NOTICE OF COMPLETION FOR THE CONSTRUCTION
CONTRACT ON THE INDUSTRIAL PARK PIPELINES
FOR THE ENCINA BASIN WATER RECLAMATION
PROGRAM, PHASE II PROJECT,
PROJECT NOS. 3887-C, 3667, AND 3930

RECOMMENDED ACTION:
Adopt Resolution No. 2006-315 accepting the construction contract on the Industrial Park
Pipelines for the Encina Basin Water Reclamation Program, Phase II, Project Nos. 3887-C, 3667, and
3930 as complete, and directing the City Clerk to record a Notice of Completion and release bonds in
accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On January 18, 2005, J. Fletcher Creamer & Son, Inc. was awarded a contract in the amount of
$9,171,466 for the construction of the Industrial Park Pipelines for the Encina Basin Water
Reclamation Program, Phase II, Project Nos. 3887-C, 3667, and 3930.
J. Fletcher Creamer & Son, Inc. substantially completed the pipeline work on August 2, 2006. City
staff has inspected the work and found it to be satisfactory. After the pipeline was completed,
Engineering requested additional work be performed. The final change order was fully executed on
October 12, 2006 and the work has been completed. Staff recommends formal acceptance of the
improvements by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

PROJECT NOS. 3887-C. 3667. AND 3930

WHEREAS, the construction of the Industrial Park Pipelines for the Encina Basin Water

Reclamation Program, Phase II was substantially completed to the City's satisfaction by J.
Fletcher Creamer & Son, Inc. on August 2, 2006; and
WHEREAS, the final change order was fully executed on October 12, 2006; and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the Industrial Park Pipelines for the Encina Basin Water Reclamation
Program, Phase II, specifically identified as Project Nos. 3887-C, 3667, and 3930, is deemed
complete and is hereby accepted by the City Council of the City of Carlsbad.
3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
execute and record the Notice of Completion for the Industrial Park Pipelines for the Encina Basin
Water Reclamation Program, Phase II, Project No. 3887-C, 3667, and 3930.
