RECOMMENDED ACTION:
Adopt Resolution Nos. 2007-081 and
members to the Planning Commission.
ITEM EXPLANATION:
The term of Marty Montgomery expires in April, 2007. Mr. Montgomery was originally
appointed to the Planning Commission in February, 2003, to fill the remainder of an
expired term. He was reappointed to a full term in March, 2003. Mr. Montgomery has
served on the Commission for four years and one month.
The term of Jeff Segall also expires in April, 2007. Mr. Segall was originally appointed in
March, 1999. He was subsequently reappointed to a full term in March, 2003, and has
served eight years.
Other members of the Planning Commission are: Julie Baker, Michael Cardosa,
Bill Dominguez, Farrah Douglas and Frank Whitton.
NOTE:Members of the Planning Commission are subject to the provisions of the
Political Reform Act, and must file a Statement of Economic Interests, Form 700.

EDUCATION: I received a Bachelor of Science in Industrial and Labor Relations from Cornell
University, Ithaca, New York in 1966.1 was awarded a Juris Doctor degree from the University of
California, Hastings College of the Law, San Francisco, California in 1969.1 was admitted to the
California Bar in January 1970.1 am authorized to practice in all State and Federal Courts in
California. I am also admitted to and authorized to practice before the United States Supreme Court.
EXPERIENCE: I have been in private law practice in Oceanside and Carlsbad since 1972 after
serving as a member of the Navy JAG in New York City. Presently my practice is focused on
business and real estate transactional matters, and trusts and estate planning.
I previously served on the Carlsbad Planning Commission, and was its Chair, as well as a
member of the Library Board of Trustees.
COMMUNITY ACTIVITIES: I am a long time member of Carlsbad Evening Rotary, and
served two terms on its Board of Directors. I am a Paul Harris Fellow. I am a 30 plus year member of
the Carlsbad Chamber of Commerce, having served on the Board for two plus terms, and as its
President in 1996.1 was the Chair of the Chamber's CBEC Committee in 2004 and 2005, and I have
been the Chair of the Village Enhancement Committee for the last two years.
I have been involved with countless community activities and organizations including helping
to establish the Carlsbad Arts Associates, the Batiquitos Festival of the Arts, ArtSplash, the Carlsbad
Library and Arts Foundation, and the Carlsbad Boys and Girls Club Foundation among others. I also
served on the Dove Library design committee, and numerous City task forces, including the City's
Connecting Community, Place and Spirit conference, and am currently an active participant in
Imagine Carlsbad. I presently serve on the following Boards: the Carlsbad Library and Arts Founda-
tion; Carlsbad Rotary Foundation; Carlsbad Chamber of Commerce; Full Access & Coordinated
Transportation (F.A.C.T.); and New Village Arts.
My late wife, Ann, who was also a Planning Commissioner and Library Trustee and I have
been active in Friends of the Library, Arts Associates, Carlsbad Historical Society, Agua Hedionda
Lagoon Foundation and AFS, among other local organizations during our thirty plus years in
Carlsbad.
ADDITIONAL INFORMATION OR COMMENTS: I would again appreciate the opportunity
to serve the City of Carlsbad, especially as it enters build-out and the unique and demanding
requirements that phase of the City's life will creates. Due to my long time involvement with the City,
I offer a unique perspective to the challenges we will be facing in the next five to ten years in
Carlsbad, and I would like to be part of helping develop that vision and long-term solution so that
Carlsbad will remain the preeminent city that it is today.

