RECOMMENDED ACTION:
It is recommended the City Council ADOPT RESOLUTION NO. 2006-190 authorizing
proceeding with the undergrounding of overhead utilities along Palomar Airport Road fronting
the Carlsbad City Golf Course Project and granting an easement within public right-of-way to
the San Diego Gas and Electric Company.
ITEM EXPLANATION:
Conditional Use Permit 97-07, Special Condition 20, of Carlsbad Planning Commission
Resolution No. 4773 adopted June 7, 2000 requires the undergrounding of overhead utilities
along Palomar Airport Road fronting the Carlsbad City Golf Course Project as a condition of
project development. Staff has recently completed negotiations with the San Diego Gas and
Electric Company to facilitate the undergrounding of the overhead utilities.
The work will occur primarily within the number 3 west-bound lane of Palomar Airport Road as
well as on the City's property fronting the road. The undergrounding of these utilities will
complete all final utility relocations along Palomar Airport Road both east and west of College
Boulevard. The work will be undertaken by SDGE beginning later in calendar 2006 and be
completed well in advance of the scheduled July, 2007 opening of the City Golf Course.
Also attached is a required Grant of Easement from the City to SDGE to allow the installation of
the utility improvements within both public right-of-way and portions of the City's property along
Palomar Airport Road. City staff has reviewed both the proposed easement and the utility
construction drawings and finds no apparent conflicts with existing facilities nor with golf course
facilities or operations.
Staff requests the City Council authorize proceeding with this work through SDG&E and the
granting of the required easement.
FISCAL IMPACT:
The total cost of the undergrounding of the utilities is $1,057,267 less a previously paid
engineering fee of $1 ,268 for a net cost of $1 ,055,999. The SDGE scope of work is a "total
cost project" including all construction, traffic control, other permits and miscellaneous fees, and
all indirect expenses.

The City Golf Course Project adopted budget includes a sub-account budget item in the amount
of $1,150,000 for undergrounding of utilities. Therefore, there are sufficient budgeted funds in
the project account and no additional appropriations are required to undertake this work.
ENVIRONMENTAL IMPACT:
On June 7, 2000, the Carlsbad Planning Commission adopted Resolution No. 4773 certifying
the Environmental Impact Report finding the project consistent with the California
Environmental Quality Act and applicable City ordinances and environmental policies.

7 WHEREAS, the City Council of the City of Carlsbad, California, has previously
8 authorized proceeding with the development of the Carlsbad City Golf Course Project,
9 hereafter referred to as the "Project;" and
10
WHEREAS, Conditional Use Permit 97-07, Special Condition 20, issued for the
11
Project requires the undergrounding of overhead utilities along frontage of the Project
12
and Palomar Airport Road; and
WHEREAS, Conditional Use Permit 97-07, Special Condition 20, issued for the
15 Project requires the undergrounding of overhead utilities along frontage of the Project
16 and Palomar Airport Road; and
17 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
18 Carlsbad, California, as follows:
19 1. That the above recitations are true and correct.

2. That the City Council does hereby authorize proceeding with the
21
undergrounding of overhead utilities by the San Diego Gas and Electric
23 Company required of the Project.
24 3. That the Finance Director is authorized to prepare a City check in the
25 amount of $1,055,999 and submit same along with one (1) copy of an SDGE
26 "Customer Payment Remittance" form, to the Customer Payment Services -

3 4. That an easement is hereby granted necessary to facilitate the installation
4 of said underground utilities and the Mayor and City Clerk are authorized to

execute said easement documents. Following the execution of said

easement, the City Clerk is directed to record said easement documents in
0 the Office of the County recorder with copies to be sent to: San Diego Gaso
9 and Electric Company, Attention: Real Estate Records - CP11D, 8335
10 Century Park Court, Suite 100, San Diego, California 92123-1569 and the
11 Public Works Department, Inspection Division, and the Recreation
12 Department for their files.

