RECOMMENDED ACTION:
Adopt Resolution No. 2006-317 authorizing a refund of business license taxes to Carter's If They
Could Just Stay Little of $971.00 and Felly's Fish Market & Deli, Inc. of $1,027.00.
ITEM EXPLANATION:
Carter's If They Could Just Stay Little had an ownership transfer to Carter's Retail Inc. Both
entities paid for their 2006/2007 business license taxes. Carter's If They Could Just Stay Little
has requested a refund for this overpayment.
Felly's Fish Market & Deli, Inc. made an error in calculating the amount due for business license
taxes. They have requested a refund for this overpayment.
The Finance Department has audited the two refund requests and confirmed the receipt of
Carter's duplicate payment and verified the amount of Felly's Fish Market & Deli, Inc.'s
overpayment.
Section 5.04.130 of the Carlsbad Municipal Code requires Council approval of any refund in
excess of $500. Therefore, staff is recommending approval of refunds to Carter's If They Could
Just Stay Little of $971.00 and Felly's Fish Market & Deli, Inc. of $1,027.00.
FISCAL IMPACT:
The payments will result in $1,998.00 refunds. There is no true fiscal impact as the payments
were in error.
ENVIRONMENTAL IMPACT:
No environmental impact.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, REFUNDING BUSINESS TAX
PAYMENTS TO CARTER'S IF THEY COULD JUST STAY
LITTLE AND FELLY'S FISH MARKET & DELI, INC.
WHEREAS, Carter's If They Could Just Stay Little and Felly's Fish Market
Inc. overpaid their business license taxes to the City of Carlsbad; and
& Deli,
WHEREAS, the Finance Department confirmed the overpayment by Carter's If
They Could Just Stay Little and Felly's Fish Market & Deli, Inc. and verified the refund
amount.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
Carlsbad, California, as follows:
1 . That the above recitations are true and correct.
2. That the refund of business license tax of $971.00 to Carter's
Could Just Stay Little and $1 ,027.00 to Felly's Fish Market & Deli,
authorized.
