ITEM EXPLANATION: Project Applications ZC 05-09 POP 05-01 Floodplain SUP 05-09 Administrative Approvals Reviewed by and Final at Planning Commission X To be reviewed - Final at Council X X The proposed project involves a request for a Zone Change (ZC), Precise Development Plan (POP), and Floodplain Special Use Permit (SUP) to allow the construction of new improvements and modification of existing structures on the Leucadia Wastewater District (LWD) campus site. The requested zone change is necessary to correct an existing General Plan/Zoning inconsistency by rezoning the property to Public Utilities (P-U) zoning to match the current Public Utility (U) General Plan designation. The POP is required for development in the P-U Zone. The Floodplain SUP is required because portions of the subject site are located within the 100-year floodplain. The proposed project complies with all development standards for the Public Utilities Zone and with the City's Floodplain Management Regulations. Approval of the requested permits will allow the LWD to remove or demolish the existing modular units on the site and construct a new headquarters building, a new workshop/storage building, and two new parking garages (for District vehicles). In addition, the exterior of the existing pump station would be remodeled to match the proposed new structures. At a public hearing on March 7, the Planning Commission voted unanimously (with Commissioner Whitton absent) to approve the Floodplain SUP and to recommend approval of the Zone Change and Precise Development Plan. At the hearing City staff presented the Commission with a letter of support for the project from the developer of the neighboring Albertson's shopping center property. No one spoke or provided any written opposition to the proposed project. FISCAL IMPACT: No new public infrastructure is required for this project. The costs of the proposed development will be borne by the developer (Leucadia Wastewater District). FOR CITY CLERKS USE ONLY. NS-837 and NS-838 Page 2 ENVIRONMENTAL IMPACT: As Lead Agency for the proposed project, the Leucadia Wastewater District conducted a review pursuant to the California Environmental Quality Act (CEQA). The District prepared and circulated a Draft Mitigated Negative Declaration (MND) between April and May 2005 and held a public scoping meeting on May 11, 2005. The LWD Board then issued a Mitigated Negative Declaration on June 8, 2005. City staff has relied upon that document in processing this project application. EXHIBITS: 1. City Council Ordinance No's. That the proposed Precise Development Plan is consistent with the public convenience, necessity and general welfare, and is consistent with sound planning principles in that the proposed new buildings and modifications to existing facilities are necessary to 10 provide sufficient employee work space, meeting space, and parking areas to adequately perform the operations and maintenance tasks related to the operation of the wastewater treatment facility and office use and the proposed construction is consistent with the Public Utilities General Plan designation and the Public Utility zoning proposed for the site. 13 The project is consistent with the City-Wide Facilities and Improvements Plan, the Local 14 Facilities Management Plan for Zone 6 and all City public facility policies and ordinances. The project includes elements or has been conditioned to construct or provide funding to ensure that all facilities and improvements regarding: sewer collection and treatment; water; drainage; circulation; fire; schools; parks and other recreational facilities; libraries; government administrative facilities; and open space, 17 related to the project will be installed to serve new development prior to or concurrent with need 18 4. That the project is consistent with the City's Landscape Manual (Carlsbad Municipal 19 Code Section 14.28.020 and Landscape Manual Section I B). 20 The Planning Commission has reviewed each of the exactions imposed on the Developer 21 contained in this resolution, and hereby finds, in this case, that the exactions are imposed to mitigate impacts caused by or reasonably related to the project, and the extent and the 22 degree of the exaction is in rough proportionality to the impact caused by the project. Conditions: 24 Note: Unless otherwise specified herein, all conditions shall be satisfied prior to issuance of 25 grading or building permit, whichever comes first. 26 1. If any of the following conditions fail to occur; or if they are, by their terms, to be implemented and maintained over time, if any of such conditions fail to be so implemented and maintained according to their terms, the City shall have the right to 2g revoke or modify all approvals herein granted; deny or further condition issuance of all future building permits; deny, revoke or further condition all certificates of occupancy issued under the authority of approvals herein granted; institute and prosecute litigation to PCRESONO. 6261 -2- compel their compliance with said conditions or seek damages for their violation. No 2 vested rights are gained by Developer or a successor in interest by the City's approval of this Precise Development Plan. 3 Staff is authorized and directed to make, or require Developer to make, all corrections 4 and modifications to the Precise Development Plan document(s) necessary to make them internally consistent and in conformity with final action on the project. Development shall occur substantially as shown in the approved Exhibits. Any proposed development different from this approval, shall require an amendment to this approval. 7 3. Developer shall comply with all applicable provisions of federal, state, and local laws and regulations in effect at the time of building permit issuance. 