RECOMMENDED ACTION:
Adopt Resolution No. 2007-033 accepting the construction contract on the Carlsbad
Boulevard OH Bridge Retrofit, Project No. 3557-1 as complete, and directing the City Clerk to record a
Notice of Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On February 7, 2006, KLM Construction Inc. was awarded a contract in the amount of $900,080 for
the construction of the Carlsbad Boulevard OH Bridge Retrofit, Project No. 3557-1.
KLM Construction Inc. substantially completed the bridge work on October 11, 2006. The punch-list
work was completed January 22, 2007. City staff has inspected the work and found it to be
satisfactory. Staff recommends formal acceptance of the improvements by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

WHEREAS, the construction of the Carlsbad Boulevard OH Bridge Retrofit has been
5
completed to the City's satisfaction by KLM Construction Inc. on January 22, 2007; and
6
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

California, as follows:10
1. That the above recitations are true and correct.11
12 2. That the Carlsbad Boulevard OH Bridge Retrofit, specifically identified as Project
13 No. 3557-1, is deemed complete and is hereby accepted by the City Council of the City of
14 Carlsbad.
15 3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
16 execute and record the Notice of Completion for the Carlsbad Boulevard OH Bridge Retrofit,
17 Project No. 3557-1.
