RECOMMENDED ACTION:
Adopt Resolution No. 2006-327 awarding the construction contract for On-Site Wetland
Mitigation Restoration for Rancho Santa Fe Road North, Project No. 3907.
ITEM EXPLANATION:
The regulatory permits for construction of Rancho Santa Fe Road North, Phases 1 and 2 required
mitigation and restoration for disturbance to wetland, upland, and ephemeral stream areas.
This project covers the on-site wetland restoration in the area under and adjacent to the new bridges
over San Marcos Creek. The off-site mitigation and restoration work will be constructed under a
separate contract.
On June 20, 2006, City Council authorized the advertisement for bids for the On-Site Wetlands
Mitigation Restoration project. The Purchasing Department received three (3) sealed bids on
August 17, 2006, as shown in Table 1.

The Engineer's Estimate for this contract is $176,000.
The bid submitted by MRS Restoration, Inc. has been withdrawn due to a potential conflict. Therefore,
the apparent lowest responsible and responsive bidder is Nature's Image. All bid documents
submitted by Nature's Image have been reviewed by staff and found to be in order.
ENVIRONMENTAL IMPACT:
The City Council, at their meeting on June 2, 1992, passed Resolution No. 92-152 certifying
EIR No. 91-1 for both Phase 1 and Phase 2 of the Rancho Santa Fe Road project. The City Council,
at their meeting on April 25, 2000, passed Resolution No. 2000-128 approving Addendum No. 2 to the
final EIR No. 91-1 for Rancho Santa Fe Road. This EIR covers the realignment and widening of
Rancho Santa Fe Road from La Costa Avenue to Melrose Drive.
This on-site wetland restoration is to comply with requirements of the California Department of
Fish and Game (CDFG) 1601 permit issued for the road realignment project.

The estimated cost for the On-Site Wetland Mitigation Restoration work under consideration is
$176,000 and is included in the Environmental Mitigation & Monitoring task as shown in the table
above. The On-Site Wetlands Mitigation Restoration project will be funded with available
Rancho Santa Fe Road funds.

3 CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING
THE CONSTRUCTION CONTRACT FOR THE ON-SITE
4 WETLAND MITIGATION RESTORATION FOR RANCHO SANTA
FE ROAD NORTH. PROJECT NO. 3907.

WHEREAS, plans and specification have been approved by the City Council of the
6
City of Carlsbad, California for On-Site Wetland Mitigation Restoration for Rancho Santa Fe Road
7
North, Project No. 3907; and

WHEREAS, the lowest responsible and responsive bid received for the On-Site Wetland
Mitigation Restoration work was submitted by Nature's Image in the amount of $156,393.73; and
10 WHEREAS, the total estimated costs for the City's contract for construction of the
11 On-Site Wetland Mitigation Restoration project is $176,000.
12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
13 California, as follows:
1. That the above recitations are true and correct.
2. That the bid of $156,393.73 submitted by Nature's Image for the On-Site Wetland

Mitigation Restoration for Rancho Santa Fe Road North project is accepted.

3. That the City Manager is hereby authorized to approve construction change
17
orders for the On-Site Wetland Mitigation Restoration for Rancho Santa Fe Road North project,
18 up to $35,000.
19 4. That the Mayor of the City of Carlsbad is hereby authorized and directed to
execute a contract for the On-Site Wetland Mitigation Restoration for Rancho Santa Fe Road
21 North project with Nature's Image.
22 5. That the award of this contract is contingent upon Nature's Image executing the
23 required contract and submitting the required bonds and insurance policies, as directed in the
24 contract, within twenty (20) days of adoption of this resolution. The City Manager may grant
reasonable extensions of time.
