Recreation Reject Bids for Erosion Repairs and Drainage Improvements, Leo Carrillo Ranch Historic Park, Authorize and Approve Plans and Specifications to Re-bid the Project and Appropriate Additional Funds DEPT. HEAD CITY ATTY. CITY MGR. RECOMMENDED ACTION: Adopt Resolution No. 2006-203 to reject bids received for the Erosion Repairs and Drainage Improvements, Carrillo Ranch Historic Park, City Project No. 45011; approval of re-bid plans and specifications; authorization to re bid; and appropriation of additional funds to the project. ITEM EXPLANATION: Several storm events in early 2005 resulted in extensive erosion at Leo Carrillo Ranch Historic Park (Exhibit 3, Erosion Photos). In order to repair the erosion and to address the ongoing drainage issues at the park, the City Council adopted Resolution No. 2005-374 on December 20, 2005 approving the plans and specifications and authorizing the advertisement for bids for erosion repairs and drainage improvements at the park. The proposed erosion repairs and improvements included the following: Supplemental stabilized decomposed granite to re-establish grades for positive drainage Minor grading to redirect water to minimize erosion - Additional catch basins and storm drainage to collect and direct run-off Installation of concrete and cobble lined swales to direct water away from the existing historic buildings and pedestrian pathways - Applications of stabilizer solutions to stabilize previously installed non stabilized decomposed granite The project was advertised and 3 bids were received on April 20, 2006. The table below lists the bidders and the corresponding bids received for the project. Contractor Name/City Romero General, Escondido Zondiros Corporation, San Marcos Palm Engineering, San Diego Item "Base Bid" "Base Bid" "Base Bid" Total Amount $243,955.00 $329,243.50 $464,740.00 Shortly after the bid opening, the apparent low bidder, Romero General, "withdrew" their bid due to several errors in calculations in filling out their bid. After review by the City Attorney's office and the Purchasing Department, it was determined that Romero General had satisfied the requirements necessary to withdraw their bid. Therefore, staff recommends to the Council that Romero be relieved of their bid. This would establish Zondiros Corporation, as the next responsive bidder for the project. Because costs continue to rise, staff is also recommending reducing the scope of the project to help lower the cost as follows: • Replace originally proposed cobble-lined concrete swale with underground perforated pipe. • Use a lower cost decomposed granite stabilizing technique. • Eliminate decomposed granite stabilization in certain areas that are less steep and therefore less prone to erosion. • Enlist the Public Works Department to assist in: o Partial dredging of the adjacent creek that has filled up with soil from erosion. o Tree removals within the creek. o Repair of irrigation caused by proposed underground drainage installation The attached Resolution will approve the plans and specifications and authorize re-bidding. Although some of these changes may potentially reduce the degree of erosion protection, staff feels the measures outlined in the re-bid design will still substantially increase the protection of the site and result in decrease closures from future erosion damage. Because of the variables related to future storm severities, it is unknown how much longer the original design would last compared to the proposed re- design. Despite the reduced scope, additional funds of $87,000 will still be required to cover the estimated cost of the re-designed project. The new engineer's estimate for the re-design is $262,000 (refer to Fiscal Impact for more information). ALTERNATIVES: Although staff is recommending re-bidding, Council has the option to award the bid to the Zondiros Corporation as submitted (Alternative 2 below). 1. Reject the bids received April 20, 2006 and authorize staff to re-bid the project with the reduced scope of work. Appropriate additional funds in the amount of $87,000 to the project from the General Capital Construction (GCC) fund. 2. Proceed with original design and award the bid to Zondiros Corporation in the amount of $329,243.50 and appropriate an additional $187,244 from the GCC fund to the project to cover the bid amount plus a 10% construction contingency. FISCAL IMPACT: There is currently $180,000 of GCC funds appropriated to the project. $5,000 has been used to date for design, leaving a balance of $175,000. LEO CARRILLO RANCH HISTORIC PARK, CITY PROJECT NO. 45011, AUTHORIZING AND APPROVING PLANS AND 5 SPECIFICATIONS FOR RE-BIDDING THE PROJECT AND APPROPRIATING ADDITIONAL FUNDS TO THE 6 PROJECT. 7 WHEREAS, the City Council of the City of Carlsbad, California, has previously 8 appropriated funds in the 2005-2006 Capital Improvement Program for the erosion 9 repairs and site drainage improvements at Leo Carrillo Ranch Historic Park, City Project 10 45011, herein after referred to as the "Project"; and 11 WHEREAS, The City Council of the City of Carlsbad has previously adopted 12 Resolution No. 2005-374, approving the plans and specifications and authorizing the . advertisement for bids for the Project; and 15 WHEREAS, bids were received and opened by the City on April 20, 2006 for the 16 Erosion Repairs and Drainage Improvements, Leo Carrillo Ranch Historic Park, City 17 Project No. 45011; and 18 WHEREAS, the City Council does hereby find it necessary, desirable and in the 19 public interest to reject said construction bids and direct staff to re-bid the 20 aforementioned Project; and 21 WHEREAS, the plans and specifications for re-bidding the Project are complete 22 and ready for advertisement and are on file in the Recreation Department of the City of 23 Carlsbad; and 25 WHEREAS, additional funds in the amount of $87,000 are required to cover 26 escalating construction costs based on previous bids received and revised Engineer's 27 cost estimate for the Project; and 28 1 WHEREAS, the City Council of the City of Carlsbad finds it necessary, desirable 2 and in the public interest to proceed with the re-bid for said project at this time; and WHEREAS, funds are available in the General Capital Construction (GCC) Fund, 4 in the amount of $87,000 to cover the additional costs for the construction of the needed 5 erosion repairs and drainage improvements for the Project; 6 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of 7 Carlsbad, California, as follows: o 9 1. That the above recitations are true and correct. 10 2. That the bids received and opened by the City on April 20, 2006 for the 11 construction of Erosion Repairs and Drainage Improvements, Leo Carrillo 12 Ranch Historic Park, City Project No. 45011, are hereby rejected. 13 3. That the City Council does hereby direct staff to re-bid for the construction 14 of Erosion Repairs and Drainage Improvements, Leo Carrillo Ranch 15 Historic Park, City Project 45011.16 17 4. That the plans and specifications for the re-bidding of the Project, on file at 18 the office of the Recreation Department of the City of Carlsbad, are 19 approved for the Erosion Repairs and Drainage Improvements, Leo 20 Carrillo Ranch Historic Park, City Project No. 45011, and the City Clerk is 91 authorized and directed to advertise for bids for the Project in accordance 22 with State law. 23 5.
