U^ — RECOMMENDED ACTION: Adopt Resolution No. 2007-031 appropriating funds from the Rancho Santa Fe Road Fund (proposed CFD #2) to the CCOA Encinitas Capital Project Fund and authorizing payment to the City of Encinitas. ITEM EXPLANATION: The City of Carlsbad approved an agreement with the City of Encinitas on July 12, 1994 for the construction of various circulation element roads titled "Agreement between the City of Carlsbad and the City of Encinitas for the construction of various circulation element roads (see Exhibit 1) within the Cities of Carlsbad and Encinitas" ("Agreement"). This Agreement was created to share the responsibilities for the construction of circulation element roadways that affected both Cities. Maintaining established minimum service levels on El Camino Real, Rancho Santa Fe Road, La Costa Avenue, Leucadia Boulevard, and Olivenhain Road was deemed mutually beneficial to both Cities. As such, both Cities agreed on the responsibilities for the funding, design, construction, and maintenance of the aforementioned roadways. Olivenhain Road, Site #8 as shown on Exhibit 1, was the only project listed in the Agreement where each City's responsibility was equally divided. According to the Agreement, each City would fund one half of the total project costs for Olivenhain Road. Funding for the City of Carlsbad's portion of the Olivenhain Road improvements came from the Rancho Santa Fe Road Fund (proposed CFD #2). Furthermore, the City of Carlsbad was designated lead agency and accounted for each Agency's share of the project costs via separate project accounts. Project expenditures where charged to the CCOA Encinitas Capital Project Fund and the CCOA Encinitas Fund was reimbursed, as necessary, from Rancho Santa Fe Road funds (collected through proposed CFD #2) to maintain the required 50% split in project expenditures. To accurately account for each participant's prorata share of the Olivenhain Road project expenditures, an adjustment needs to be made transferring $28,133.16 in cash from the Rancho Santa Fe Road Fund (proposed CFD #2) to the CCOA Encinitas Capital Project Fund. This transfer will enable the City of Carlsbad to maintain the required expenditure ratio and reimburse the City of Encinitas for their share of the Olivenhain Road project expenditures.