8 4. If any condition for construction of any public improvements or facilities, or the payment 9 of any fees in-lieu thereof, imposed by this approval or imposed by law on this Project n are challenged, this approval shall be suspended as provided in Government Code Section 66020. If any such condition is determined to be invalid this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. 12 5. Developer shall implement, or cause the implementation of, the Leucadia Wastewater District Site Improvement Project Mitigation Monitoring and Reporting Program dated June 2005. -. t- 6. Developer/Operator shall and does hereby agree to indemnify, protect, defend and hold harmless the City of Carlsbad, its Council members, officers, employees, agents, and 16 representatives, from and against any and all liabilities, losses, damages, demands, claims and costs, including court costs and attorney's fees incurred by the City arising, directly 17 or indirectly, from (a) City's approval and issuance of this Precise Development Plan, (b) City's approval or issuance of any permit or action, whether discretionary or non- discretionary, in connection with the use contemplated herein, and (c) 19 Developer/Operator's installation and operation of the facility permitted hereby, including without limitation, any and all liabilities arising from the emission by the 20 facility of electromagnetic fields or other energy waves or emissions. This obligation survives until all legal proceedings have been concluded and continues even if the City's approval is not validated. 22 7. Developer shall submit to the Planning Director a reproducible 24" x 36" mylar copy of 23 the Site Plan reflecting the conditions approved by the final decision making body. 24 8. This project shall comply with all conditions and mitigation measures which are required as part of the Zone 6 Local Facilities Management Plan and any amendments made to 25 that Plan prior to the issuance of building permits. 9. This approval is granted subject to the approval of ZC 05-09 and SUP 05-09 and is ~_ subject to all conditions contained in Planning Commission Resolutions No. 6260 and 6262 for those other approvals incorporated herein by reference. 28 10. Prior to issuance of building permits, Developer shall submit to the City a Notice of Restriction to be filed in the office of the County Recorder, subject to the satisfaction of PCRESONO. 6261 -3- the Planning Director, notifying all interested parties and successors in interest that the 2 City of Carlsbad has issued a Precise Development Plan (PDP 05-01) and Special Use Permit (SUP 05-09) by Resolutions No. 6261 and 6262 on the property. Said Notice of 3 Restriction shall note the property description, location of the file containing complete project details and all conditions of approval as well as any conditions or restrictions specified for inclusion in the Notice of Restriction. The Planning Director has the ,. authority to execute and record an amendment to the notice which modifies or terminates said notice upon a showing of good cause by the Developer or successor in interest. 6 11. No outdoor storage of materials shall occur onsite unless required by the Fire Chief. 7 When so required, the Developer shall submit and obtain approval of the Fire Chief and the Planning Director of an Outdoor Storage Plan, and thereafter comply with the approved plan. 12. Developer shall submit and obtain Planning Director approval of an exterior lighting plan including parking areas. All lighting shall be designed to reflect downward and avoid any impacts on adjacent homes or property. 11 13. All roof appurtenances, including air conditioners, shall be architecturally integrated and 12 concealed from view and the sound buffered from adjacent properties and streets, in substance as provided in Building Department Policy No. 80-6, to the satisfaction of the •* Directors of Community Development and Planning. 14 14. Developer shall submit and obtain Planning Director approval of a Final Landscape and j 5 Irrigation Plan showing conformance with the approved Preliminary Landscape Plan and the City's Landscape Manual. Developer shall construct and install all landscaping as 16 shown on the approved Final Plans, and maintain all landscaping in a healthy and thriving condition, free from weeds, trash, and debris. 15. The first submittal of Final Landscape and Irrigation Plans shall be pursuant to the landscape plan check process on file in the Planning Department and accompanied by the 19 project's building, improvement, and grading plans. 20 16. Developer shall construct, install and stripe not less than a total of 82 parking spaces, of which approximately 18 spaces shall be in enclosed garages, as shown on Exhibit "C". 21 17. Developer shall provide a minimum of five (5) bicycle parking spaces on site. 22 18. Upon approval by City Council the setbacks/yards, open space, height and bulk of buildings, fences and walls, landscaping, grading, dedication and improvement 24 requirements, phasing (if any), points of ingress and egress, and parking proposed by PDP 05-01 shall be the minimum development standards for PDP 05-01. 25 19. Upon approval by City Council this Precise Development Plan (PDP 05-01) site plan 26 shall become the approved site plan for the entire 4.18-acre Leucadia Wastewater District campus development and shall supersede all preceding approvals for the 27 site. 28 PCRESONO. 6261 -4- Engineering: 2 The term Developer or Contractor shall refer to Agency or District or its authorized representative for this project. The limits of the project relative to these conditions is within the 3 City Boundary of Carlsbad. 4 NOTE: Unless specifically stated in the condition, all of the following conditions must be met prior to issuance of grading or building permit, whichever comes first. t- GeneralO 7 20. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, Developer shall apply for and obtain approval from, the City Engineer 8 for the proposed haul route. 