ITEM EXPLANATION:
Project Background: The North Agua Hedionda Interceptor Sewer (NAHI), constructed in 1965, is a
24-inch diameter sewer pipeline approximately 15,500 feet in length which conveys approximately
1.3 million gallons of untreated wastewater per day (average daily flow) for treatment at the
Encina Water Pollution Control Facility. The alignment begins near the intersection of Cannon Road
and El Camino Real and proceeds westerly along the north shoreline of the Agua Hedionda Lagoon to
the Foxes Lift Station located just east of Interstate 5. Inspection of the pipeline and manholes
revealed the sewer has reached its useful life and is in need of rehabilitation.
Rehabilitation of the eastern segment, which included only trenchless construction methods with
minimal environmental permitting issues, was completed during 2003. The more extensive
rehabilitation to the NAHI western segment (Project) is burdened by its proximity to the Batiquitos
Lagoon's shoreline and surrounding Environmentally Sensitive Habitat Area (ESHA). The initial design
included insitu rehabilitation of existing manholes and re-establishment of an access road over the
pipeline alignment, which would also provide for a public trail along the shoreline of the lagoon.
Additionally, the design included a shoreline protection wall, protecting the existing pipeline,
manholes, and access road from further shoreline erosion.
Permit Status: All required local, state and federal permits, except for a Coastal Development Permit
(CDP) issued by the California Coastal Commission (CCC), have been acquired for the described
project. In response to the City's CDP application, CCC staff has clearly indicated with their staff
report, that they would not support the project as described or any project that perpetuated the
existing pipeline alignment near the lagoon when, in their opinion, other projects would lessen adverse
impacts to ESHA.
Project Revision: City staff is working with CCC staff to develop an alternative that is acceptable to
the CCC Board. Revisions include the design of a new parallel pipeline system implementing
tunneling construction methods. Tunneling methods will be used on that portion of the alignment
where ESHA impacts were unavoidable with the original rehabilitation design. The project revisions
will avoid environmental impacts, including those issues of concern by the CCC, and will be designed
for a useful life of 50 to 100 years. While a CDP will continue to be necessary for the revised design,
no other resource agency permit or local permits will be required for the project.
Additional Design Services: Revision to the project requires additional professional engineering design
services to supplement the existing design. Dudek and Associates has provided the engineering
design services for the original design and through their project familiarity and experience with pipeline
tunneling design, is uniquely qualified to provide the proposed tunneling design.

On October 3, 2005, the City and Dudek and Associates entered into an agreement for engineering
and environmental services for a fee not-to-exceed $81,783. Services in this agreement included
engineering tasks necessary to complete plans and specifications through final design. Prior to this
agreement, Dudek and Associates had completed 70% design through a separate agreement.
On December 21, 2005, Amendment No. 1 was approved for a fee not-to-exceed $18,190.
Engineering services in this amendment included design modifications which would reduce
environmental impacts caused during the construction of a proposed shoreline protection wall.
The scope of work for proposed Amendment No. 2 includes engineering services for a fee
not-to-exceed $137,000. Engineering services in this amendment will provide for the plans and
specifications necessary for project revisions, including the design and specification for construction of
the tunneled parallel pipeline.
ENVIRONMENTAL IMPACT:
The CEQA process for the initial project was completed with certification of an EIR by the Planning
Commission. It is anticipated that the revised project will require either a Negative Declaration (ND) or
Mitigated Negative Declaration (MND). The appropriate document will be prepared in accordance with
the requirements of the California Environmental Quality Act (CEQA) and will be circulated for public
review. Approval of the CEQA document from the Planning Director will be obtained prior to
completion of design and bidding of the project.

The cost associated with the subject amendment is $137,000 with the total amount of the agreement
not-to-exceed $236,973 and is included in the estimates for engineering design services in the table
above. Sufficient funds are available for the completion of the project design. Staff will request
City Council to authorize appropriation of additional funds for the construction of this project as part of
the construction contract award process. The project is funded from the Sewer Replacement Fund.
Funds are available from the Sewer Replacement Fund for the estimated additional amount.

