RECOMMENDED ACTION:
ADOPT Resolution No. 2006-290 authorizing staff to prepare and distribute through US mail
and city facilities an "information brochure" about Proposition D and E to Carlsbad residents
and to allocate up to $30,000 in City funds for printing, mailing, postage and distributing the
information brochure.
ITEM EXPLANATION:
The purpose of the brochure is to provide Carlsbad residents with impartial information about
the two proposed initiatives that affect the Cannon Road corridor. The measures will appear on
the November 7 ballot. The brochure is a public service the City of Carlsbad is providing to
assist voters with learning about the impacts of the proposed initiatives, so they can make an
informed decision. The brochure will be reviewed by the City Attorney's office to ensure that it
follows the legal requirements of public education.
Background:
In July 2006, a local organization called "Concerned Citizens of Carlsbad" gathered the required
number of signatures to qualify a land use initiative for the November 7, 2006 ballot. The
proposed initiative affects the area of Carlsbad referred to as the "Cannon Road Corridor"
The Carlsbad City Council also proposed an initiative for the same area, and convened a 30-
member Citizen's Committee to study both initiatives. The Committee's membership was
comprised of a broad spectrum of local residents who were interested in assisting the City in
analyzing the impacts of the measures.
The Committee developed a matrix-system to facilitate the study of the proposed measures.
The Citizens' Committee presented its finding to the City Council in August. The City Council
reviewed the findings, and incorporated the recommendations of the Citizen's Committee into
their initiative, and voted to place it on the November 2006 ballot.
The City Council re-convened the Citizens' Committee to study the revised Council initiative
and the initiative proposed by the Concerned Citizens. The Committee developed a matrix to
compare the various land use, financial and other impacts the initiatives would have on the
Cannon Road area, should they be adopted by voters. The reports were accepted by Council
on 9/26/06.
The City Council believes it is an important public service to provide the information about the
financial, legal and Citizen's Committee analyses to Carlsbad residents, who will ultimately be
impacted by the decision made on Nov. 7, 2006.

FISCAL IMPACT:
The cost to print, mail and distribute information brochures two times to Carlsbad residents is
estimated at $30,000. Staff recommends that the funds be appropriated from the Council's
contingency account.
ENVIRONMENTAL IMPACT:
Acceptance of the recommendation to print and mail a Citizen's Information brochure does not
qualify as a project under the California Environmental Quality Act (CEQA Section 15378) and
no environmental review is required.

4 WHEREAS, The City of Carlsbad believes that providing information on issues is
5 an important public service, and believes it is the responsibility of government to keep
6 its citizenry informed,
7 WHEREAS, the City of Carlsbad is committed to transparently communicating
^ information to its citizens,

WHEREAS, the City of Carlsbad is committed to providing impartial analysis of
10 Proposition D and E, so that voters can make an informed decision,
11
WHEREAS, the City of Carlsbad has retained a respected jurist and former
12
justice to the Fourth District Court of Appeals to review the information to ensure it is
communicated in a fair and impartial manner that is in compliance with the law, and has
15 sent the information to the San Diego District Attorney,
16 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
17 Carlsbad, California, as follows:

19 2. Direct staff to prepare an impartial information brochure to distribute to

Carlsbad residents

3. Appropriate $30,000 from the Council contingency account in the General

RE: Propositions 90 and E
Dear Mayor Lewis & Councilmembers:
On behalf of the Carlsbad Chamber of Commerce, its over 1,600 members and 64,000
represented employees and the citizens of Carlsbad, we respectfully request that the City
Council instruct the City Attorney to research what impact Proposition 90 and
Proposition E will have on the City of Carlsbad and its taxpayers if they pass in
November.
Carlsbad is a city with a tradition of doing the right thing, not only for business, but for
its taxpayers. We believe that if Proposition 90 and Proposition E were to pass the City
and its taxpayers would be on the hook for even more than the election code, section
9212 report indicates.
It is obvious that Proposition E is a poorly written and researched initiative. Proposition
90 coupled with Proposition E could very well deplete any surplus dollars that the City of
Carlsbad has for services such as public safety, parks, trails and infrastructure
improvements.
We urge you to instruct the City Attorney to research the possible impacts on the
taxpayers of Carlsbad if Proposition 90 and Proposition E were to pass.
