Adopt Resolution No.

ITEM EXPLANATION:
The Carlsbad City Council adopted the Circulation Element of the General Plan as a way to ensure a
comprehensive manner and method for the circulation of people, goods, energy, water, sewage,
storm waters, communications and services. On February 27, 2001, City of Carlsbad Council Policy
Statement No. 63 was issued to establish a policy on the acceptance or conditional acceptance of
Circulation Element roadways or portions of such roadways into the City street system. This policy
states that City Council shall consider the policies of the General Plan, the standards of the Growth
Management Plan, the safety and needs of the traveling public, which in the opinion of the City
Council are necessary and appropriate for the orderly, safe and efficient development of the
circulation system. Policy no. 63 requires formal City Council acceptance of these Circulation Element
roadways into the City's street system. Melrose Drive meets the criteria of a Circulation Element
roadway.
The construction of Melrose Drive as shown on drawing number 399-4, consisting of the construction
of Melrose Drive between Palomar Airport Road and Carlsbad's northerly boundary, is substantially
complete. It is anticipated all remaining items of work will be complete in early August, 2006. The
ultimate Melrose Drive improvements cannot be completed until the intersection of Palomar Airport
Road and Melrose Drive is re-constructed. The necessary intersection improvements cannot be
completed until acquisition of necessary right-of-way south of Palomar Airport Road is acquired.
Melrose Drive is being constructed in accordance with the plans and specs that were previously
approved by the City Engineer and in accordance with the interim intersection plans that have been
approved by the City Engineer. The interim intersection plans are on file in the office of the City
Engineer. City staff has inspected the work completed to date and found it to be satisfactory.
Pursuant to CMC Chapter 11.04 Section 11.04.050 (C) this acceptance does not relieve the
developer from liability for any and all defects found after the acceptance of improvements, in
accordance with the Subdivision Improvement agreements or any other similar agreements.
ENVIRONMENTAL IMPACT:
The environmental review for these projects was conducted with the approval of the individual
projects, including cumulative impacts of all of the above mentioned projects. There are no additional
or cumulative impacts not previously considered in the environmental review for these projects.

FISCAL IMPACT:
There is no appreciable fiscal impact associated with conditionally accepting the roadway. Final
acceptance of the road will obligate the City to perform the on-going maintenance of the road. This will
be done by existing City maintenance crews with no appreciable fiscal impact.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, CONDITIONALLY ACCEPTING THE
CONSTRUCTION OF MELROSE DRIVE FROM PALOMAR
4 AIRPORT ROAD TO THE CITY'S NORTHERLY BOUNDARY,
CT 99-06 .

WHEREAS, Melrose Drive meets the criteria of a circulation element roadway as defined
6
in the City's General Plan and Council Policy No. 63; and
WHEREAS, the construction of Melrose Drive from Palomar Airport Road to the City's
8
northerly boundary as shown on drawing number 399-4 has been substantially completed to the
9
City's satisfaction; and
WHEREAS, the completion of the ultimate improvements cannot take place at this time
due to the need for additional right-of-way;
WHEREAS, an interim striping plan, drawing number 399-4c, that allows for the opening

of Melrose Drive prior to completion of the ultimate improvements, has been filed with the City14
Engineer;\ o
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,16
California, as follows:
18 1. That the above recitations are true and correct.
19 2. That the construction of Melrose Drive from Palomar Airport Road to the City
20 northerly boundary, as shown on Drawing Number 399-4, is substantially complete.
21 3. An interim striping plan, drawing number 399-4c is on file with the City Engineer.
22 4. The City conditionally accepts Melrose Drive between Palomar Airport Road and
23 the northerly City boundary for the purposes of opening the road to vehicular traffic. Prior to final
24 acceptance, all identified punch-list work shall be completed to the satisfaction of the City
25 Engineer.
