RECOMMENDED ACTION:
Introduce Ordinance No. NS-804 to establish a prima facie 40 mile per hour speed limit
upon Aston Avenue from College Boulevard to its intersection with Rutherford Road.
ITEM EXPLANATION:
Aston Avenue is a two-lane industrial collector road located in the Carlsbad Research Center that
is unclassified on the Circulation Element of the General Plan. Aston Avenue has been built to City
standards with concrete curb and gutter, sidewalks, and street lights. Bicycle lanes are striped on both
sides of the roadway. The daily traffic volume on Aston Avenue is about 5,800 vehicles and in the past
10 years there have been three reported traffic collisions on Aston Avenue.
Sections 22357 and 22358 of the California Vehicle Code authorizes local authorities to establish a
prima facie speed limit on the basis of the results of an Engineering and Traffic Survey.
The Engineering and Traffic Survey considers such factors as the number of collisions that have
occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic
volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight distance,
and conditions that may not be readily apparent to the driver.
At their meeting on May 1, 2006, the Traffic Safety Commission considered the results of the
Engineering and Traffic Survey to establish a prima facie speed limit upon the subject portion of
Aston Avenue. The Commission recommended by a 5-0 vote that a 40 mile per hour prima facie
speed limit be established upon Aston Avenue from College Boulevard to its intersection with
Rutherford Road.
The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic
Engineer.
ENVIRONMENTAL IMPACT:
The installation of an official traffic control device is a project that is a Class 1 categorical exemption
(minor alteration of existing structure or facility) and is, therefore, exempt from the environmental
review process under the provisions of the California Environmental Quality Act (CEQA),
Section 15301(c).
FISCAL IMPACT:
Installing two speed limit signs upon Aston Avenue will cost about $250.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44,
OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF
4 SECTION 10.44.760 TO ESTABLISH UPON ASTON AVENUE A PRIMA
FACIE 40 MILE PER HOUR SPEED LIMIT FROM COLLEGE
5 BOULEVARD TO ITS INTERSECTION WITH RUTHERFORD ROAD.
6 The City Council of the City of Carlsbad, California, hereby ordains as follows:
7 SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended
g by the addition of Section 10.44.760 to read as follows:
o "10.44.760 Aston Avenue. Upon Aston Avenue from College Boulevard
to its intersection with Rutherford Road, the prima facie speed limit shall
JQ be forty miles per hour."
1 1 EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption; and
12 the City Clerk shall certify the adoption of this ordinance and cause it to be published at least once in
13 a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its adoption.