9 Fees/Agreements 21. Developer shall cause property owner to execute and submit to the City Engineer for recordation, the City's standard form Geologic Failure Hold Harmless Agreement. 22. Developer shall cause property owner to execute and submit to the City Engineer for recordation the City's standard form Drainage Hold Harmless Agreement regarding 13 drainage across the adjacent property. 14 23. Prior to approval of any grading or building permits for this project, Developer shall cause Owner to give written consent to the City Engineer to the annexation of the area shown within the boundaries of the subdivision into the existing City of Carlsbad Street Lighting and Landscaping District No. 1 and/or to the formation or annexation into an additional Street Lighting and Landscaping District. Said written consent shall be 17 on a form provided by the City Engineer. 18 Grading 19 24. Based upon a review of the proposed grading and the grading quantities shown on the site plan, a grading permit for this project is required. Developer shall apply for and obtain a grading permit from the City Engineer prior to issuance of a building permit for the project. 22 25. Prior to issuance of a grading permit or building permit, whichever occurs first, Developer shall submit to the City Engineer proof that a Notice of Intention for the start 23 of work has been submitted to the State Water Resources Control Board. 26. Upon completion of grading, Developer shall file an "as-graded" geologic plan with the City Engineer. The plan shall clearly show all the geology as exposed by the grading operation, all geologic corrective measures as actually constructed and must be based on 26 a contour map which represents both the pre and post site grading. The plan shall be signed by both the soils engineer and the engineering geologist, and shall be submitted on a 24" x 36" mylar or similar drafting film format suitable for a permanent record. 27. This project requires off site grading. No grading for private improvements shall occur outside the limits of this approval unless Developer obtains, records and submits a recorded copy to the City Engineer a grading or slope easement or agreement from the PCRESONO. 6261 -5- owners of the affected properties. If Developer is unable to obtain the grading or slope 2 easement, or agreement, no grading permit will be issued. In that case Developer must either apply for and obtain an amendment of this approval or modify the plans so grading 3 will not occur outside the project and apply for and obtain a finding of substantial conformance from both the City Engineer and Planning Director. 4 Dedications/Improvements fi 28. Additional drainage easements may be required. Developer shall dedicate and provide or install drainage structures, as may be required by the City Engineer, prior to or concurrent 7 with prior to or concurrent with any grading or building permit. 8 29. Developer shall provide the design of all drainage systems to the satisfaction of the City Engineer. All private drainage systems shall be inspected by the City. Developer shall 9 pay the standard improvement plancheck and inspection fees. 30. Developer shall execute a City standard Development Improvement Agreement to install 11 and secure with appropriate security as provided by law, public improvements shown on the site plan and the following improvements including, but not limited to clearing and 12 grubbing, grading, undergrounding or relocation of utilities, to City Standards to the satisfaction of the City Engineer. The improvements are: 13 a. Water line b. Fire hydrants Improvements listed above shall be constructed within 18 months of approval of the 16 subdivision or development improvement agreement or such other time as provided in said agreement. 17 31. Developer shall comply with the City's requirements of the National Pollutant Discharge 1 ° Elimination System (NPDES) permit. Developer shall provide improvements constructed , n pursuant to best management practices as referenced in the "California Storm Water Best Management Practices Handbook" to reduce surface pollutants to an acceptable level 20 prior to discharge to sensitive areas. Plans for such improvements shall be submitted to and subject to the approval of the City Engineer. Said plans shall include but not be 21 limited to notifying prospective owners and tenants of the following: 22 a. All owners and tenants shall coordinate efforts to establish or work with 23 established disposal programs to remove and properly dispose of toxic and hazardous waste products. 24 b. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil, 25 antifreeze, solvents, paints, paint thinners, wood preservatives, and other such ~ , fluids shall not be discharged into any street, public or private, or into storm drain or storm water conveyance systems. Use and disposal of pesticides, fungicides, 27 herbicides, insecticides, fertilizers and other such chemical treatments shall meet Federal, State, County and City requirements as prescribed in their respective 28 containers. PCRESONO. 6261 -6- c. Best Management Practices shall be used to eliminate or reduce surface pollutants 2 when planning any changes to the landscaping and surface improvements. 3 32. Prior to the issuance of grading permit or building permit, whichever occurs first, Developer shall submit for City approval a "Storm Water Pollution Prevention Plan (SWPPP)." The SWPPP shall be in compliance with current requirements and provisions - established by the San Diego Region of the California Regional Water Quality Control Board and City of Carlsbad Requirements. The SWPPP shall address measures to reduce 5 to the maximum extent practicable storm water pollutant runoff during construction of the project. At a minimum, the SWPPP shall: 7 a. include all content as established by the California Regional Water Quality Control Board requirements; b. include the receipt of "Notice of Intent" issued by the California Regional Water Quality Control Board; 10 c. recommend source control and treatment control Best Management Practices (BMPs) that will be implemented with this project to avoid contact or filter said pollutants from storm water to the maximum extent practicable before discharging to City right-of-way or natural drainage course; and d: establish specific procedures for handling spills and routine clean up. Special 13 considerations and effort shall be applied to employee education on the proper procedures for handling clean up and disposal of pollutants. 