RECOMMENDED ACTION:
Adopt Resolution No.2006-323 appointing one member to the Buena Vista
Lagoon Joint Powers Committee.
ITEM EXPLANATION:
The Carlsbad City Council, in December, 1982, adopted Resolution No. 7100, approving
the Buena Vista Lagoon Joint Powers Agreement. Subsequently, in January, 1983, the
Council adopted Resolution No. 7112, approving the formation of the Buena Vista Lagoon
Joint Powers Committee, appointing three members to represent the City of Carlsbad, and
authorizing the City Council to appoint, replace, and remove members.
Under the terms of the Joint Powers Agreement, two of the appointees from the City of
Carlsbad must be City Council Members, and one must be a member of the public. The
current Council Members serving on the Committee are Council Members Packard and
Sigafoose.
The third appointee from the City of Carlsbad is a citizen, Pearl Tade. At the Joint Powers
Committee Meeting held on September 25, 2006, Ms. Tade submitted her resignation from
the Committee. Therefore, one appointment is needed to fill the vacancy.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, APPOINTING ONE MEMBER TO
4 THE BUENA VISTA LAGOON JOINT POWERS COMMITTEE

WHEREAS, The Buena Vista Lagoon Joint Powers Agreement was originally
6
approved by the City Council on December 21, 1982; and
7
WHEREAS, Section 5 of the Agreement established the Buena Vista Lagoon8

Joint Powers Committee, and
WHEREAS, Section 6 of the Agreement established the membership of the
Committee for the participating cities, and authorized the City of Carlsbad to have three
members on the Committee, two City Council Members and one public member; and
WHEREAS, the City's public member, Pearl Tade, has announced her resignation

from the Committee.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of

Carlsbad, California, as follows:17
18 1. That the above recitations are true and correct.
2. That the following person is hereby appointed to the Buena Vista Joint
Powers Committee, to serve as the City of Carlsbad's public member, for a two year
