HEAL^fr'kn CITY ATTY. tfg£ CITY MGR. ^^f> RECOMMENDED ACTION: Adopt Resolution No. 2006-211 to temporarily close West Oaks Way at Palomar Oaks Way by the installation of a lockable swinging gate and k-rail. ITEM EXPLANATION: West Oaks Way is a public roadway located in central Carlsbad and is a cul-de-sac approximately 1,615 feet in length. West Oaks Way has been built with curb and gutters on both sides of the roadway but no sidewalks on either side. It measures 32 feet curb to curb and improvement plans were approved on 9/5/85. There are eight developable lots along West Oaks Way, but no development has occurred to date. The lack of development on this cul-de-sac has resulted in a long history of illegal dumping, loitering, and other undesirable behavior along West Oaks Way. All eight developable lots on West Oaks Way are owned by a single property owner. On November 18, 2005, code enforcement staff was contacted by the property owner via the property management firm of Madison Square Properties, regarding the ongoing problem with illegal dumping along West Oaks Way. The property owner requested that the roadway be temporarily closed until development occurs. Staff has contacted all potentially affected utility companies. SDG&E and Buena Sanitation District, which have facilities located on West Oaks Way, support the request to close the roadway with the provision that emergency access is made available. Other utility companies, such as SBC and Adelphia, do not have facilities on this street and would not need access until development occurs. On March 23, 2006, an internal stakeholder meeting with the Engineering Department, Streets Maintenance Department, Code Enforcement, Fire Department and Police Department was held to discuss this request. Support for the temporary closure of West Oaks Way was unanimous. A temporary gate supplemented with k-rail would eliminate the illegal dumping that previously had to be cleaned up by either the property owner or the City if dumped material was in the public right-of-way. Over the past two years alone, the City has spent nearly $20,000 addressing the trash and debris removal issues along this stretch of roadway. Emergency-only access would also eliminate any loitering or illegal activity that could occur on a secluded and undeveloped street. The Fire Department would need access to their fire hydrants on West Oaks Way in case of a fire emergency and could be provided with key access at the gate. Utility companies and other Carlsbad staff could also access the road via key locks placed on the gate. The California Vehicle Code governs the closure of streets. Section 21101 (a)(1) of the Vehicle Code allows local authorities to adopt rules and regulations by ordinance or resolution to close any highway (street) to vehicular traffic when, in the opinion of the legislative body having jurisdiction, the highway is no longer needed for vehicular traffic. Staff recommends that a temporary gate and k-rail be installed across West Oaks Way immediately west of Palomar Oaks Way as depicted on Exhibit 1. The road will not be permanently closed and the gate would be removed when property along West Oaks Way is developed. This project has been determined to be exempt from environmental review per CEQA, Section 15301 - Class 1c, minor alteration of an existing facility. FISCAL IMPACT: The proposed gate, k-rail, and signs will be installed by the Streets Department. Staff has estimated the cost to be $2,800. Sufficient funds are available in the Streets Maintenance operating budget and no additional allocations are necessary. The property owner is willing to share in the cost of this temporary road closure and has agreed to contribute up to $1,400 if necessary. EXHIBITS: 1. Location Map. 2. City staff will maintain the temporary gate until its eventual removal. 5.