14 33. Prior to the issuance of grading permit or building permit, whichever occurs first, Developer shall submit for City approval a "Storm Water Management Plan (SWMP)." ,,- The SWMP shall demonstrate compliance with the City of Carlsbad Standard Urban Storm water Mitigation Plan (SUSMP), Order 2001-01 issued by the San Diego Region of 17 the California Regional Water Quality Control Board and City of Carlsbad Municipal Code, all versions in effect at time of permit issuance. The SWMP shall address 18 measures to avoid contact or filter said pollutants from storm water, to the maximum extent practicable, for the post-construction stage of the project. At a minimum, the 19 SWMP shall: 20 a. identify existing and post-development on-site pollutants-of-concern; 21 b. identify the hydrologic unit this project contributes to and impaired water bodies that could be impacted by this project; 22 c. recommend source controls and treatment controls that will be implemented with this project to avoid contact or filter said pollutants from storm water to the maximum extent practicable before discharging to City right-of-way; 24 d. establish specific procedures for handling spills and routine clean up. Special considerations and effort shall be applied to (RESIDENT/EMPLOYEE) education 25 on the proper procedures for handling clean up and disposal of pollutants; e. ensure long-term maintenance of all post construct BMPs in perpetuity; and f identify how post-development runoff rates and velocities from the site will not exceed the pre-development runoff rates and velocities to the maximum extent practicable. 28 PCRESONO. 6261 -7- Special Conditions 2 34. The Average Daily Trips (ADT) and floor area contained in the staff report and 3 shown on the site plan are for planning purposes only. Developer shall pay traffic impact and sewer impact fees based on Section 18.42 and Section 13.10 of the City of 4 Carlsbad Municipal Code, respectively. 35. The Developer shall design and construct public facilities within public right-of-way or 5 within minimum 20-feet wide easements granted to the District or the City of Carlsbad. At the discretion of the District Engineer, wider easements may be required for adequate 7 maintenance, access and/or joint utility purposes. o 36. Prior to commencement of construction, Developer shall pay all fees, deposits, and 0 charges for connection to public facilities. Developer shall pay the San Diego County Water Authority capacity charge (s) prior to issuance of Building Permits. 10 37. The Developer shall prepare a colored recycled water use map and submit this map to the 11 Planning Department for processing and approval by the District Engineer. 12 38. The Developer shall design and construct public water, sewer, and recycled water 13 facilities substantially as shown on the site plan to the satisfaction of the District Engineer. Proposed public facilities shall be reflected on public improvement plans. 14 39. This project is approved upon the express condition that building permits will not be 15 issued for the development of the subject property, unless the District Engineer has ., determined that adequate water and sewer facilities are available at the time of occupancy. 17 40. A fire flow system shall be required for this development and it shall be constructed as a 18 looped system. The Developer shall complete the looped water system by tying into the existing waterline system in the shopping center to the satisfaction of the District Engineer. 20 41. The Developer shall coordinate with the District Engineer regarding the looped system 21 and easements. 22 Code Reminders 23 The project is subject to all applicable provisions of local ordinances, including but not limited to 24 the following: 25 42. Developer shall pay a landscape plan check and inspection fee as required by Section 20.08.050 of the Carlsbad Municipal Code.26 27 43. II. INTRODUCTION The proposed project involves a request for a Zone Change (ZC), Precise Development Plan (PDF), and Floodplain Special Use Permit (SUP) to allow the construction of new improvements and modification of existing structures on the Leucadia Wastewater District campus site. The requested zone change is necessary to correct an existing General Plan/Zoning inconsistency by rezoning the property to Public Utilities (P-U) zoning to match the current Public Utility (U) General Plan designation. The PDF is required for development in the P-U Zone. The Floodplain SUP is required because portions of the subject site are located within the 100-year floodplain. The proposed project complies with all applicable development standards and other regulations, and there are no outstanding planning or engineering issues associated with the project. III. PROJECT DESCRIPTION AND BACKGROUND A. Project Description The proposed project involves demolishing and removing some existing structures, repaying the majority of the 4.18-ac site, remodeling of some existing structures, and construction of new improvements on the Leucadia Wastewater District (LWD) campus. Other existing facilities/structures would remain in place with no modifications. The campus uses include administrative activities and tertiary wastewater treatment activities. The LWD Treatment Facility currently serves approximately 60,000 residents in portions of Carlsbad, Leucadia, and Encinitas. The facility provides tertiary (only) wastewater treatment processing. Some of the o ZC 05-09/PDP 05-01/SUP 05-09 - LWD SITE IMPROVEMENT PROGRAM March 7, 2007 Page 2 wastewater which has received primary and secondary treatment at the Encina Water Pollution Control Facility (EWPCF) is pumped back to the LWD site where it receives tertiary treatment, resulting in grey water, which is then used by the La Costa Resort. The LWD facility can process up to 1 million gallons per day (MOD) of water. The La Costa Resort is the only user of this treated wastewater. If the La Costa Resort does not need all of the processed water, it goes back into the wastewater stream. If use is expected to be low for a longer time period (e.g., winter), the facility can be shut down. The proposed project would accommodate all current on- site employees and space for an anticipated ten new employees within the next 25 years. Listed below are the proposed new improvements and the existing facilities. Each is discussed in detail in the following analysis. (Refer to Exhibits "A" - "C" of the full-size plan sheets for locations of the various structures/uses.) Proposed new improvements include the following: • Headquarters/Administration building (12,800 sf) • Workshop/Storage building (3,294 sf) • Enclosed Parking Garage (small equipment/vehicles) (2,285 sf) • Enclosed Parking Garage (large equipment/vehicles) (1,950 sf) • Covered Parking Area (small equipment/vehicles) (7 spaces) • Entry Plaza • Entry Gate • Perimeter Fencing • Trash Enclosure Existing facilities/structures include the following: • Administration Building - 3,900-sf modular building, to be demolished • Support Annex/ Field Services Building - 400-sf modular building, to be demolished • Workshop/Maintenance Garage - 4,800-sf structure, to be demolished • Storage Building - 1,058-sf pre-fabricated metal building, to be demolished • Pump Station Overflow Basin - underground basin, to remain unchanged • Pump Station - 1,500-sf, to remain with exterior remodel to match new improvements • Chemical Feed and Storage Building - 1,600-sf building, to remain unchanged • Wastewater Treatment Facility - to remain unchanged Administration/Support Facilities New Headquarters/Administration Building The proposed new Headquarters/Administration building would be located on the southeastern portion of the site on a currently undeveloped area. The new building would be a 12,800-sf structure. The ground level will house a circular entry area, reception area, boardroom and board chamber, employee lounge, and numerous offices and work areas. There will be a small (less than 1,000-sf) basement (visible on the north elevation) which will house locker rooms and a laundry drop-off area. The second floor will house more office uses. There will be a small tile- finished balcony on the south side of the second floor off the general manager's office. The entry area and boardroom/board chambers will be on the western side of the building. The west elevation of the proposed building will be visible to the public from the shopping center/LWD shared entry off La Costa Avenue. The entry to the new building will be on the west elevation. The west and north elevations will incorporate concrete masonry, metal siding and panels, slate tiles, steel shade devices painted to match the building, and aluminum frame windows. The proposed building will be two stories and 28 feet high at the top of the parapet. The roof will be a sloped standing seam metal roof. The roof will incorporate several skylights over the office/work areas below. The new Headquarters building would replace the existing Administration building, which consists of a 3,900-sf modular building located on the western edge of the property. The old Administration building would be demolished. New Workshop/Storage Building The proposed new Workshop/Storage building would be located in the northeastern corner of the site. The workshop/storage building would be approximately 28 feet wide by 120 feet long and approximately 3,294-sf in size. It will be a single-story structure 13'10" high and will contain two small offices and some storage areas. The building will have a concrete masonry base (the lower 3 to 4 feet) with metal siding above and a sloped standing seam metal roof to match surrounding improvements. It will have three roll-up doors on the western side and aluminum frame windows. Parking The proposed project includes two new enclosed parking garages and a new covered parking area. Both of the proposed parking garages will have a concrete masonry base (the lower 3 to 4 feet) with metal siding above and a sloped standing seam metal roof to match surrounding improvements. The proposed new enclosed parking garage for small equipment/vehicles will be located on the northern edge of the site. It will be approximately 22 feet wide by 81 feet long and 2,285-sf in size and will be a single-story structure approximately 15'3" in height. It will contain approximately nine parking spaces in different sizes to accommodate vehicles associated with the LWD use. It will have four double-sized roll-up doors on the south side. The proposed new enclosed parking structure for large vehicles/equipment associated with the use would be located along the northwestern side of the property adjacent to the neighboring grocery store/shopping center. This building would be 40 feet wide and 48 feet long and 1,950- sf in size. It will be 18'6" high at the peak of the sloped roof. This building will have metal siding and roofing. It will accommodate four large vehicles and will have three roll-up doors on the east and west sides. The project also includes a new covered parking area for seven spaces located near the new headquarters building and another seven spaces next to the proposed small vehicle parking garage. In total, the project would provide a total of 82 parking spaces. ZC 05-09/PDP 05-0I/SUP 05-09 - LWD SITE IMPROVEMENT PROGRAM March 7, 2007 Page 4 