RECOMMENDED ACTION:
Adopt Resolution No. 2007-073 appointing a citizen and registered voter of Carlsbad to fill
the unexpired term of former Council Member Norine Sigafoose or, alternatively, if no
appointment is made, to call for a special election.
ITEM EXPLANATION:
Former City Council Member Norine Sigafoose was elected to the Carlsbad City Council on
November 2, 2004 for a four year term ending in November 2008. On Tuesday February 27,
2007 the Carlsbad City Council accepted former Council Member Norine Sigafoose's letter of
resignation from her position on the Carlsbad City Council effective March 13, 2007. Under
local and state law, the City Council must either appoint a successor to fill the unexpired term of
former Council Member Norine Sigafoose or call for a special election within 30 days after the
commencement of the vacancy. (Carlsbad Municipal Code 2.04.030 and California Government
Code section 36512) The person so appointed by the City Council shall serve the remainder of
former Council Member Norine Sigafoose's term and until a successor is certified to take office.
If a successor is not appointed by April 12, 2007, then the City Council is required by law to call
a special election. A special election cannot be held sooner than 114 days after the call by the
City Council. Therefore, the next available date pursuant to law is the statewide election of
November 6, 2007. The Council may appoint a successor to hold office until the results of the
special election are certified.
If a special election is called the election calendar for it is attached as Exhibit "A".
FISCAL IMPACT:
The cost of a special election have been estimated by the City Clerk to be in the range of
$325,000 AND $400,000.
ENVIRONMENTAL IMPACT:
An appointment or a special election is not a project within the meaning of the California
Environmental Quality Act (Public Resources Code section 21065 and CEQA guidelines section
15357, 15377, and 15378).

SIGAFOOSE.

6 WHEREAS, Norine Sigafoose has resigned from her position as City Council
7 Member effective March 13, 2007; and
8 WHEREAS, Carlsbad Municipal Code Section 2.04.030, requires the City
9 Council to either appoint someone or call for a special election within 30 days of the
10 vacancy; and

WHEREAS, at the February 27, 2007 meeting, the City Council decided to fill the
12
vacancy by appointment; and
WHEREAS, Norine Sigafoose has left an unexpired term which ends November
15 2008;and
16 WHEREAS, the appointee will serve the balance of the unexpired term of former
17 Council Member Sigafoose until a successor is elected at the regular Municipal Election
18 of November 4, 2008.
19 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
20 Carlsbad, California, as follows:

1. That the above recitations are true and correct.

2. That the following citizen and registered voter of the City of Carlsbad is
24 hereby appointed to serve as a member of the Carlsbad City Council until a successor
25 is elected at the regular Municipal Election of November 4, 2008 and is certified to take

3. If no appointment is made by April 12, 2007, then the City Council calls for
a special election to be held as required by law on a date no sooner than 114 days from
this call, which date is November 6, 2007. The City Council appoints the following
citizen and registered voter of the City of Carlsbad to serve as a member of the City
Council until a successor is elected at the Special Municipal Election of November 6,
2007 and is certified to take office:
