RECOMMENDED ACTION: That the City Council, by motion, authorize a closed session to discuss pending litigation as follows: I move that the City Council hold a closed session based on existing facts and circumstances regarding pending litigation including an appeal against San Diego County Regional Water Quality Control Board Permit pursuant to Government Code section 54956.9(c). This probably has to do with the new Storm water permit requirements for municipalities. It is not in your citizens or the cities interst to fight against these new expanded requirements. You want tourism and it is imperative that our streams, beaches and lagoons are clean. Don't be suckered by the attornies. THE CITY IS COMMITED TO CONTINUE COMPLYING WITH THE REGIONAL WATER QUALITY PERMITS, AND BELIEVES THE STATE HAS A RESPONSIBILITY UNDER THE STATE CONSTITUTION TO FUND MANDATED PROGRAMS.