Wastewater Processing Facilities Existing Pump Station The existing pump station is a masonry building located on the southwestern corner of the project site. It is approximately 1,500 sf in size with a height of approximately 12 feet at the peak of the mansard roof. (The mansard conceals the roof equipment.) It contains a control room, wet well, pump room, and related use areas. As a part of this proposed project, the building exterior will be remodeled to match the surrounding new improvements. Other Existing Structures/Facilities There are several existing structures/facilities on the project site which will remain unchanged in their current locations. These include a chemical feed and storage building, a pump station overflow basin, a contact tank, and reactor clarifier and filters. The existing 1,600-sf chemical feed and storage building is located on the northern portion of the site. This structure is approximately 16 feet high. The existing underground overflow basin is located east of the pump station. The existing contact tank (1,800 sf) is located in the central part of the project site (just north of the proposed new headquarters building). The tank structure is about 12 feet high. An existing reactor clarifier and sand filters (totaling about 900 sf) are located in the central part of the project site (near the existing contact tank). Other Facilities/Amenities Although this project is not required by Code to provide employee eating areas, the applicant is proposing to provide both indoor (459-sf) and outdoor (approximately 525-sf) employee eating areas. Both would be located on the eastern side of the new Headquarters building. The project includes a proposed 6-ft high retaining wall (fluted, cast-in-place concrete to match existing nearby structures) on the southern portion of the site adjacent to the pump station. A 6- ft high metal chain link fence is proposed around the perimeter of the facility except for the entry area to the interior of the site, where a combination of a 6-ft high metal fence (tubular steel) and an 8-ft high masonry wall (colored, with bead-blasted finish) will be located. A 6-ft high metal rolling gate would be installed at the entrance to this area. The majority of the site, including the administrative building area, parking areas, entry area and existing wastewater treatment process areas, will be asphalt paved. There will be a small area of concrete paving near the large vehicle parking garage. Site Preparation/Changes Earthwork for the proposed project involves 2,540 CY of cut and 1,080 CY of fill, resulting in an earthwork volume of approximately 732 CY/AC. This figure includes some off-site grading (60 CY of cut on the northwestern corner of the site) to better accommodate the proposed large vehicle parking garage and general circulation. Site Description The project site is located about 150 feet south of San Marcos Creek and about 1,000 feet southeast of Batiquitos Lagoon. A large berm was previously constructed on the La Costa Resort property to the north adjacent to the south bank of the creek. That berm was constructed by the shopping center developer and was intended to ensure that the 100-year flood would be contained within the bermed area. The project site is currently developed with the existing LWD administration building, pump stations, and storage and maintenance facilities. The site is generally flat from previous grading and contains a brow ditch on the southeastern portion of the site. The site is generally developed with the exception of an undeveloped, unvegetated area in the center and the southeastern portion (where the new Headquarters building would be located). The site contains no vegetation other than ornamental landscaping with the exception of a small area of disturbed coastal sage scrub (CSS) habitat in the southeastern corner of the site. The CSS area is outside of an existing retaining wall, isolated from the developed portion of the site. The proposed project will not change the existing development in this area and will not disturb the isolated CSS. The project site has a Public Utilities (U) General Plan designation and General Commercial (C2) zoning. The site currently contains the existing LWD administration building, pump station, and storage and maintenance facilities. The property to the north has an Open Space (OS) General Plan designation and Planned Community (P-C) zoning. The property to the east has a Travel/Recreation Commercial (TR) General Plan designation and P-C zoning. Both of these areas are developed as part of the La Costa Resort and Spa. The property areas immediately north and east of the LWD proposed project contain storage and maintenance structures for the La Costa Resort development. The property immediately to the south of the project site has OS and Local Shopping Center (L) General Plan designations and Neighborhood Commercial zoning with a Qualified Overlay (C-l/Q). That site is developed with Chabad at La Costa and a small parking lot for the shopping center uses. The property to the west has a Local Shopping Center (L) General Plan designation and Local Shopping Center (CL) zoning. That site is developed with the shopping center. C. Prior Actions The LWD site has had a number of permit approvals over the years. It was originally developed through approval of a Conditional Use Permit (CUP 77) under the existing commercial zoning. Permits previously approved for the site/project include: • CUP 77 - Planning Commission Resolution No. 877 for a sewer pump station; 20-year time limit; approved by Planning Commission on March 13, 1973; • CUP 130 - Planning Commission Resolution No. 1311 for a public building; no time limit; approved by Planning Commission on January 12, 1977; and, • CUP 130(A) - Planning Commission Resolution No. 3312 for an office addition and remodel; no time limit; approved by Planning Commission on November 20, 1991. The applicant originally