RECOMMENDED ACTION:
Adopt Ordinance No. NS-824 amending the Carlsbad Municipal Code, Section 2.08.090, to
exempt the Carlsbad Tourism Business Improvement District (CTBID) Board of Directors
from being required to be residents of the City of Carlsbad.
ITEM EXPLANATION:
Ordinance No. NS-824 was introduced and first read at the City Council meeting held on
December 5, 2006. The second reading allows the City Council to adopt the ordinance,
which would then become effective in thirty days. The City Clerk will have the ordinance
published within fifteen days, if adopted.

2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AMENDING SECTION 2.08.090 OF THE CARLSBAD
3 MUNICIPAL CODE TO EXEMPT THE CARLSBAD TOURISM BUSINESS
IMPROVEMENT DISTRICT (CTBID) BOARD OF DIRECTORS FROM
4 BEING RESIDENTS OF THE CITY OF CARLSBAD
5 The City Council of the City of Carlsbad, California, does ordain as follows:
6 Section I: That Section 2.08.090 of the Carlsbad Municipal code is amended to read as
follows:

"2.08.090 Boards and Commission membership - Citizenship required.
8 It is a prerequisite for appointment to any city board, commission, committee that the
member be a resident of the city and a registered voter, except that members of the Carlsbad
9 Tourism Business Improvement District (CTBID) Board of Directors shall be assessees of the
CTBID regardless of residency."

EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption; and
the City Clerk shall certify the adoption of this ordinance and cause it to be published at least
once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its
adoption.14

INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council on
the 5th day of December, 2006, and thereafter.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the
City of Carlsbad on the 12th day of December, 2006, by the following vote:
AYES: Council Members Lewis, Hall, Kulchin, Packard.
NOES: None.
ABSENT: Council Member Sigafoose.
ABSTAIN: None.
