RECOMMENDED ACTION:
Adopt Resolution No. 2006-142 approving the 2006 five-year Regional Transportation
Improvement Program (RTIP) for Carlsbad.
ITEM EXPLANATION:
The 2006 Regional Transportation Improvement Program (RTIP) is a program of proposed highway,
arterial, transit, and bikeway projects for Fiscal Years 2006/07 through 2010/11. The San Diego
Association of Governments (SANDAG) is required by State and Federal laws to develop and adopt
the RTIP every two years. The 2006 RTIP is due to the State by August 1, 2006.
Each City in the region must adopt their recommended RTIP project list following a public hearing
process. The public hearing allows citizens an opportunity to comment on the City's RTIP project
list. The public hearing which will be held at the J^!16 6,2006city Council meeting, was set and
noticed in the local papers for the required ten, or more, days. The RTIP project list must be adopted
biennially by each participating SANDAG agency that desires to expend TransNet and/or certain
Federal and State funds.
Most major transportation projects must be included in the approved RTIP prior to receiving certain
categories of State and Federal funding and Federal project approvals. In addition, the TransNet
Ordinance requires that proposed TransNet funded projects be included in the RTIP. The Federal
Metropolitan Planning and Air Quality Conformity Regulations also require inclusion of all regionally
significant capacity increasing road projects for air quality emissions analysis.
The proposed Carlsbad 2006 RTIP project list includes projects with the following funding types:
• Federal Highway Bridge Rehabilitation and Replacement (HBRR) Program
• Federal SAFETEA-LU (High Priority)
• SANDAG TransNet Local (L)
• Regionally Significant Capacity Increasing Projects Regardless of Funding Source
The complete RTIP project list for Carlsbad which identifies the funding source(s), project cost, and
funding year is attached as Exhibit 1.
The TransNet funds as programmed in the 2006 RTIP project list will provide significant funding for
the continued improvement of roadways throughout Carlsbad. The ECR Improvement Project is
programmed to receive $3,300,000 in TransNet funding in FY 06/07, $950,000 in FY 08/09 and
$800,000 in FY 10/11. The Pavement Management Program is programmed to receive TransNet
funds each year ranging from $2,550,000 to 2,650,000 in FY 10/11. The programmed TransNet
funding for the Carlsbad Blvd. bridges over Las Encinas Creek, the warm water jetty at the power
station and the railroad just south of State Street will provide the local matching funds for the
Federal HBRR funding identified for the projects.
In addition to TransNet funded projects the 2006 RTIP project list includes the Poinsettia Lane
Reach E project which has received an allocation of $1,600,000 in Federal SAFETEA-LU, High
Priority Project funds.
The Carlsbad 2006 RTIP project list also includes capacity increasing roadway projects located
along regionally significant arterials, regardless of the funding source. The projects in this category
are Cannon Road Reach 4, College Boulevard Reach A and Poinsettia Lane Reach E.

ENVIRONMENTAL REVIEW:
This activity is statutorily exempt from CEQA pursuant to State CEQA Guidelines, Section 15276,
which states that CEQA does not apply to the adoption of regional transportation improvement
programs.
FISCAL IMPACT:
Approving the RTIP is a requirement under State law for receiving TransNet, Federal and State
funds. Approval of the RTIP ensures eligibility for funding and programs the funding so that positive
cash flow is maintained.
Inclusion in the RTIP, however, is not a guarantee that projects will receive the stated funding. The
amounts shown are the best available estimates of anticipated funding. In the event that funding
falls short or is not available, the City Council is not obligated to proceed with a project just because
it is included in the RTIP.