applied for a CUP extension for the proposed project. However, the inconsistency between the current General Plan designation (U) and zoning (C-2) must be corrected, and the proposed P-U Zone requires the approval of a Precise Development Plan ZC 05-09/PDP 05-0I/SUP 05-09 - LWD SITE IMPROVEMENT PROGRAM March 7, 2007 Page 6 (PDF). Pursuant to these findings, the applicant applied for a zone change and PDF rather than an extension of or amendment to the CUP. IV. ANALYSIS The project requires approval of the following legislative actions: • Zone Change from General Commercial (C-2) to Public Utility (P-U); and, • Precise Development Plan (PDP) The project requires approval of the following discretionary permits: • Special Use Permit - Floodplain The project is subject to the following regulations and requirements: A. Carlsbad General Plan, including the Public Utilities (U) designation; B. Public Utility (P-U) Zone regulations (Chapter 21.36 of the Carlsbad Municipal Code); C. Special Use Permit (Floodplain Management) regulations (Chapter 21.110 of the Carlsbad Municipal Code); and D. Growth Management regulations (Chapter 21.90 of the Carlsbad Municipal Code); The recommendation for approval for this project was developed by analyzing the project's consistency with the applicable City regulations and policies. The project's compliance with each of the above regulations is discussed in detail in the sections below. A.General Plan The proposed project involves new improvements and changes to existing facilities and structures on the LWD campus site. The site currently contains, and will continue to contain, both office/administrative uses and tertiary wastewater treatment facilities. The site carries a Public Utility (U) General Plan designation. The U designation is the appropriate designation for the existing and proposed use. The proposed project is consistent with the various elements, goals, objectives, and policies of the General Plan, as demonstrated in Table 1, below. P-U Zoning/PDF The applicant is requesting to change the zoning of the property from General Commercial (C-2) to Public Utility (P-U). The proposed zone change would make the zoning on the site consistent with the Public Utility General Plan designation on the property. The C-2 zoning on the site is a carry-over from the neighboring shopping center. The P-U Zone is the implementing zone for the U General Plan designation and is the appropriate zone for the current and planned development of the site. The P-U Zone requires the approval by City Council of a Precise Development Plan (POP). The P-U Zone contains only two specific development standards: the minimum lot area and the maximum lot coverage. In recognition of the unique nature of public utility uses, all other development standards for the P-U Zone are subject to City Council approval. The proposed reconfiguration of the project site and consolidation of office areas will create the opportunity for an increase in the number of parking spaces on the site (over current numbers) for both employees and visitors. The calculation of the parking requirement for the proposed project is based upon the varied uses on the site and the number of expected employees and visitors. The applicant is proposing a total of 82 parking spaces (including enclosed spaces and spaces for vehicles associated with the use). This is six spaces more than the required number. C. Special Use Permit Regulations (SUP) - Floodplain Projects involving work within any area of special flood hazard must obtain approval of a Special Use Permit (SUP) by the floodplain administrator (the Planning Commission). The intent of these regulations is to promote the public health, safety, and welfare and to minimize public and private losses due to flood conditions. The project site is located approximately 150 feet south of San Marcos Creek and about 1,000 feet southeast of Batiquitos Lagoon and is within the 100-Year Floodplain boundary as shown on Flood Insurance Rate Map (FIRM) No. 06073C1034F, Panel No. 1034 of 2375, effective June 19, 1997. The site is designated as being within Zone A, which is an area that would be inundated by a 100-year flood and for which no base flood elevations have been identified. The proposed project would place portions of the proposed structures within the 100-year floodplain, and some of the existing facilities (not being modified) are and would remain within the 100-year floodplain. FEMA and the City's Floodplain regulations allow development in the floodplain subject to incorporation of specific construction methods and building materials to minimize the potential for flood related losses. Staff has included several conditions which ensure that the project complies with FEMA and City standards of construction within the floodplain area. Should LWD decide to pursue the removal of their site from the floodplain, staff has included a condition of approval which requires that the applicant receive approval of a Conditional Letter Of Map Revision (CLOMR) prior to issuance of a grading permit and a Letter Of Map Revision (LOMR) after grading is completed. These documents would have to be processed with FEMA. And, any site modifications which might be necessary to accomplish such an action would have to be reviewed by the City. However, removal of the site from the 100-year floodplain is not required for the proposed project to be in compliance with FEMA or the City's Floodplain regulations since the Floodplain Management Regulations do allow development within the 100- year floodplain. ZC 05-09/PDP 05-0I/SUP 05-09 - LWD SITE IMPROVEMENT PROGRAM March 7,2007 Page 9 Finally, the LWD has the ability to pump storm water off the site should it be necessary. Thus, the proposed development minimizes the potential flood hazard to the LWD site. Since the LWD site is a low spot relative to its neighbors, the proposed development would not represent an increased