Subject: Carlsbad Municipal Golf Course - Conversion - Cost Extension (expires
7/21/06)
This letter is to advise you that we have completed the engineering required to replace the
existing overhead electric facilities with an underground system as described on the enclosed
sketch.
As we previously agreed, we will be providing the trench, conduit, backfill and substructures.
Under the requirements outlined above, your conversion cost of $1,057,267.00, less the
$1,268.00 engineering fee which you previously paid, will leave an amount due of
$1,055.999.00, including CIAC tax.
EASEMENTS
Easement(s) are required before our facilities can be installed. Questions regarding the
easements should be directed to the right-of-way agent. Please understand that if we are
unable to obtain easements and/or permits for the systems as presently designed, our offer
outlined in this letter will become void. New specifications and contract documents will be
prepared reflecting an alternate route and revised costs.
These negotiations do not include the installation of any ornamental street lights or street light
services that might be required by the City of Carlsbad. Should they require lights in
conjunction with this conversion, please contact us and service points for the street light service
will be established.
This offer shall expire at the end of the business day on 7/21/2006. If your check in the
amount of $1,055,999.00 has not been received by that date, it may be necessary to
recalculate the costs for your job. If you request a new cost estimate after that date, a cost
update fee will be required.

enclosed envelope. Project Management Offices are unable to accept payments. All

Once your check has been received and the easements have been completed, your project will
be issued to our Construction Department.
Your costs, as cited herein, are subject to change at any time. All cost calculations are based
upon SDG&E's filed tariffs, SDG&E's internal costs, and all applicable governmental or
regulatory statutes, regulations, codes and rules. Should any change in, or addition to, those
tariffs, costs, statutes, regulations, codes or rules in any way impact these cost calculations,
you will be subject to any resulting increase or decrease.
The costs quoted in this letter include a cost component to cover the utility's estimated liability
for State and Federal Income Tax.
I suggest you contact the local telephone and cable television companies for their requirements
and any charges they may have.

EASEMENT
THE CITY OF CARLSBAD. CALIFORNIA, a municipal corporation, hereinafter called
"Grantor", grants to SAN DIEGO GAS & ELECTRIC COMPANY, a corporation, "Grantee", an
easement and right of way to erect, construct, change the size of, improve, reconstruct, relocate,
repair, maintain and use facilities consisting of: (1) Underground electric facilities, and
appurtenances for the transmission and distribution of electricity, (2) Underground
communication facilities, and appurtenances, for any and all purposes, together with the right of
ingress thereto and egress therefrom over said easement and over other practical routes across
Grantor's land situated in the City of Carlsbad, County of San Diego, State of California described
as follows:
Lots 13, 15, 19, 20, 23, 24 and 25 of Carlsbad Tract No. 85-17, according to Map thereof
No. 12903, filed in the Office of the County Recorder of said County of San Diego.
The said easement in the aforesaid lands shall be more particularly described as follows:
Those certain strips of land 7.00 feet in width within said Lots 13, 15. 19, 20, 23 and 24,
said strips lying adjacent to and coincident with the exterior boundaries of that dedicated street
shown and delineated as "P ALOMAR AIRPORT ROAD," on said Map No. 12903.
ALSO: That certain strip of land 10.00 feet in width within said Lot 25, said strip lying
adjacent lo and coincident with the exterior boundaries of that dedicated street shown and
delineated as "PALOMAR AIRPORT ROAD," on said Map No. 12903.
In order lo provide adequate working area for Grantee, Grantor shall not erect, place or
construct, nor permit to be erected, placed or constructed any building or other structure, deposit
any materials, park any vehicle, plant any trees and/or shrubs within eight feet of the front of the
door or hinged opening of any above ground facilities installed within this easement.
Grantor grants to Grantee the right to erect and maintain on Grantor's property immediately
adjacent to this easement retaining walls and/or protective barricades as may be necessary for Grantee's
purposes.
Grantor will exercise only such reserved rights in said land as will not interfere with or
prohibit the free and complete use and enjoyment by Grantee, its successor or assigns, of the
rights hereby granted. Grantee shall have the right to assign any or all rights granted in this
easement in whole or in part to other companies providing utility or communication services.
Grantee shall have the right to top, cut, remove, or trim interfering plants and trees, and to keep
said easement free from and to prevent any person, including Grantor and successors and assigns,
from erecting, placing, or storing on said easement any flammable or other hazards and any
structures, objects, or earth fills/cuts or other obstructions.
