use policies and regulations regarding the best use of the 21 undeveloped land along Cannon Road east of Interstate 5 before amending the General Plan for 22 this area; and 23 WHEREAS, neither initiative addresses the future zoning or the Local Coastal Plan for this area; and 25 WHEREAS, this Citizens' Committee will analyze and present to the City Council a report 26 and recommendation that the City Council must weigh in determining what General Plan, Local 27 Coastal Plan and zoning designations will best promote the welfare of the citizens of Carlsbad, and 28 1 WHEREAS, the City Council directed the commencement of reports on the fiscal, economic, legal and other information set forth in Election Code section 9212. 3 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 4 California, as follows: 5 1. That the above recitations are true and correct.6 2. That there is hereby created a Citizens' Committee to Study the Flower Fields and the Strawberry Fields Area of the City whose charge shall be to analyze and present to the City Council a report and recommendation on each of the proposed initiatives as well as a proposed City Council measure to help determine what General Plan and Zoning designations will best promote the welfare of the citizens of Carlsbad. The Committee shall review all pertinent 12 information regarding this area of the city including all existing land use documents (General 13 Plan, Zoning, Local Coastal Plan, etc.), historical information and recent visioning efforts;14 i e review the proposed ballot measures relating to the area; receive public input on the area and on the ballot measures including presentations from the ballot measure proponents; and 17 prepare an independent, objective comparison of the measures. 10 3. That the Ad Hoc Advisory Committee ("Committee) shall be appointed by the Mayor 19 with the advice and recommendations of the City Council and that the 25 members shall be a 20 combination of citizens-at-large and representatives of various City boards and commissions. 21 ~ 4. That the Committee shall meet approximately once a week for six weeks on either 23 Tuesday or Thursday mornings from 9 to 12 AM, or at such other times as determined by the 24 Committee. Additional meetings may be held if deemed necessary by the Committee, however, in no case shall the Committee forward the results of its deliberations to the City 26 27 28 -2- 1 Council later than July 1 8, 2006. At that time, the committee shall cease to exist. Committee 2 members shall serve without compensation. 5 . That staff from the City of Carlsbad shall provide information on current land use 4 policies and regulations. The Committee shall be given all reasonable tools, resources, 5 background information and staff support necessary for it to accomplish its objectives. A 6 -, budget not to exceed $ 1 00,000 is hereby appropriated from the Council contingency fund to 8 support the work of this Committee including an outside independent facilitator for the 9 meetings, fiscal impact analyses for all of the measures, and necessary environmental * 0 documents. A budget not to exceed $ 1 00,000 is hereby appropriated to the City Attorney' s budget for the Election Code section 9212 reports. 12 6. That the Committee shall select a Chairperson and Vice-Chairperson and shall establish 13 its operational ground rules for participation and voting.14 15 7. That the Committee shall conduct its business in open and public meetings, which shall 1 6 be subject to the Ralph M. Brown Act (Gov. Code Section 54950 et seq.) 17 8. That the principal charge of the Committee is to analyze and present to the City Council 18 the merits of each initiative and/or measure. 19 9. That no member of the Committee shall participate in discussion or cast a vote on 20 recommendations where he or she is likely to have a conflict of interest. Subsequent to the preparation of Council Resolution No. 2006-129, which is scheduled for adoption by the City Council on Tuesday, May 16, 2006, another committee member, Katie Butler, declined the Mayor's appointment. Lara Means Pope has indicated a willingness to serve on the committee replacing Katie Butler. .^ Mayor and City Council Members and the entire Carlsbad Community. For the Record: The Concerned Citizens of Carlsbad hereby demands that all citizens committee meetings cease and a completely new citizens committee be Established for the reasons as follows: 1. Nearly half of applications were received many days after the voting members had already been assigned per the last city council meeting on May 2, 2006. Also, the council members had already chosen most of the members Therefore, an Equal Opportunity was never established for all citizens of Carlsbad. Also, it did not give those who had turned in their applications prior to May 2, 2006 an equal opportunity to be chosen for the citizens committee. The Concerned Citizens spokesman had addressed this issue by stating that a lottery type format be used in order to give an Equal Opportunity to all citizens of the community. 2. The application form stated that there were three requirements in order to be appointed to the committee, which are (a) United States Citizenship (b) Resident of Carlsbad (c) Registered Voter in Carlsbad This was for the purpose of establishing a Carlsbad Citizen based committee. Some of the applicants made false and/or misleading marks on their Applications. State examples: Most important: The City officials did not checked for validity and to verify if all of the above requirements were met before choosing the committee members. The facts have been made known to all of the council members and Citizens of the Carlsbad Community. The Mayor and the City Council have already voted to create a citizens committee at a city expense of 100 thousand dollars. The committee, by its true definition, is an agency consisting of over 25 people, city staff and private sector consulting firms for the purpose of studying the two complete initiatives and an unfinished city based initiative. Therefore, we desire to see the fabrication of a balanced citizen based committee for the purpose of representing our community. If we do not see the appropriate action taken according to the equal opportunity act, then we will be left with no other alternative but to seek legal council. Each City Council member personally read their 5 choices. 