RECOMMENDED ACTION:
Adopt Resolution No. 2007-043 accepting bids and awarding a contract to Good & Roberts, Inc.
for the construction.of Senior Center Improvements, Project No. 45001-2.
ITEM EXPLANATION:
On October 17, 2006, the City Council approved plans and specifications and authorized the
advertisement of bidding for the construction of the Senior Center Improvements. The project includes
tenant improvements to approximately 14,245 square feet within the existing Senior Center (an area
formerly owned by the Carlsbad Unified School District.
The first floor (approx. 8,475 square feet) is designed to augment senior activities and includes:
• Fitness center
• Computer lab
« Multi-purpose / conference room
• Arts and crafts room
• Bathroom and changing room (including a shower)
• Several small office rooms (for tax preparation assistance, blood pressure testing, etc.)
• Game room
• Lunch area
The second floor will house Recreation Administration offices.
Ten bids were received on January 23, 2007. The following is the breakdown of the bids:

The apparent low bidder is Good & Roberts, Inc. at $631,500. The second low bidder, Stevens
Construction, alleged that Good & Roberts did not send in their subcontractor's prices within the required
time limits as specified in California Public Contracting Code. The Public Works Buyer and City
Attorney's Office have reviewed the allegation and have determined that Good and Roberts did indeed
send in the required information within the allocated time limits. Stevens Construction has subsequently
decided not to pursue their objections.
FISCAL IMPACT:
Current funds of $1,535,229 are available in the 2006-2007 Fiscal Year Capital Improvement Program to
cover the cost of the project. These include Redevelopment Agency funds ($1,027,017 allocated for the
first floor improvements) and $508,212 from General Capital Construction fund (for second floor
improvements).

* 30% is used due to the nature of the project being essentially a retrofit tenant improvement. This type of project
has a greater chance of experiencing potential change orders due to encountering unknown pre-existing conditions
(e.g. cracked slabs under existing flooring, wiring within walls that are now sub-standard, etc).
Redevelopment Fund contribution to project are restricted to use on first floor construction; the Senior
Center programming expansion portion. The first floor is estimated to cost approximately 70% of the
total project or $997,150 which can be covered by the $1,027,017 in Redevelopment funds already
appropriated to the project.
ENVIRONMENTAL IMPACT:
Because the project is not increasing the floor area or intensity of use, it is exempt under CEQA, "Minor
Alterations of Existing Structures", Section 15301.

WHEREAS, the City Council of the City of Carlsbad, California, has previously
6
appropriated funds in the Fiscal Year 2006-2007 Capital Improvement Program for
7
improvements to the existing Carlsbad Senior Center, hereafter referred to as the8
9 "Project"; and
10 WHEREAS, on October 17, 2006, the City Council approved plans and
11 specifications and authorized the advertisement of bidding for the construction of the
12 Senior Center Improvements.
13 WHEREAS, on January 23, 2007, bids were opened for the Project and the
14 apparent low bidder is Good & Roberts, Inc. at $631,500; and
15
WHEREAS, the second low bidder, Stevens Construction, alleged that Good &
16
Roberts did not send in their subcontractor's prices within the required time limits as
17
specified in California Public Contracting Code; and18
,g WHEREAS, City staff reviewed the document and have determined that Good &
20 Roberts did timely submit the documentation; and
21 WHEREAS, Stevens Construction has informed staff that they have decided not
22 to pursue their objections; and
23 WHEREAS, the City Council of the City of Carlsbad hereby finds it necessary,

desirable, and in the public interest to provide improvements to the Senior Center; and
25 WHEREAS, adequate funds are available in the Fiscal Year 2006-2007 Capital
26
Improvement Program for the project in the amount of $1,535,229.

1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
2 Carlsbad, California, as follows:
3 1. That the above recitations are true and correct.

2. That the bids received by the City and opened on January 23, 2007 are
5
hereby accepted and the lowest responsive, responsible bid received is
6
hereby determined to be that which was submitted by Good & Roberts, Inc.,
g in the amount of $631,500.
9 3. That said bid received by City from Good & Roberts, Inc. is accepted, the
10 contract is hereby awarded to this firm, and the Mayor is authorized to
execute said contract on behalf of the City.
12 4. That the City Manager is hereby given the authority to approve
13
construction change orders, singly or in aggregate, for the Project, up to the
14
amount of the specified construction contingency.