Amendment No. 2, with a total amount of the said agreement not-to-exceed $236,973 for
environmental permitting and engineering design of the North Agua Hedionda Interceptor Sewer's
western segment, is accepted and approved and the Mayor is hereby authorized and directed to

Proposal for Additional Engineering Service - Microtunnelling
Dear Mr. Biskup:
As you know, Dudek has prepared complete plans and specifications for restoration of access to the North
Agua Hediondia sewer, including extensive shoreline protection. We understand permitting the project
through the California Coastal Commission has necessitated a new approach. The purpose of this letter is
to provide an engineering proposal for an alternative design that relocates the existing sewer away from
the lagoon by use of trenchless technologies. Dudek proposes to utilize much of the current design,
however this changes will require engineering services beyond the original scope. This proposal presents
the additional services and costs for revising the design plans to meet the new project goals.
Detailed Scope of Work
Dudek and our subconsultants, Jacobs Associates, TerraCosta Consulting Group (structural), and San
Dieguito Engineering will provide additional engineering consulting and design services as follows:
Task 1.0 - Initial Project Planning
The following items of work are needed to determine the design alignment, impacts to the existing
properties, assess the easement value, and determine the overall rough estimate of the project construction
cost.
• Meet with a drilling contractor and microtunneling (jacking) consultant on-site to determine the
accessibility and constructability of drilling an intermediate jacking pit. (complete)
• Determine the final horizontal alignment of the jacking portion of the alignment, (complete)
• Determine the number of soils tests to make and the locations of the bore holes (complete)
• Offset the alignment by 5-feet to either side to show the easement area. The offset will be
centered along the pipeline unless directed by the City, (complete)
• Using the 100-ft buffer line from the existing 2-ft contour, quantify the area within the easement
for each parcel along the jacking portion that is either within, or outside the buffer area
(complete)
• Overlay areas of existing sensitive or endangered habitat and quantity the areas within each parcel
that contain sensitive or endangered habitat, (complete)
• Identify the limits between slopes zero and 25%, 25% and 40% and greater that 40% slope.
Quantify the areas within each parcel that fit within these three slope ranges, (complete)
• Prepare an updated project construction cost estimate eliminating the seawall work and adding
the new pipeline installation and associated connection manholes .

The deliverable of Task 1 will be a series of exhibits showing the easement, buffer areas, steep slopes and
impacts to natural habitats, and a planning level construction cost estimate for the project.
Task 2.0 - Geotechnical Investigation
Following approval of the City to move forward with Design, Dudek will coordinate with Terra Costa to
perform soil samples at three locations along the alignment. Soils testing will be in accordance with the
requirements necessary for completing the micro-tunneling specifications. Terra Costa will prepare a
letter report summarizing the results of the soils sampling.
Testing points will be at either end of the tunneling operation and one deep bore at the hinge point.
Testing will involve capturing a core sample within the tunnel horizon to best represent the conditions
what will be encountered during the drilling operation.
The deliverable for Task 2 will be a geotechnical report summarizing the subsurface soil conditions in the
tunnel horizon, including specific rock classification information necessary for micro-tunneling.
Task 3.0 - Easement Documents
Dudek will coordinate with San Dieguito Engineering to prepare plat map and legal descriptions of
permanent and temporary construction easements along the alignment and staging areas required for
construction. Plats and legal descriptions will be in a format consistent with other documents previously
prepared on the project.
The Deliverable for Task 3.0 will be new plat and legal descriptions for eleven parcels reflecting the
alignment of the micro-tunneling and related construction staging areas.
Task 4.0 - Engineering Design
Dudek will modify the existing design drawings to incorporate the changes in the design. Changes and
additions will include:
• Update Title sheet and General Notes
• Remove any work between the original stations 1+00 and 5+00.
• Remove the paved extension of Hoover Street to the shoreline
• Remove all details and design plan and profiles reflecting the sea wall design (Sheets 4, 5, 6, 11,
12, 14, 16, 17 and 18)
• Add Plan and Profile sheets projecting new gravity pipeline between existing Manhole 9A and 19
using approximately 100 linear feet (If) of open trench installation and 1,900 If of micro-
tunneling.
• Add details and staging delineation for each of two jacking pits
• Add details and staging delineation for the single mid-point receiving pit
• Sheets 8 and 9 will remain the same
Project technical specifications will be updated to reflect the change in work. The following sections will
be removed:
• Sheet Piles
• Modular Concrete Retaining Wall
• Cable Hand Rails
Several technical specifications will be added for work related to the microtunneling installation. Dudek
will incorporate the expertise of Craig Camp of Jacobs Associates for review and recommendations of the