1 . According to Mayor Lewis, Committee Members were to be selected and interviewed based on their interest in being on the committee and by submitting a formal application provided by the City. 2. All of the applicants were required to submit an application and based on the applications submittaL, interviews were to be conducted by the 5 council members of all interested citizens. This would mean that all applications had to be received prior to the May 2nd council meeting. (Note) 10 of the 25 applications received are dated May 3rd to May 9th after the council members publicly read their choices. (Conclusion ) how could these 10 committee members have been selected if their applications were not turned in until after the selection process had been completed and their names read aloud at the City Council meeting on May 2nd?? 3. Based on this evidence it is our belief that there was no random subjective selection and that the Council Members Pre selected people they personally knew, which brings us to the feel that the Citizens Committee is not only Bias and one sided but the Citizens Committee will serve the best interest of the City Council, has no true reflection of Citizens. Our belief is that the Committee selection process was Bias, prejudice and reeks of inequality. 4. My Application ( Michael Bovenzi) was submitted on April 27th and my interview with the Mayor was scheduled for Monday May 1st at 10:45am. Mayor Lewis specifically told me during my interview that he was the only Council Member that had not finished the selection process and that the Other 4 City Council Members had already finished the selection process by Selecting 5 Citizen Committee members each. 5. Now if My Interview (Michael Bovenzi) was Monday morning May 1st at 10:45 and all of the other council members had already selected 5 committee members, how could Council Member Ann Kulchin already have selected Citizens Committee Member Gina Mcbride who didn't turn in her application in until that Monday May 1 st. ( Not Possible ) 6. Not only do we have 10 Members who were selected for the Citizens Committee who's application Date is After the Committee Members had been announced, but Gina Mcbride Selected by Council Member Ann Kulchin according to the Mayors comments to me would be 1 1 . This Means 1 1 of the 25 Members Selected never submitted an application prior to being selected. How?? This proves the committee is fixed (Bias). The CCC Political Action Committee elected spokesperson is Ronald Alvarez. We would appreciate any future correspondence be directed to CCC (PAC) Spokesperson. Now, in regards to your invitation to your citizens committee, on April 25,2006 at the city council meeting, the Concerned Citizens of Carlsbad spokesperson (Ronald Alvarez) stated that CCC would not be a part of the Carlsbad City Council fabricated committee for general reasons, such as: 1. We believe that City of Carlsbad has no true bases to fabricate a citizens committee for the purpose of analyzing citizens based initiatives compared city based initiatives. 2. We believe that the cost associated with this committee is a waste of Tax Payer Funds. 3. We believe that city has formulated a bias committee with some of the initial stake holders of the eleven confidential developmental meetings for the subject areas. 4. The City based initiative is not completed in order for any committee to fairly study all three initiatives equally. 5. The CCUPP group does not have the required signatures in order to qualify for the November 2006 ballot 6. The Committee i« recommending goals and policies to help prevent the premature elimination of agriculture and to attempt to preserve land for agricultural use when it is determined to be feasible* In order to accomplish this, the Committee recommends that the city* & A) Support and utilize all measures available to reduce the financial burdens on agricultural land; B) Develop measures to ensure the compatibility of agriculture with adjacent non-agricultural uses; C) Permit agricultural land uses throughout the city; D) Conserve the largest possible amount of suitable,, undeveloped land for agricultural uses with the willing *= compliance of affected parties; E) Participate with neighboring cities and communities in preserving agricultural resources along mutual boundaries; and F) Finally, consider the acquisition of lands or property rights for permanent agricultural uses through methods such aa trusts, foundations and city-wide assessment districts. / The Committee recommends that specific consideration be given to the flower fields or lands east of 1-5 to the first ridgeline between Cannon Road and Paloroar Airport Road. The city should attempt to preserve this agricultural area through whatever method created and most advantageous to the city. Minority Opinion - There was a minority opinion on the Committee that the above recommended measures were not going far enough in preserving agriculture in the city. The minority believed that the city should take a much more active, initiating-type role in preserving agriculture as a permanent use even if it requires public acquisition. The minority also believed that the lands in the city most suitable for agricultural purposes (i.e, along Palomar Airport Road} should be so designated in the Land Use Element. ***** 10. PARKS The Citizens Committee supports the city's community park concept and program, however, the Committee also believes 12 Committee Leaders ( fact) There are two people in charge of running the new citizens committee A. Sandra Holder B. Michael Holsmiller Sandra holder) who is the community development director in Carlsbad has a lot of power in fact she is even the boss of the Planning director. Sandra Holder was involved in the secret meetings with Lennar and stated in the attached E mail that the city was not involved. 