(@£2- CITY MGR. ~^p RECOMMENDED ACTION: Adopt Resolution No. 2006-261 accepting Zamborelli Enterprises, Inc.'s construction contract on the Rancho Santa Fe Road Fill Failure at Agua Dulce project, City of Carlsbad Project No. 1001 (FHWA project no. KJK-CBD-001-1); Zamborelli Enterprises, Inc.'s construction contract on La Costa Ave. at Marbella project, City of Carlsbad Project No. 1002 (FHWA project no. KJK-CBD-002-0); Erreca's construction contract on La Costa Ave. at Marbella project, City of Carlsbad Project No. 1002 (FHWA project no. KJK-CBD-002-0) as complete, and directing the City Clerk to record a Notice of Completion and release bonds in accordance with State Law and City Ordinances. ITEM EXPLANATION: At an emergency meeting of the City Council held on March 18, 2005, the City Council adopted Resolution No. 2005-089 authorizing emergency repairs to the slope adjacent to Rancho Santa Fe Road and Agua Dulce Court. Emergency work commenced immediately and Public Works contracts were executed with Zamborelli Enterprises, Inc. (ZEI) and Erreca's, Inc. The repairs at Agua Dulce for which ZEI was responsible were completed on August 1, 2006. City staff has inspected the work and found it to be satisfactory. Staff recommends formal acceptance of the slope repair work by the City Council. ENVIRONMENTAL IMPACT: The approval of a Notice of completion is a ministerial process and is exempt from the requirements of CEQA pursuant to Section 15268 of the State CEQA Guidelines.
