RECOMMENDED ACTION:
Adopt Resolution No. 2007-045 accepting the construction contract on the 2006 Pavement
Overlay Project, Project No. 3667-13 as complete, and directing the City Clerk to record a Notice of
Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On June 13, 2006, Silvia Construction, Inc. was awarded a contract in the amount of $5,978,245 for
the 2006 Pavement Overlay Project, Project No. 3667-13.
Silvia Construction, Inc. substantially completed the pavement overlay work on October 24, 2006. The
final punch list work was completed on January 25, 2007. City staff has inspected the work and found
it to be satisfactory. Staff recommends formal acceptance of the improvements by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

CARLSBAD, CALIFORNIA, ACCEPTING THE CONSTRUCTION
3 CONTRACT ON THE 2006 PAVEMENT OVERLAY PROJECT,
PROJECT NO. 3667-13 AS COMPLETE

5 WHEREAS, the construction of the 2006 Pavement Overlay Project has been completed
6 to the City's satisfaction by Silvia Construction, Inc. on January 25, 2007; and
7 WHEREAS, the formal project Notice of Completion has been prepared; and
8 WHEREAS, all project costs have been established to date.
9 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
10 California, as follows:
1. That the above recitations are true and correct.
12 2. That the 2006 Pavement Overlay Project, specifically identified as Project No.
13 3667-13, is deemed complete and is hereby accepted by the City Council of the City of Carlsbad.

3. The City Clerk of the City of Carlsbad is hereby authorized and directed to

execute and record the Notice of Completion for the 2006 Pavement Overlay Project, Project No.