flood hazard to any surrounding upstream or downstream properties or uses. With the inclusion of the special conditions contained in Planning Commission Resolution No. 6262, the proposed project complies fully with all applicable FEMA and City of Carlsbad Floodplain Management Regulations D. Growth Management The proposed project is located within Local Facilities Management Zone 6 in the southeast quadrant of the City. The impacts on public facilities created by the project, and its compliance with the adopted performance standards, are summarized in Table 3 below. Mr. Neu introduced Agenda Item 3 and stated Senior Planner Elaine Blackburn would make the Staff presentation. Chairperson Baker asked if the applicant wished to continue with only six Commissioners present. The applicant confirmed that he would. Chairperson Baker opened the Public Hearing on Item 3. Ms. Blackburn gave a brief presentation and stated Staff would be available to answer any questions. Chairperson Baker asked if the Commission had any questions of Staff. Planning Commission Minutes March 7, 2007 Page 20 Commissioner Segall asked how many employees would be working out of the site. Ms. Blackburn stated the applicant could better answer that question. Commissioner Segall asked if the project is located within the 100-year floodplain and a flood occurs, what would happen to the building. He additionally inquired if there would be additional standards applied to the project because of the situation. Ms. Blackburn stated there are specific requirements in the floodplain regulations that call for certain types of building materials and construction methods that would ensure that should the area become inundated with water, the building would not be subject to shifting or collapse. Commissioner Segall asked if a subject property is removed from the floodplain designation, does that mean that it has been analyzed and a determination has been made that the property had been incorrectly placed there to begin with. Ms. Blackburn stated that is incorrect. She added what that would mean is, hydrology studies would have been conducted and submitted to the City and ultimately to FEMA. She stated changes to the site would be reviewed, including the berm that was previously created on the La Costa Resort property, which was intended to assist this area in this situation. Ms. Blackburn stated if FEMA were to agree that the increase to the berm height properly addresses all the floodplain issues when the area is remapped by FEMA, it would no longer be shown as being within the 100-year floodplain. Commissioner Dominguez asked if the map revisions have been partially completed or if they are conditional. Ms. Blackburn stated this area is unclear and it has been difficult locating some of the documentation. She added FEMA staff has been contacted and is in the process of researching the location of those documents. Ms. Blackburn stated when the shopping center was built, the engineers for that area conducted studies and submitted a Conditional Letter of Map Revision to the City and ultimately to FEMA. She added she has seen correspondence from FEMA that states the project is on track and requests the submission of the final studies and a final letter. Ms. Blackburn stated Staff does not have a copy of that document, which has been requested. If it cannot be located, the matter can be addressed by the Leucadia Wastewater staff by conducting the appropriate studies and following the same process. Chairperson Baker asked if there were any further questions of Staff; seeing none, she asked the applicant if he would like to give a presentation. Robin Morishita, Project Manager, Leucadia Wastewater District, 1960 La Costa Avenue, Carlsbad, stated Leucadia Wastewater currently employs 18 individuals at that location and has plans to increase the number to 28 within the next 20 years. Mr. Morishita stated the conditions have been reviewed and there are no objections. He added the project is being undertaken to (1) meet the future projected size of the Leucadia Wastewater organization and (2) improve the aesthetics of the location. Commissioner Segall asked why 82 parking spaces are included in the site development plan. Project Architect Joe Mansfield stated the number of parking spaces is based on the number of square footage of building space. He added it does come to a large number, but the building square footage is the driving factor in making that determination. Chairperson Baker asked if the space would be utilized in some other way if fewer parking spaces were required. Mr. Mansfield stated the development of the property was born from a needs assessment study that was conducted. During that study it was determined that the site would require reconfiguration. The current proposal is the result of that effort. He stated the site is divided into two distinct areas: a public side and a private/process side. There is room for potential activities that could occur at the plant, such as micro-filtration or reverse osmosis. Mr. Mansfield stated the future is unknown with respect to the water market and it is difficult to determine exactly what needs may arise for this site, but areas of the site have been set aside for potential future treatment facilities depending on need. Planning Commission Minutes March 7, 2007 Page 21 Mr. Mansfield stated the facility will serve as a polling station during elections and the excess parking spaces will be utilized. He added there are plans for community outreach programs, and the hope is that the board room at the new facility will also serve in an educational capacity for local schools. Chairperson Baker asked if the site would be maintained upon completion of the project. Mr. Mansfield stated the site has recently made improvements and is currently in a state of change. Mr. Morishita added there will be further progress in this area when the site is fully developed.