CARLSBAD, CALIFORNIA, APPROVING THE 2006
FIVE-YEAR REGIONAL TRANSPORTATION IMPROVEMENT
PROGRAM (RTIP) FOR CARLSBAD.
WHEREAS, on November 3, 1987, the voters of San Diego County approved the
San Diego Transportation Improvement Program Ordinance and Expenditure Plan (87-01); and
WHEREAS, on November 4, 2004, the voters of San Diego County approved the
San Diego Transportation Improvement Program Ordinance and Expenditure Plan (04-01)
extension; and
WHEREAS, that both Ordinances provide that SANDAG, acting as the Regional
Transportation Commission, shall approve a multi-year program of projects submitted by local
jurisdictions identifying those transportation projects eligible to use transportation sales tax
(TransNet) funds; and
WHEREAS, the City of Carlsbad was provided with an estimate of annual TransNet local
street and road revenues for Fiscal Years 2006/07 through 2010/11; and
WHEREAS, the City of Carlsbad has held a public hearing in accordance with Section
5(A) of both Ordinances; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the 2006 Five Year Regional Transportation Improvement Program (RTIP) for
Carlsbad attached to the agenda bill as Exhibit 1, is hereby approved.
3. That pursuant to Section 8 of both TransNet Ordinances, the City of Carlsbad certifies
that the required minimum annual level of discretionary funds be expended for street and local
purposes will be met through the five-year period consistent with Maintenance of Effort
Requirements adopted by the SANDAG Commission on June 24, 1988 and on May 28, 2004.

4. That pursuant to Section 9 of the TransNet Ordinance, the City of Carlsbad certifies
that the TransNet funds programmed in the 2006-10 RTIP for the City of Carlsbad do not replace
private developer funding which has been or will be committed for any project.
5. That pursuant to Section 9a of the TransNet extension Ordinance, the City of
Carlsbad certifies that the agency will extract $2,000 from the private sector for each newly
constructed residential housing unit in that jurisdiction to the Regional Transportation Congestion
Improvement Program (RTCIP) beginning no later than July 1, 2008.
6. That pursuant to Section 16 of the TransNet Ordinance, the City of Carlsbad certifies
that each project of $250,000 or more will be clearly designated during construction with TransNet
project funding identification signs.
7. That the City of Carlsbad does hereby certify that all other applicable provisions of the
TransNet Ordinances 87-01 and 04-01 have been met.
8. That the City of Carlsbad agrees to hold harmless and defend the SANDAG
Commission against challenges related to local TransNet funded projects.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 6th day of June , 2006 by the following vote, to wit:

We are not able to attend the City Council meeting tomorrow night but ask that you include this email as
part of the record and include it in your deliberations of this item.
Cannon Road Reach 4 has been added to this update with the entire project cost of $ 34m in local funds
to be expended in 2010-2011.
This action does not seem to be consistent with a number of other recent/planned city actions. Please
have staff clarify the following apparent inconsistencies:
1 . This road segment causes a traffic failure for the 2030 traffic conditions for the Robertson Ranch
project- as identified in Mitigation Measure T12 of the proposed final EIR dated April 2006 and heard but
put over at the Planning Commission meeting of May 31, 2006.
If the city is knowingly proceeding with this project that will cause traffic failures then is it the city's intent to
build this very expensive road, using local taxpayer funds, that will cause traffic failures- and then claim
this is an unavoidable traffic impact ?
2. In the current adopted city budget Cannon Road Reach 4 does not even show as an unfunded project.
Will these $ 34m of local funds be added to the budget update currently in process so local taxpayers are
informed of the consequences of this project?
3. There was a prior allocation of Transnet funds for the environmental analysis for this project, but these
funds do not show on Exhibit 1 . Why are these funds not shown? Does this mean that the current total
project cost is even higher than $ 34 m? If so, what is the total estimated project cost for this 1 .3 mile
road segment? Is there a point at which you might start to think- perhaps this is just too costly a project
for our taxpayers to have to pay for or is the cost of no concern?
4. The project shows a local funding requirement of $ 34 m. There is only about $ 23m remaining in the
funds set aside two years ago for the 4 Measure C projects. These funds are also supposed to fund the
emergency services training facility, and open space and trails. How does the city expect to pay for this
road, and the other remaining items, when there are insufficient funds remaining in the account?
5. 100% of the expenditures are programmed for a single year- 2010/1 1 . Large capital projects like this
do not complete engineering, design and construction in a single year. Why are these project
expenditures being shown this way?
6. Please clarify how this proposed project expenditure is consistent with the SANDAG guidelines for the
5 year RTIP update.
We request that these questions be fully answered before including this project in the RTIP Update.
