CITY MGR. ~~Sp. — *TCl RECOMMENDED ACTION: Adopt Resolution No. 2007-015 approving plans and specifications and authorizing the City Clerk to advertise for bids for the construction of the widening of Olivenhain Road and Rancho Santa Fe Road, Project No. 3860. ITEM EXPLANATION: The Olivenhain Municipal Water District (OMWD) obtained approval of Conditional Use Permit 02-01 for the expansion and continued operation of their headquarters and operations yard at the corner of Olivenhain Road and Rancho Santa Fe Road. The Conditional Use Permit includes a condition which states that the OMWD shall design the roadway improvements and the City shall construct the improvements pursuant to a reimbursement agreement. The construction project consists of roadway widening improvements along Olivenhain Road and Rancho Santa Fe Road. In addition to the construction along the OMWD site, the project improvements extend to the northeast along Rancho Santa Fe Road and westerly along Olivenhain Road. The construction to the northeast of the OMWD site along Rancho Santa Fe Road will enable the widening to join existing improvements northwest of the intersection. The construction to the west along Olivenhain Road and into the City of Encinitas is needed to facilitate and complete the widening of Olivenhain Road. The plans and specifications for the project have been prepared. The City and OMWD have executed the necessary reimbursement agreement as noted above. The City of Carlsbad has also executed a reimbursement agreement with the City of Encinitas for the portion of construction within the City of Encinitas. Together, these two reimbursement agreements will enable the entire scope of construction along Olivenhain Road and Rancho Santa Fe Road to be awarded as a single contract. This will facilitate the efficient and coordinated construction of the improvements. ENVIRONMENTAL IMPACT: Based on an agreement between the City of Carlsbad and OMWD, the OMWD serves as the lead agency for the preparation of environmental documents and the City of Carlsbad is the responsible agency due to the permit authority over the development project. As lead agency, OMWD prepared the Mitigated Negative Declaration for the project which was adopted on August 27, 2003. As the responsible agency, the City made a finding in the approving resolution for the project that the environmental review is adequate to cover the proposed development and legislative actions. In regard to the improvements within the City of Encinitas, they performed an Environmental initial Study in accordance with CEQA which was circulated for review and comment. The Encinitas City Council then adopted the Mitigated Negative Declaration on September 4, 2005. FOR CITY CLERKS USE ONLY. The City of Carlsbad will utilize Rancho Santa Fe Road funds (collected through proposed CFD#2) for the roadway improvements not related to the OMWD/development frontage improvements including the improvements to the northeast along Rancho Santa Fe Road. The improvements to the west along Olivenhain Road within the City of Encinitas will be funded by the City of Encinitas. The Reimbursement Agreements which have been executed provide for the payment of the actual project costs by OMWD and the City of Encinitas. OMWD and Encinitas will submit deposits to the City of Carlsbad after the construction bids are received and prior to the award of the construction contract. The deposits will be based on the successful bidders proposal and will include the cost of each agencies construction items plus a 10% contingency. If the deposits are insufficient to cover the actual costs of construction, the agreements include provisions requiring OMWD and the City of Encinitas to make additional payments to fully fund the costs of their associated construction expenses. Sufficient funds have been appropriated by the City of Carlsbad for the City's share of the project costs. EXHIBITS: 1. Location Map 2. PROJECT NO. 3860. WHEREAS, the City Council of the City of Carlsbad, California, has determined it necessary, desirable, and in the public interest to construct the widening of Olivenhain Road and Rancho Santa Fe Road, Project No. 3860; and WHEREAS, the plans and specifications for furnishing of all labor, materials, tools, equipment, transportation, and other expenses necessary or incidental to said project have been prepared and are on file in the Public Works-Engineering Department of the City of Carlsbad and are incorporated herein by reference; and WHEREAS, on January 7, 2004, the City of Carlsbad Planning Commission approved Resolution No. 5538 approving the Olivenhain Municipal Water District Campus Plan, Conditional Use Permit 02-01; and WHEREAS, the City of Carlsbad has entered into an agreement with the Olivenhain Municipal Water District which requires the Olivenhain Municipal Water District to deposit the funds necessary to construct the improvements which are their responsibility as conditioned in Conditional Use Permit 02-01 after construction bids are received and prior to awarding the construction contract; and WHEREAS, the City of Carlsbad has entered into an agreement with the City of Encinitas which requires the City of Encinitas to deposit the funds necessary to construct the improvements within the City of Encinitas after the construction bids are received and prior to awarding the construction contract; and WHEREAS, there are sufficient funds available in the project accounts to construct the improvements in the City of Carlsbad which are not the responsibility of the Olivenhain Municipal Water District as conditioned in Conditional Use Permit 02-01. 1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 2 California, as follows: 3 1. That the above recitations are true and correct. 4 2. That the plans, specifications, and contract documents for the Widening of 5 Olivenhain Road and Rancho Santa Fe Road, Project No. 3860, on file in the Public Works- 6 Engineering Department of the City of Carlsbad are hereby approved. 7 3.
