RECOMMENDED ACTION:
That the City Council ADOPT Resolution No. 2006-273 directing staff to continue to
implement the Early Public Notice Program and that this Program be subsequently codified as a part of
the update to Title 21 (Zoning Ordinance) of the Carlsbad Municipal Code.
ITEM EXPLANATION:
In July 2005, the City initiated a pilot Early Public Notice program for the purpose of providing earlier
notification to Carlsbad residents regarding project development proposals in their neighborhood. Prior
to embarking on this program, staff briefed the City Council and committed to provide an overall
assessment of the program (this report) after one year of implementation.
To summarize, the Early Public Notice program requires that within the first 30 days of the submittal of
an application to the City: 1) an early public notice be mailed to all property owners located within 600
feet of a property that is proposed for development and 2) that a project notice sign be posted in a
visible location on the project site.
The mailed Early Public Notice package (See Exhibit "2") includes: a non-technical description of the
project, an aerial photo of the project site and neighborhood, a reduced site plan and building elevations
whereby the proposed project is more understandable to the average resident.
The Early Public Notice signs (See Exhibit '3") are 6 square feet in size, colored yellow with black print
and briefly describe the project and City staff and applicant contact information. The signs are required
to be posted at the most publicly visible location on the project, or off-site subject to Planning Director
approval.
During this first year a total of 50+development applications have been subject to the Early Public
Notice process. The number of responses per notice has ranged from 2 to 10 with more neighborhood
feedback typically associated with infill development projects. Based upon this amount of community
response, staff concludes that the Early Public Notice program has been very effective in educating the
public and soliciting early public input on neighborhood development proposals. Furthermore, the
public comments have resulted in the early redesign of some projects, thereby avoiding "late-hits" at a
public hearing.
Accordingly, staff recommends that the Early Public Notice Program be continued indefinitely and that
this process be formalized by incorporating it into the Carlsbad Municipal Code (Title 21). This will be
accomplished as a part of the Planning Departments overall update of Title 21 which is scheduled to
begin this year.

FISCAL IMPACT:
Additional staff time will be required to continue to implement the Early Public Notice Program and to
process a zone code amendment to incorporate the program into the Zoning Ordinance. Staffing within
the Planning Department is adequate to continue the implementation of the Early Public Notice.
ENVIRONMENTAL IMPACT:
The continuation of the Early Public Notice Program is categorically exempt from the California
Environmental Quality Act (CEQA) per Section 15311, Accessory Structures (i.e. on-premise signs), of
the State CEQA Guidelines. Consistent with CEQA, environmental review will be conducted on the
subsequent zone code amendment.

The City Council of the City of Carlsbad, California, does hereby resolve as
5 follows:
6 WHEREAS, the City Council of the City of Carlsbad, on the 19th day
7 of September 2006, received a one year assessment of the pilot Early Public Notice
8 Program from City staff; and

WHEREAS, the program has been very effective in educating the public about

and soliciting early public input on neighborhood development proposals, and
NOW, THEREFORE, BE IT HEREBY RESOLVED BY the City Council of the
City of Carlsbad, California, as follows:

EARLY PUBLIC NOTICE
PROJECT NAME:BRITTANY COVE

This early public notice is to let you know that a development application for a residential project
within your neighborhood was submitted to the City of Carlsbad on December 2, 2003. The
project application is undergoing its initial review by the City.
LOCATION: The project site is located on the east side of Jefferson Street and north of Laguna
Drive (See Page 2). The property is zoned R-3 (Multiple Family Residential) and currently
developed with 6 single-family residences. Existing single-family and multi-family residences
surround the site.
PROJECT DESCRIPTION: Demolish the 6 existing residences and redevelop the .84 acre
property with 9 new residential condominium units (See Pages 3 and 4). The 9 condominium
units are proposed in 3 separate buildings (3 units per building) located along the project
driveway. All of the units are two-story (maximum 29') except an affordable unit, which is one-
story in height.
The project includes 1 one-bedroom affordable unit (774 square feet), and 8 three-bedroom
market rate units ranging in size from 2,199 to 2,491 square feet. Each unit includes a 2-car
garage and a private rear yard. Six spaces will be available for guest parking. A solid masonry
wall will be constructed around the project perimeter. Decorative paving will be used along the
private driveway with landscaping provided throughout the project and in private rear yards. The
project access will be off of Jefferson Street.
Please keep in mind that this is an early public notice and that the project design could change
as a result of further staff and public review. A future public hearing noticg will be mailed to you
when this project is scheduled for public hearing before the Planning Commission.