micro-tunneling plan and profile alignment and details. Mr. Camp will assist in preparation of the
specifications sections related to the micro- tunneling operation.
The specification, bid schedule and bid documents will be updated to reflect the change in construction
work.
The project construction cost estimate will be revised to reflect the change in scope of work. The current
construction cost estimate compares the use of a CEDH pier wall system and Silent Pier pressed-in sheet
pile wall system for construction of the access road along the lagoon shoreline. The construction cost
estimate will remove line items related to the seawall construction, as well as access roadway construction
and include construction costs associated with the micro-tunneling installation method.
Dudek will submit a revised plans/specifications/estimate package reflecting 90% of design for City
review and comment. Following City review, a meeting will be coordination to address City comments.
Final comments will be addressed and a 100% design package will be submitted. Any remaining minor
comments from the 100% submittal will be addressed and final project mylar plans will be prepared,
stamped, signed and submitted for advertising.
Bid and Construction Phase services will be in accordance with the current project contract.
Deliverables for Task 4.0 include 90%, 100% and Final Design plans, specifications and construction cost
estimates. Two copies of each submittal will be provide at 90% and 100% stages. One set of signed
mylar plans will be submittal at the final stage. One electronic copy of the specifications, estimate and
design drawings will also be provided on CD.
To stay on schedule, project budget originally reserved for bidding and construction phases was used to
complete Task 1 of this proposal. Therefore this proposal reestablishes budget for the following tasks
according to the description from the original contract:
• Bid Phase Support
• Services During Construction
• Reimbursable Expenses
Subconsultant services from Jacobs Associates only includes work up to final design and does not include
bidding or engineering support during construction. If such services are necessary, a separate proposal
will be prepared itemizing the associated scope and costs for City consideration.
Proposed Project Fee
Reimbursable costs such as copies, shipping, mileage, etc are estimated at $2,000 and will be billed at
cost plus 15%. Based on our assessment of the expanded scope of services, Dudek proposes to perform
the additional engineering, surveying, and geotechnical tasks outlined herein on a time and materials basis
for an estimated fee of One Hundred Thirty Seven Thousand Dollars ($137,000). A detailed breakdown
of this fee proposal is attached in Exhibit A.
Proposed Schedule
Dudek has already completed the majority of Task 1 items. We anticipate the geotechnical investigation
and study will be completed within 6-weeks of notice to proceed. Modifications to the design plans and
specifications will begin upon the NTP. Submittal of the 90% design is anticipated to occur within seven
weeks of the notice to proceed and within one-week of completion of the geotechnical investigation.

AMENDMENT NO. 2 TO EXTEND AND AMEND AGREEMENT FOR
ENGINEERING AND ENVIRONMENTAL SERVICES
(DUDEK AND ASSOCIATES, INC.)
Ji^Araendment No. 2 is entered into and effective as of the /9 day
£X&xX^. , 200(c , extending and amending the agreement dated
i, 2005 (the "Agreement") by and between the City of Carlsbad, a municipal
corporation, ("City"), and Dudek & Associates, Inc., a California corporation, ("Contractor")
(collectively, the "Parties") for North Agua Hedionda Interceptor Sewer Improvements.
RECITALS
A. On December 21, 2005, the Parties executed Amendment No. 1 to the
Agreement, extending the contract term by one (1) additional year until October 3, 2006 and
amending services to provide additional engineering tasks; and
B. The Parties desire to alter the Agreement's scope of work to include design for an
alternative construction method; and
C. The Parties have negotiated and agreed to a supplemental scope of work and fee
schedule, which is attached to and incorporated by this reference as Exhibit "A", Scope of
Services and Fee; and
D. The Parties desire to extend the term of the Agreement until October 3, 2007.
NOW, THEREFORE, in consideration of these recitals and the mutual covenants
contained herein, City and Contractor agree as follows:
1. In addition to those services contained in the Agreement, as may have
been amended from time to time, Contractor will provide those services described in Exhibit "A".
With this Amendment, the total annual Agreement amount shall not exceed two hundred thirty
six thousand nine hundred seventy three dollars ($236,973).
2. City will pay Contractor for all work associated with those services
described in Exhibit "A" on a time and materials basis not-to-exceed one hundred thirty seven
dollars ($137,000). Contractor will provide City, on a monthly basis, copies of invoices sufficiently
detailed to include hours performed, hourly rates, and related activities and costs for approval by
City.
3. Contractor will complete all work described in Exhibit "A" by October 3,
2007.
4. That the Agreement, as may have been amended from time to time, is
hereby extended for a period of one year, with all other provisions of the Agreement remaining in
full force and effect.
5. All requisite insurance policies to be maintained by Contractor pursuant to
the Agreement, as may have been amended from time to time, will include coverage for this
Amendment.

6. The individuals executing this Amendment and the instruments referenced
in it on behalf of Contractor each represent and warrant that they have the legal power, right and
actual authority to bind Contractor to the terms and conditions of this Amendment.