3 months later when questioned by a reporter form the coast news, she admitted it. Since she was involved in the secret meetings and has every intention in Developing the areas if question and her leadership role is tainted. Since she is Bias she should not be running the citizens committee. Michael Holsmiller) as former planning director and employee of Sandra Holder is working along with Holder to run this committee. As planning director, he never performed the required annual reports regarding build out as required per the Growth management plan and in fact in the 10 year anniversary report to the city council he specifically recommends no Major changes, however Rezoning this beautiful open space is a major change and they should not even be thinking about doing any development. Tne city council may initiate an amendment to any of the plans at any time if in its discretion it determines that an amendment is necessary to ensure adequate facilities and improvements. (c) If at any time it appears to the eatiofootion of the city manager that facilities or improvements within a facilities management zone or zones are inadequate to accommodate any further development within that zone or that the performance standards adopted pursuant to Section 21.90.100 are not being met he shall immediately report the deficiency to the council. If the council determines that a deficiency exists or will exist due to the impacts of new development then no further building or development permits shall be issued within the affected zone or zones and development shall cease wrttf unless one of the following applies: (1) aAn amendment to the citywide facilities and improvements plan or applicable local facilities management plan which addresses the deficiency is approved by the city council and the performance standard is met. (2) A financial guarantee and time schedule for construction and operation of the needed facility or improvement is approved by the city council. (3) The affected geographic area of the city is served by an Independent district for purposes of the facility in question, and the independent district determines that it is not feasible to provide the mitigation necessary to achieve compliance with the performance standard. (d) The planning director shall monitor the development activity for each local facilities management zone and shall prepare an annual report to the city council consisting of maps, graphs, charts, tables and text and which includes a developmental activity analysis, a facilities and improvements adequacy analysis, a—feeitity revenue/expenditure analysis and recommendation for any amendments to the facilities management plan. The content of the annual report shall be established by the city council. (e) The city council shall annually review the citywide facilities and improvements plan at the time it considers the city's capital improvement budget. Nothing in this chapter shall be construed as relieving a builder, developer or subdivf'der from any public improvement requirement dedication requirement or fee requirement which is imposed pursuant to Titles 13, 18, 20 or 21 of this code or pursuant to any city council policy. (Ord. 9808 §1 (part), 1986) 21.90.150 Implementing guidelines. The city council may adopt any guidelines it deems necessary to implement this chapter. (Ord. 9808 §1 (part), 1986) 21.90.160 Exclusions. (a) Development proposals which consist of facilities, or structures constructed by a city, county, special district, state, or federal government or any agency, department, or subsidiary thereof for governmental purposes are excluded from the provisions of this chapter. This exclusion shall not apply to development proposals to which a possessory interest tax would be applicable. 16 A. INTRODUCTION Ten years ago, the City of Carlsbad enacted its Growth Management Plan. The Growth Management Plan changed the way the City operated with respect to physical growth and the approval and implementation of public and private development projects. The Plan requires that public facilities and services be provided concurrently with new growth and development according to adopted facility and service performance standards. Unless these performance standards are met, no new growth and development can occur. The Plan also established a limitation on the maximum number of future residential dwelling units that could be built in the City; both Citywide and by quadrant of the CKy. The Growth Management Plan as well as the dwelling unit limitation was voted on and ratified by the citizens of Carlsbad in the election of November 1986. The Plan cannot be deleted or the dwelling unit limitation exceeded without a subsequent vote of the citizens. Much has been accomplished as a result of the Growth Management Plan. Citizens and decision makers rely on it to ensure that growth in the City is well managed. Applicants and developers know that they must comply with the Plan in order to have their projects approved. The Plan has received considerable recognition and has won numerous awards for its approach to managing