RECOMMENDED ACTION:
That the City Council ADOPT Resolution No. 2006-241 .. APPROVING the second amendments in
2006 to the Land Use Element and Open Space and Conservation Element of the General Plan, consisting of
two projects commonly known as "La Costa Village Center Townhomes" (GPA 04-10) and "La Costa
Resort Lot Line Adjustment" (GPA 05-09).
ITEM EXPLANATION:
State law allows a jurisdiction to amend a mandatory element of the General Plan no more than four times
per calendar year. The mandatory elements are Land Use, Circulation, Housing, Open Space, Noise, Safety,
and Conservation. Each amendment to a mandatory element, however, may include more than one change
to that element.
The two General Plan Amendment applications listed below propose changes to the Land Use Element and
Open Space and Conservation Element. The City Council has approved in concept each of the applications
at duly noticed public hearings on the meeting dates noted below. The two applications are now being
grouped together to comprise the second amendments in 2006 to the Land Use Element and Open Space
and Conservation Element. The recommended action would formally adopt the changes to the General Plan
(previously approved in concept), which will ensure consistency between the General Plan and Zoning
Ordinance.

Element
The amendments to the Land Use Element and the Open Space and Conservation Element
of the General Plan are considered a project and therefore subject to CEQA. Since the
amendments consists of two different projects, the impacts of each project need to be
considered cumulatively. The City's environmental review of each project, as described
below, determined the projects would cause no significant environmental effects (when
mitigation measures are implemented for GPA 04-10).
The environmental analysis performed for each project revealed that the projects would
produce no cumulatively considerable impacts when viewed in connection with the effects of
past projects, other current projects, and probable future projects. Therefore, the cumulative
impacts resulting from the second amendments in 2006 to the Land Use Element and Open
Space and Conservation Element have been addressed adequately, and no additional
environmental analysis is necessary.

La Costa Village

GPA 04-10 is part of a project that consists of a subdivision of a 14.4 acre site (west side of
El Camino Real and north of Dove Lane) into 4 lots (2 residential lots for 53 condominiums,
1 driveway lot, and 1 open space lot). The project involves an amendment to the land use
designations (GPA 04-10 and LCPA 04-09), and the zoning designations (ZC 04-06 and
LCPA 04-09).
An environmental review for the project, including GPA 04-10, was processed in accordance
with CEQA. Potentially significant biological and noise impacts were identified. The
developer agreed to mitigation measures to reduce the identified impacts to below a level of
significance and a Mitigated Negative Declaration was prepared in accordance with CEQA.
The City Council adopted the Mitigated Negative Declaration and Mitigation Monitoring and
Reporting Program on June 27, 2006.

Lot Line
Adjustment
The proposed GPA is part of a project that consists of a change to the land use designations
on 7 parcels, and a lot line adjustment to convey property known as the "finger lands" of the
La Costa Resort and Spa property to adjacent property owners. .
An environmental review for the project, including GPA 04-10, was processed in accordance
with CEQA. No potentially significant impacts on the environment were identified. A
Negative Declaration was adopted by the City Council on July 11, 2006.

9 WHEREAS, pursuant to Government Code Section 65358(b), no mandatory
10 element of the General Plan shall be amended more frequently than four times during any
11 calendar year, and any one of those four amendments may include more than one change to
12 the General Plan; and
13 WHEREAS, the Land Use Element and Open Space and Conservation Element
14 are mandatory elements of the General Plan; and
15 WHEREAS, pursuant to Government Code Section 65358, and the provisions of
16 the Carlsbad Municipal Code, the Planning Commission did, on April 5, 2006 (GPA 04-10) and
17 May 17, 2006 (GPA 05-09), hold duly noticed public hearings as prescribed by law to consider
I O10 the proposed changes to the General Plan; and
in WHEREAS, the Planning Commission adopted Planning Commission
20 Resolutions No. 6055 and 6076 recommending approval in concept of the proposed changes to
21 the General Plan; and
22 WHEREAS, the City Council did, on June 27, 2006 (GPA 04-10) and July 11,
23 2006 (GPA 05-09), hold duly noticed public hearings to consider the Planning Commission's
24 recommendations and to hear all persons interested in the proposed amendments to the
25 General Plan and the related environmental reviews; and

WHEREAS, the City Council adopted City Council Resolutions No. 2006-180,
27 and 2006-193 approving in concept the proposed changes to the General Plan; and

1 WHEREAS, the City Council of the City of Carlsbad wishes to consolidate the
2 changes to the Land Use Element and the Open Space and Conservation Element of the
3 General Plan as proposed by GPA 04-10 and GPA 05-09 into a single amendment for each
4 element constituting the second Land Use Element Amendment of 2006 and the second Open
5 Space and Conservation Element Amendment of 2006;
6 NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Carlsbad,
7 California, does hereby resolve as follows:
8 1. That the above recitations are true and correct.
Q 2. That the findings of the City Council set forth in City Council Resolutions No.
, 0 2006-180 and 2006-193 (on file in the City Clerk's office) are made a part hereof by reference.
11 3. That the second amendments to the Land Use Element and Open Space and
Conservation Element of the General Plan during calendar year 2006 are approved as shown
12 on the attached exhibits consisting of: a) 1 page titled "GPA 04-10 LA COSTA VILLAGE
CENTER TOWNHOMES" (dated April 5, 2006), and b) 1 page titled "GPA 05-09 LA COSTA
13 RESORT LOT LINE ADJUSTMENT" (dated May 17, 2006).
14 EFFECTIVE DATE: The amendments to the Land Use Element and the Open
15 Space and Conservation Element shall become effective thirty (30) days following the adoption
16 of this resolution.
