DEPT. 18,705 8/21/06 CD CITIZENS' COMMITTEE TO STUDY THE FLOWER FIELDS AND THE STRAWBERRY FIELDS AREA DEPT. HEAD CITY ATTY. CITY MGR. RECOMMENDED ACTION: That the City Council ADOPT City Council Resolution No. 2006-254 . RECONVENING the Citizens' Committee to Study the Flower Fields and the Strawberry Fields Area and APPOINTING a smaller, working Committee to draft a comparative analysis for review and approval by the entire Committee. ITEM EXPLANATION: On April 18th and May 2nd, 2006, the City Council appointed an Ad Hoc Citizens' Committee to Study the Flower Fields and Strawberry Fields Area of the City. On July 25, the Council reviewed the Report prepared by the Citizens' Committee. The Report included a comparative analysis of the "Save the Strawberry and Flower Growing Fields Act of 2006" (Proposition E) that has qualified for the General Municipal Election of November 7, 2006 and a proposed, draft of a City measure (Proposition D) regarding the Study Area that the City Council was considering placing on the November 7 election ballot. The Report also included recommendations made by the Committee regarding the draft City measure (Proposition D). The Council accepted the Committee's Report and determined to revise the City measure to include all the recommendations of the Committee. On August 1st and August 8th, 2006, the City Council reviewed the revised City measure, entitled "Preserve the Flower and Strawberry Fields and Save Carlsbad Taxpayers' Money" (Proposition D) and determined to place it on the November election ballot. The measure includes all the changes recommended by the Citizens' Committee. Because Proposition D is substantially different from the draft originally reviewed by the Committee, the Council also requested that the Committee reconvene for the purpose of preparing a new comparative analysis that compares the revised Proposition D with Proposition E. Attached is a resolution reconvening the Citizens Committee to Study the Flower Fields and Strawberry Fields Area with the citizens originally appointed by the City Council. The purpose of the reconvened Committee would be to prepare a new comparative analysis. Since the City cannot expend taxpayer's funds to advocate a particular result in an election, the analysis needs to be a neutral, impartial comparison that could be utilized for voter educational purposes. The comparison cannot advocate a position in support of, or in opposition to either one of the two measures. The attached resolution also appoints a small, working Committee of the larger Committee to draft the comparative analysis which would then subsequently be considered by the entire Committee and forwarded to the City Council. There are sufficient funds remaining in the original account authorized by the City Council to fund reconvening the Committee. ENVIRONMENTAL IMPACT: Reconvening of the Committee and the appointment of previous members is not a project under the California Environmental Quality Act (CEQA) and no environmental review is required. City Council Resolution No. 2006-254 t reconvening the ad hoc Citizens' Committee and appointing a smaller, working Committee. 1 RESOLUTION NO. 2006-254 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, RECONVENING THE 3 CITIZENS' COMMITTEE TO STUDY THE FLOWER AND 4 STRAWBERRY FIELDS AREA OF THE CITY AND APPOINTING A SMALLER, WORKING COMMITTEE TO 5 PREPARE A COMPARATIVE ANALYSIS. 6 WHEREAS, on April 18 and May 2, 2006, The City Council appointed an Ad Hoc 7 Citizens' Committee to Study and Flower and Strawberry Fields Area of the City; and 8 WHEREAS, on July 25, 2006, the City Council accepted the Report from the 9 Citizens' Committee that included recommendations for revisions to a proposed City 10 ballot measure (now Proposition D) regarding the Study Area and a comparative analysis of the proposed City measure and an initiative that had qualified for the 12 November 7, 2006 General Municipal Election also affecting the Area Proposition E; 13 14 WHEREAS, on August 8, 2006, the City Council decided to place the City 15 measure (Proposition D) on the November 7, 2006 election with all the revisions 16 recommended by the Citizens Committee; and 17 WHEREAS, the City Council is desirous of reconvening the Citizens' Committee 18 for the purposes of preparing a new comparative analysis of the revised City ballot 19 measure and the initiative. 20 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of 21 Carlsbad, California, as follows: 22 1. That the above recitations are true and correct. 23 24 2. That the purpose and task of the reconvened Citizens' Committee shall be to prepare a new comparative analysis of the revised City measure entitled "Preserve the Flower and Strawberry Fields and Save Carlsbad Taxpayers' Money" (Proposition D) and the initiative entitled the "Save the Strawberry and Flower Growing Fields Act of 2006" (Proposition E). It is authorized to spend previously appropriated funds as necessary to complete that task. 4. That the comparative analysis prepared by the Citizens' Committee shall be a neutral, impartial analysis and shall not advocate a position in support of, or in opposition to the City measure or the initiative measure. 5.