EDUCATION: I graduated from Stanford University with Departmental Honors and
University Distinction (B.A., International Relations, 1982), and earned my law degree from
the University of Virginia School of Law in 1987.
In June 2006,1 received a Professional Certificate in Urban Planning and Development
from the University of California - San Diego: Extension. The certificate program provides
technical tools and a legal framework for understanding financing, land-use, development,
and environmental planning. Required courses include Fundamentals of City Planning,
Urban Planning and Development Law, and Environmental Planning and Site Analysis. Over
the course of the 21-month program, I wrote several term papers on topics related to
Carlsbad, namely: (1) Housing Production in the City of Carlsbad: A Study of Supply and
Demand, (2) Habitat Management Plan for Natural Communities in the City of Carlsbad: An
Analysis of Impact on Site Development, and (3) The Carlsbad Strawberry Fields: A Study of
Competing Plans for the Cannon Road Area.
I have been a member of the California State Bar since 1998 and regularly attend
Continuing Legal Education programs on topics relevant to my practice area, such as
landlord-tenant law and property management. In order to enhance my understanding of
affordable housing projects, I plan to attend a half-day seminar on Financing Affordable
Housing in June 2007. I consider myself a "continual learner* and enjoy acquiring and
applying new knowledge and skills.
EXPERIENCE: I have almost twenty years of experience as a practicing attorney
representing established and early-stage public and private companies. My areas of expertise
include domestic and international commercial transactions, licensing and protection of
intellectual property, litigation, labor and employment, antitrust and general corporate. I
served as General Counsel for Astec America, Inc, a division of Emerson Electric based in
Carlsbad, and have held senior-level corporate legal positions at various other companies. I
began my career with a Top 100 law firm in Richmond, Virginia.
Currently, I work out of my home on a part-time, project basis for a technology
company in San Diego while I continue to develop and build my own law practice specializing
in landlord-tenant law, commercial leasing and real property transactions. I am also a
licensed Real Estate Broker although not actively engaged in the purchase and sale of real
estate.
COMMUNITY ACTIVITIES:
I participated in the Winter 2005 session of the Carlsbad Citizens' Academy. In August
2005,1 was appointed to the Carlsbad Housing Commission. In addition, I have served on
the City's Community Development Block Grant (CDBG)/HOME Advisory Board for the past
two years (2006-2007). I am also active in the local bar, currently serving as Vice Chair of
the Environmental Law and Land Use Section of the San Diego County Bar Association.
ADDITIONAL INFORMATION OR COMMENTS:
I have lived in Carlsbad since 1998 and do not currently own property in the City. I
have enjoyed serving on City Boards and Commissions and am familiar with City operations
and personnel. My experience with the City to date, coupled with my legal background and
training, would enable me to hit the ground running and quickly get up-to-speed on matters
coming before the Planning Commission. Moreover, I have specialized knowledge in the fields
of urban planning, land use and environmental law which I could apply to some of the City's
top-priority projects, including sensitive development of the Cannon Gateway area,
development of a planning vision for the Westfield Mall, and implementation of a consistent
planning vision for the Ponto beachfront area. I currently reside in the southwest quadrant of
the City (San Pacifico), although I do not own property there.
I am well-situated to carry out the duties and responsibilities of a Planning
Commissioner. Having worked for many years as a corporate in-house attorney, I am now
successfully self-employed with a flexible, part-time schedule. I realize that effective service
on the Planning Commission would require a big commitment of time and energy; I am fully
prepared to make that commitment. I would bring enthusiasm, diligence, discretion,
independence and a fresh perspective to the job.
I really love Carlsbad and believe we have something special here. I fully support and
agree with the Council's Five-Year Vision of Carlsbad as a city that manages its environment
proactively, maintains city-wide "small town" community spirit, and promotes a safe and
efficient integrated transportation system. At all times, I would seek to balance the personal
interests of residents impacted by proposed projects with the interests of the residents of
Carlsbad as a whole.

I request that you consider my reappointment to a second term on the Planning Commission for the City
of Carlsbad. I have mulled the decision for a second term appointment for a long time with my wife
Diane. My ownership of a local structural engineering firm in the Carlsbad coupled with kids still in
school weighed heavily on our minds. Ultimately we feel that I can balance these daily responsibilities
and still be able to provide stability, leadership and insight into a planning commission that is starting to
change in its makeup and composition.
I feel strongly about allowing the public to state their opinions to the commission freely so that they feel
that they have been treated fairly. I'm still an advocate for the quality of life here in Carlsbad. The
future of the desalination plant and securing that protection of our water resources is a fundamental task
of the leadership of this community. The La Costa Town Squate will be developed soon and will
require much effort in building a consensus. The southern gateway of our city at Ponto will be
deliberated at length in the next few years. Procuring open spaces for our citizens in an efficient and
cost effective manner is of great importance to our community.
I ask that you grant my reappointment to the Planning Commission. I believe I can continue to make a
difference and provide key input in the planning of these important projects and many others that will
come before the commission.
