CONSTRUCTION CONTRACT ON FOREST AVENUE
HDD GRAVITY SEWER PIPELINE

RECOMMENDED ACTION:
Adopt Resolution No. 2007-086 accepting the construction contract on Forest Avenue
Horizontal Directional Drill (HDD) Gravity Sewer Pipeline, Project No. 3495 as complete, and directing
the City Clerk to record a Notice of Completion and release bonds in accordance with State Law and
City Ordinances.
ITEM EXPLANATION:
On April 19, 2005, HMS Construction, Inc., (HMS) was awarded a contract in the amount of $539,843
for the construction of the Forest Avenue HDD Gravity Sewer Pipeline, Project No. 3495.
HMS completed the work on February 28, 2006. The vegetation establishment period ended
June 2006. In June 2006, Engineering Department staff requested a proposal from HMS
Construction, Inc., to modify a new S-1 Standard Sewer Access Hole to an S-2 Drop Access Hole due
to changed field conditions. Between March and June of 2006, unknown to staff, HMS discontinued
their sewer construction business and no longer employed workers to perform the work.
In response to the staff request, however, HMS contacted other construction companies for the
purpose of subcontracting the requested work. Unfortunately, potential subcontractors were not
interested in the requested work because of the low dollar value of the work and no proposals were
submitted to HMS Construction, Inc. As a result, the City was unable to include the additional work
under this contract due to unresponsive potential subcontractors. Staff stopped pursuit of the request
for proposal from HMS Construction, Inc., and will develop a construction strategy for the work to be
performed by a different contractor at a later date in 2007 under a separate contract.
City staff has inspected the work performed by HMS Construction, Inc., and found it to be satisfactory.
Formal acceptance of the improvements by the City Council is recommended.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING THE CONSTRUCTION
CONTRACT ON THE FOREST AVENUE HDD GRAVITY SEWER
4 PIPELINE. PROJECT NO. 3495.
5 WHEREAS, construction of the Forest Avenue HDD Gravity Sewer Pipeline has been
6 completed to the satisfaction of the City of Carlsbad by HMS Construction, Inc., on February 28,
7 2006; and
8 WHEREAS, the contractor re-vegetated some portions of the construction area and the
9 resulting extended establishment period delayed the issuance of the Notice of Completion; and
10 WHEREAS, additional work requested by staff was not able to be performed by
11 HMS Construction, Inc., since unresponsive subcontractors also delayed the issuance of the
12 Notice of Completion; and
13 WHEREAS, the formal project Notice of Completion has been prepared; and
14 WHEREAS, all project costs have been established to date.
15 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

1. That the above recitations are true and correct.
1R 2. That the Forest Avenue HDD Gravity Sewer Pipeline, specifically identified as
19 Project No. 3495, is deemed complete and is hereby accepted by the City Council of the City of
20 Carlsbad.
21 3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
22 execute and record the Notice of Completion for the Forest Avenue HDD Gravity Sewer Pipeline,
23 Project No. 3495.
