RECOMMENDED ACTION: ADOPT Resolution No2007-089APPROVING staffs recommendations for the preparation and content of a Request for Qualifications/Proposal (RFQ/RFP) from consulting firms to prepare a comprehensive update to the City's General Plan, Local Coastal Program, and Zoning Ordinance, including a program environmental impact report (PEIR). ITEM EXPLANATION: BACKGROUND On December 5, 2006, the City Council adopted Resolution No. 2006-355, accepting the Citygate Associates Development Review Process Action Plan and Recommendations. The Citygate report included a recommendation to comprehensively update the General Plan and Zoning Ordinance. The City Council's adoption of Resolution No. 2006-355 authorized the implementation of the Citygate recommendations. One of the Council's goals for FY 2006-2007 (Goal # 7737) consists of: 1) the development of a scope of work for completing a comprehensive update to the General Plan, Local Coastal Program, and Zoning Ordinance, including a PEIR; 2) the preparation and distribution of a RFQ/RFP to consultants; and 3) the submittal of proposals from consulting firms interested in assisting the City in completing the update program. DRAFT SCOPE OF WORK/UPDATE PROGRAM Staff has prepared a draft list of issues/topics (scope of work) to be considered in the update program (Exhibit 2). This scope of work will be included in the RFQ/RFP. Staff anticipates that the scope of work may be modified after input from citizens and stakeholders is received through the public outreach component of the update process. Therefore, staff recommends that the update program be conducted in two phases, as follows: GENERAL PLAN / LOCAL COASTAL PROGRAM / ZONING ORDINANCE UPDATE PROGRAM Phase One Community-wide public outreach (citizens, stakeholders, commissions, City Council, and other interest groups) Analysis of documents to be updated (including all related documents) Preparation of a final scope of work Report to the City Council on final scope of work. ^ FOR CITY CLERKS USE ONLY. The actual cost to complete Phase Two of the update program will be dependent upon the development of a final scope of work, which will be prepared after input is received through the public outreach phase. After Phase One is completed and a final scope of work is developed, the City will have the option to: 1) extend the contract and have the Phase One consultant complete Phase Two; or 2) prepare and distribute a RFP for Phase Two, and receive additional proposals for the completion of Phase Two. PUBLIC OUTREACH With regard to public input, which is the first step of Phase One, staff recommends that a public outreach program be developed after a consultant is hired to complete Phase One of the update program. It is staffs objective to create a public outreach program that is efficient and effective in obtaining valuable input from all segments of the community. Successful community participation in the update process will help to build community support and consensus for the future vision of the City, and will provide the City Council with valuable information related to the community's desires and concerns. Input from a consultant with prior experience in updating general plans and zoning ordinances in other jurisdictions will be valuable to the development of a successful public outreach program. With the assistance and advice of the Phase One consultant, staff will prepare a public outreach program and return to the City Council for concurrence prior to initiating a public outreach program. NEXT STEPS The following is a summary of the next steps that will occur after the City Council's adoption of Resolution No2007-089(Exhibit 1): 1. Staff will finalize and send the RFQ/RFP to the consulting firms listed on Exhibit 3 (target date to send RFQ/RFP is May 15, 2007); 2. The firms will be given 30 days to respond to the RFQ/RFP; 3. After reviewing all proposals received, staff will recommend the selection of the consultant that is best qualified to achieve the objectives of the update program (target date to select a consultant is June 29, 2007); 4. Staff will return to the City Council for approval of a contract with the recommended consulting firm to complete Phase One of the update program (target - July/August 2007); 5. Initiation of Phase One. DEPARTMENT CONTACT: Don Neu 760-602-4601 dneu@ci.carlsbad.ca.us Page 3 - RFP PREPARATION GENERAL PLAN/LOCAL COASTAL PROGRAM/ZONING ORDINANCE UPDATE/PEIR FISCAL IMPACT: As indicated in Agenda Bill No. 18,829 ("Acceptance of Citygate Associates Development Review Process Action Plan and Recommendations"), the estimated cost to update the General Plan is $800,000 to $1.5 million, and $100,000 for the first year to update the Zoning Ordinance (subsequent years to be determined). Overall, the update program is estimated to cost up to $1.8 million, which is earmarked in the Community Development Department contingency fund. The Finance Department is working with Planning staff to encumber these funds prior to the end of this fiscal year. ENVIRONMENTAL IMPACT: The preparation of a RFQ/RFP and initiation of Phase One of the update program (public outreach, analysis, research, and development of a final scope of work) will not involve or result in any disturbance to the environment, and is categorically exempt from the California Environmental Quality Act (CEQA). CEQA Section 15306 describes the following activities as being exempt from environmental review: "...basic data collection, research, experimental management, and resource evaluation activities which do not result in a serious or major disturbance to an environmental resource. These may be strictly for information gathering purposes, or as part of a study leading to an action which a public agency has not yet approved, adopted, or funded." EXHIBITS: 1.