growth, including a national award for innovation from Rutgers University, a statewide award of excellence from the League of California Cities, a San Diego County regional "orchid" award for comprehensive planning and several American Planning Association awards. A recent editorial in the North County Times referenced the Growth Management Plan as "arguably the most significant accomplishment in Carlsbad in the past 10 years." The primary purpose of this 10 year anniversary report is to summarize and to celebrate the accomplishments which have resulted directly or indirectly from the implementation of the Growth Management Plan. Much has been accomplished in terms of providing for adequate public facility and services, in the way facilities and services are financed and in the overall way planning for future growth and development is done. A secondary purpose of the report is to determine whether any minor refinements to the implementation of the Plan should be enacted based on ten years of experience with the Plan. Staff is recommending some minor implementation refinements, however based on the City's decade of experience with the Plan, staff believes that it is / completely accomplishing what it was intended to do and that no major refinements or y implementation changes are necessary or desirable. Finally, this report concludes with a discussion of the Dwelling Unit Limitation portion of the Growth Management Plan. B. CHRONOLOGY OF DEVELOPMENT OF THE GROWTH MANAGEMENT PROGRAM The origins of Growth Management in Carlsbad go back to the mid 1970s. At that time, the City's General Plan contained a Public Facilities Element which generally called for 2. Projects proposing a zone change from non-residential to residential based upon the following findings: a. The property was zoned for other than residential use on July 1986. b. The property is compatible for residential use without significant mitigation. c. The density of the project does not exceed the Growth Management Control Point of any adjacent residential property." 3. Infill multi-family projects that meet all development standards and where the resulting density does not exceed adjacent, existing multi-family projects. Application of the priority levels should be based on the total number of excess units available in a quadrant The purpose of having three priority levels Is to address the issue of, having only a minimal number of excess units available in a quadrant at any one particular point in time. If there ere only a minimal number of excess units available in a quadrant, then the units should only be used for a First Priority project Conversely, if there are a substantial number of excess units available in the quadrant, allocation to a Second or Third Priority project Is acceptable. Regarding the use of excess dwelling units for affordable housing, the Intent of this policy is to work in conjunction with and to aid In implementing the programs of the Housing Element including the Inclusionary Housing Ordinance and the Density Bonus Ordinance. If a substantial allocation of excess dwelling units are being requested for affordable housing, the project should then, however, exceed the basic numerical requirements of these ordinances regarding the provision for lower income units. F. SUMMARY Based on ten years of experience with the Growth Management Plan, staff believes that it is working well and has accomplished what it was intended to do. Much has been achieved in terms of providing for adequate public facilities and services, in the way facilities and services are financed and in the overall way planning for future growth and development is done. Although no major revisions to the Plan are recommended, staff is proposing some minor refinements/updates and appropriate resolutions and ordinance amendments have been prepared to effectuate these minor changes as follows: 1. The two parcels that you mention in your e-mail are both owned by the Carltas Company. Last year, Carltas put both of these parcels on the market and posted the properties with "for sale" signs. It is my understanding that the Lennar Corporation has entered into an option agreement with the Carltas Company for both of these parcels. I have not seen and do not know the terms of this agreement. For further information regarding Lennar's intended use of these properties, I would suggest that you contact them directly. The two properties are part of the Carlsbad Ranch Specific Plan, Planning Areas 8a and 8b, which designates these properties as "golf course". There is no application on file with the City of Carlsbad at this time to change any of the land use or zoning on this property. The Carlsbad Mayor and City Council members have not met with, negotiated with, nor discussed Lennar's intentions to develop this property. For the past year, the City staff has been working on an overall vision for the area we call "Centre City Gateway" - an area roughly extending from the south side of the Agua Hedionda Lagoon to Palomar Airport Road, and from the Pacific Ocean to El Camino Real. This goal was established by the City Council at their annual goal-setting workshop last January. City staff has been developing a "sustainability" model for this area that would incorporate all of the recognized factors of sustainability - environmental, social, and economic. The City is also desirous of creating an opportunity for a "civic village" somewhere in this area for the long-term possibility to create a significant community/civic campus and gathering place. This area provides an opportunity to connect the northern and southern portions of the community and to provide for the creation of a great public place where people in the community could connect with each other for many genefafionsToTome.
