RECOMMENDED ACTION:
Adopt Resolution Nos. 2006-232 2006-233 and 2006-234. appointing
three members to the Design Review Board.
ITEM EXPLANATION:
The composition of the Design Review Board, in accordance with Chapter 2.26 of the
Carlsbad Municipal code, consists of: Two (2) Planning Commissioners, one (1) Village
Redevelopment Area property owner, one (1) Village Redevelopment Area Business Owner,
and one (1) general member. All members of the Design Review Board must also be
residents of the City of Carlsbad.
The term of Sarah Marquez expired in October 2005. Ms. Marquez was originally appointed
in May 1994, and served until 1997. When the membership criteria changed in October
1997, in accordance with Ordinance NS-330, she was appointed as a representative of the
Village Property Owner category for a term expiring in October 2001. Ms. Marquez was
reappointed to an additional term expiring this year. She has served eleven years.
The term of Mike Schumacher expired in October 2005. Mr. Schumacher was originally
appointed in April 2005, to fill an unexpired term as a representative of the General Member
category. Mr. Schumacher has served six months.
In addition, the term of Courtney Heineman expired in October 2005. Mr Heineman was
originally appointed in May 1999, to fill an unexpired term. He was reappointed in December
2001, and has served six years. Mr. Heineman serves on the Board as a representative of
the Planning Commission. At their meeting of November 2, 2005, the Planning Commission
recommended that Mr. Heineman be reappointed and continue to serve until the expiration
of his Planning Commission term.
Current members of the Design Review Board are: Julie Baker and Tony Lawson.
Three appointments are needed: One to represent the Village Property Owner category,
one to represent the General Member category, and one to represent the Planning
Commissioner category.
NOTE: Members of the Design Review Board are subject to the provisions of the Political
Reform Act, and must file a Statement of Economic Interests.

Chairperson Segall asked if there were any other questions or if any members of audience wished to
speak on the item. Seeing none, he opened and closed public testimony.
MOTION
ACTION: Motion by Commissioner Montgomery, and duly seconded, that the Planning
Commission adopt Planning Commission Resolution No. 5977 recommending
adoption of a Mitigated Negative Declaration and Mitigation Monitoring and
Reporting Program and adopt Planning Commission Resolutions No. 5978,
5979, 5980 and 5981 recommending approval of General Plan Amendment
05-03, Zone Change 05-01, Local Facilities Management Plan Amendment
87-10(A) and Habitat Management Plan Permit 05-06 and adopt Planning
Commission Resolutions No. 5982, 5983, 5984, 5985, 5986, and 5987 approving
Tentative Tract Map CT 05-06, Non-Residential Planned Development Permit
05-04, Site Development Permit 05-03, Conditional Use Permit 05-01, Hillside
Development Permit 05-02, and Special Use Permit 05-01 based on the findings
and subject to the conditions contained therein.
DISCUSSION
Chairperson Segall commented that this use is a far better use for the area as opposed to more
residential homes, and he stated his support for the project.

AYES: Chairperson Segall, Commissioners Baker, Cardosa, Dominguez, Heineman,
Montgomery, and Whitton

ABSENT: None
Chairperson Segall closed the public hearing on Item 3 and asked Mr. Neu to introduce the next item.
4. Planning Commission Appointment for the Design Review Board
Mr. Neu introduced Item 4 and stated it was for an appointment to the Design Review Board. Mr. Neu
stated that City Council is asking that Planning Commission recommend a member to them and they
would take the appropriate action to appoint the replacement. Mr. Neu further stated that Commissioner
Heineman has served 6 years on the Design Review Board and is eligible for reappointment at least for
the remainder of his term as Planning Commissioner. Chairperson Segall asked when Commissioner
Heineman's term expires on the Planning Commission. Mr. Neu stated April 2006.
MOTION
ACTION: Motion by Commissioner Montgomery, and duly seconded, to extend
Commissioner Heineman's term on the Design Review Board.
VOTE: 7-0
AYES: Chairperson Segall, Commissioners Baker, Cardosa, Dominguez, Heineman,
Montgomery, and Whitton
NOES: None
ABSENT: None
PLANNING COMMISSION COMMENTS
Chairperson Segall gave a brief update on the Connecting Community Place and Spirit session held
today.
Commissioner Baker stated that at 3:00 p.m. November 3, 2005, at the Carlsbad Village Theater, the
Chamber of Commerce and City will announce the winners of the design competition for downtown
Carlsbad.
