RECOMMENDED ACTION:
Adopt Resolution No.2007-044 accepting the construction contract on the Concrete
Replacement project, Project No. 6006 as complete, and directing the City Clerk to record a Notice of
Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On April 25, 2006, Romero General Construction Corp. was awarded a contract in the amount of
$1,143,350 for the Concrete Replacement project, Project No. 6006.
Romero General Construction Corp. substantially completed the concrete work on November 3, 2006.
The final punch list work was completed on January 19, 2007. City staff has inspected the work and
found it to be satisfactory. Staff recommends formal acceptance of the improvements by the City
Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING THE CONSTRUCTION
CONTRACT ON THE CONCRETE REPLACEMENT PROJECT,
4 PROJECT NO. 6006
5 WHEREAS, the construction of the Concrete Replacement project was substantially
6 completed on November 3, 2006, and all punch work was completed on January 19, 2007; and
7 WHEREAS, All work has been completed to the City's satisfaction by Romero General
8 Construction Corp.; and
9 WHEREAS, the formal project Notice of Completion has been prepared; and
10 WHEREAS, all project costs have been established to date.
11 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

13 1. That the above recitations are true and correct.
14 2. That the Concrete Replacement project, specifically identified as Project No.
15
6006, is deemed complete and is hereby accepted by the City Council of the City of Carlsbad.

3. The City Clerk of the City of Carlsbad is hereby authorized and directed to

execute and record the Notice of Completion for the Concrete Replacement project, Project No.
18
6006.
