CITY MGR.
RECOMMENDED ACTION:
ADOPT Resolution No2007-089APPROVING staffs recommendations for the preparation and content
of a Request for Qualifications/Proposal (RFQ/RFP) from consulting firms to prepare a comprehensive
update to the City's General Plan, Local Coastal Program, and Zoning Ordinance, including a program
environmental impact report (PEIR).
ITEM EXPLANATION:
BACKGROUND
On December 5, 2006, the City Council adopted Resolution No. 2006-355, accepting the Citygate
Associates Development Review Process Action Plan and Recommendations. The Citygate report
included a recommendation to comprehensively update the General Plan and Zoning Ordinance. The
City Council's adoption of Resolution No. 2006-355 authorized the implementation of the Citygate
recommendations.
One of the Council's goals for FY 2006-2007 (Goal # 7737) consists of: 1) the development of a scope
of work for completing a comprehensive update to the General Plan, Local Coastal Program, and
Zoning Ordinance, including a PEIR; 2) the preparation and distribution of a RFQ/RFP to consultants;
and 3) the submittal of proposals from consulting firms interested in assisting the City in completing
the update program.
DRAFT SCOPE OF WORK/UPDATE PROGRAM
Staff has prepared a draft list of issues/topics (scope of work) to be considered in the update program
(Exhibit 2). This scope of work will be included in the RFQ/RFP. Staff anticipates that the scope of
work may be modified after input from citizens and stakeholders is received through the public
outreach component of the update process. Therefore, staff recommends that the update program be
conducted in two phases, as follows:
GENERAL PLAN / LOCAL COASTAL PROGRAM /
ZONING ORDINANCE UPDATE PROGRAM
Phase
One
Community-wide public outreach (citizens, stakeholders, commissions, City Council, and
other interest groups)
Analysis of documents to be updated (including all related documents)
Preparation of a final scope of work
Report to the City Council on final scope of work. ^
FOR CITY CLERKS USE ONLY.

RFQ/RFP
The RFQ/RFP will be sent to 12 consulting firms (Exhibit 3), and will request that the consulting firms
submit: 1) their qualifications to complete Phase One and Two of the update program; 2) a proposal
and budget to complete Phase One; and 3) an estimated cost to complete Phase Two. The actual
cost to complete Phase Two of the update program will be dependent upon the development of a final
scope of work, which will be prepared after input is received through the public outreach phase. After
Phase One is completed and a final scope of work is developed, the City will have the option to: 1)
extend the contract and have the Phase One consultant complete Phase Two; or 2) prepare and
distribute a RFP for Phase Two, and receive additional proposals for the completion of Phase Two.
PUBLIC OUTREACH
With regard to public input, which is the first step of Phase One, staff recommends that a public
outreach program be developed after a consultant is hired to complete Phase One of the update
program. It is staffs objective to create a public outreach program that is efficient and effective in
obtaining valuable input from all segments of the community. Successful community participation in
the update process will help to build community support and consensus for the future vision of the
City, and will provide the City Council with valuable information related to the community's desires and
concerns. Input from a consultant with prior experience in updating general plans and zoning
ordinances in other jurisdictions will be valuable to the development of a successful public outreach
program. With the assistance and advice of the Phase One consultant, staff will prepare a public
outreach program and return to the City Council for concurrence prior to initiating a public outreach
program.
NEXT STEPS
The following is a summary of the next steps that will occur after the City Council's adoption of
Resolution No2007-089(Exhibit 1):
1. Staff will finalize and send the RFQ/RFP to the consulting firms listed on Exhibit 3 (target date
to send RFQ/RFP is May 15, 2007);
2. The firms will be given 30 days to respond to the RFQ/RFP;
3. After reviewing all proposals received, staff will recommend the selection of the consultant
that is best qualified to achieve the objectives of the update program (target date to select a
consultant is June 29, 2007);
4. Staff will return to the City Council for approval of a contract with the recommended consulting
firm to complete Phase One of the update program (target - July/August 2007);
5. Initiation of Phase One.

ORDINANCE UPDATE/PEIR
FISCAL IMPACT:
As indicated in Agenda Bill No. 18,829 ("Acceptance of Citygate Associates Development Review
Process Action Plan and Recommendations"), the estimated cost to update the General Plan is $800,000
to $1.5 million, and $100,000 for the first year to update the Zoning Ordinance (subsequent years to be
determined). Overall, the update program is estimated to cost up to $1.8 million, which is earmarked in
the Community Development Department contingency fund. The Finance Department is working with
Planning staff to encumber these funds prior to the end of this fiscal year.
ENVIRONMENTAL IMPACT:
The preparation of a RFQ/RFP and initiation of Phase One of the update program (public outreach,
analysis, research, and development of a final scope of work) will not involve or result in any disturbance
to the environment, and is categorically exempt from the California Environmental Quality Act (CEQA).
CEQA Section 15306 describes the following activities as being exempt from environmental review:
"...basic data collection, research, experimental management, and resource evaluation
activities which do not result in a serious or major disturbance to an environmental
resource. These may be strictly for information gathering purposes, or as part of a study
leading to an action which a public agency has not yet approved, adopted, or funded."

LOCAL COASTAL PROGRAM (LAND USE PLAN) UPDATE
ISSUES/TOPICS TO BE CONSIDERED
Local Coastal Program (LCP)
• Revise format to create a more user-friendly LCP, and determine appropriate format
options:
o Incorporate into General Plan; or
o Separate General Plan element; or
o Separate document
• Consolidate maps with General Plan and Zoning maps
• Consolidate the six segments into a single Local Coastal Program
• Obtain Coastal Development Permit authority for the Agua Hedionda Segment and other
pockets of deferred certification
• Update to achieve consistency with Habitat Management Plan requirements
• Policies should be revised to not refer to specific properties by land owner name
• Address all topics required by the Coastal Act.
ZONING ORDINANCE UPDATE
ISSUES/TOPICS TO BE CONSIDERED
Consistency
• Evaluate zoning regulations for consistency with the updated General Plan, State law,
and other applicable regulations
User-Friendly
• Create a more user-friendly Zoning Ordinance
o More understandable terms
o Organized in a easier to read/follow format
o Use of graphics
Definitions
• Modify existing definitions for clarity and consistency with state law
• Create new definitions as needed
• Remove standards from definitions
• Consider locating all definitions in one definitions chapter
Land Use Matrix
• Consider creating a land use classification chapter
o Provide a single land use matrix in place of listing uses in each zone chapter
o Use general use categories in place of specific uses
o Consider adding the following uses to the list of permitted uses for certain zones:
» "Residential care facility (for 6 or fewer persons)"
» "Commercial living unit"
» "Farm worker housing"
Consolidate Chapters
• Consolidate chapters where possible to reduce volume and repetition, and provide
clarity
o Consider creating a Purpose and Intent chapter/section (consolidating Purpose
chapter and Zone Establishment - Boundaries chapter)
o Consider creating a General Development Regulations chapter (consolidate
standards that apply to all development - e.g., regulations for fences, constrained
lands, accessory structures, etc.)
o Consider creating zoning district chapters in place of a separate chapter for each
zone (e.g., consolidate residential zone chapters into one residential district chapter)
o Consider consolidating Variance and Administrative Variance chapters
Page 4 of 6
ZONING ORDINANCE UPDATE
ISSUES/TOPICS TO BE CONSIDERED. CONTINUED
Consolidate Chapters. Continued
o Consider consolidating all chapters/sections related to procedures, processes,
notices and fees
o Consider consolidating all chapters related to Coastal Development Permits and
coastal regulations
Eliminate Chapters
• Evaluate the potential to eliminate chapters that may be obsolete, and zones not
necessary to implement the General Plan (i.e. zones that can be replaced with another
zone that more effectively implements the General Plan)
o Example of zones that could be eliminated : E-A, R-A, R-E, R-P, R-T, L-C, T-C
o Example of other chapters that may be able to be eliminated: Planning Moratorium
chapter, Dedication of Land and Fees for School Facilities chapter
Industrial Zones
• Evaluate the industrial zones
o Ensure consistency with General Plan industrial policies
o P-M zone - consider revising purpose and intent, and consider allowing other uses
o C-M and M zones - Consider eliminating or modifying to achieve city's objectives for
industrial development (existing and new development)
Overlay Zones
• Evaluate the need for overlay zones (e.g., Q-Overlay, Hospital Overlay, Scenic
Preservation Overlay, Beach Area Overlay, Commercial Visitor Serving Overlay, etc.)
o May be able to achieve the purpose of the overlay zones (if still desirable) through
other means
New Zones/Standards
• Consider creating:
o New zones/standards as necessary to implement the updated General Plan
o A general commercial zone to implement a general commercial land use
designation (consolidate or replace the C-1 and C-2 zones)
o A zone and/or standards for mixed-use
o A zone to implement the school and Government land use designations
o A chapter for Specific Plans
o Standards for infill development
o Criteria/standards for "consistency/substantial conformance" determinations
Page 5 of 6
10
ZONING ORDINANCE UPDATE
ISSUES/TOPICS TO BE CONSIDERED. CONTINUED
New Zones/Standards. Continued
o A chapter for standards for specific uses (e.g., home occupations, recycling
facilities, bed and breakfast uses, etc.)
o Design standards for commercial and industrial development
o A condominium conversion ordinance
o A "hotel overlay zone" or other means of addressing (protecting/preserving)
hotels in the Beach Area that are nonconforming
• Consider adding Planning Department and City Council policies to the Zoning Ordinance
(e.g., Livable Communities policy, and Architectural Design Guidelines)
Existing Standards
• Evaluate/update existing standards for:
o Parking (update existing standards/ratios, provide standards for uses that the code
does not list a parking standard for)
o Planned Development (evaluate whether standards for condominiums should be
different from apartments)
o Non-residential Planned Development (evaluate whether a permit is needed or if a
subdivision map would be more appropriate)
o Nonconforming Buildings and Uses (update, evaluate policies, provide ability to
remodel nonconforming uses)
o Inclusionary Housing (consider no longer requiring City Council approval of
alternatives to construction of inclusionary units, and evaluate applicability of impact
fee)
o Fence/wall height regulations (update, modify, clarify)
o Hillside Development (evaluate policies and standards for how natural and
manufactured slopes are treated, establish threshold for what is a "hillside", clarify
applicability in/out of Coastal Zone)
o Floodplain regulations (update if necessary)
o Evaluate areas where variances are granted on a regular basis and modify
standards for those areas to reduce the need for variances
Master and Specific Plans
• Evaluate/amend Master and Specific Plans to ensure consistency with updated General
Plan and Zoning Ordinance
• Evaluate the potential of eliminating some Master or Specific Plans that can be replaced
by the updated Zoning Ordinance regulations
